5-23-2019 meeting minutes HEALTH- �n'k . 1, R Board: Board of Health Subcommittee: Date: May 23, 2019 City of Beverly, Massachusetts Public Meeting Minutes Place: Beverly Council on Aging, Arts & Crafts Room Board members present: Frank S. Carbone Jr. MD, William J. Alpine Jr. and Susan Higgins Board Members Absent: Others present: William Burke, Director of Public Health, Joyce Redford, M.E.D. Director NA /CA Tobacco alcohol Policy Program Recorder: Kathleen McCullough Chairman Carbone called the meeting to order at 7:30 a.m. The minutes of the April 11, 2019 meeting were approved and accepted as mailed. John Fatello attended the meeting requesting a lifeguard waiver for Gateway Condominium Trust on Rantoul St. He tests the pool during the week and has volunteers on the weekends. There has been no issue with the pool and Mr. Reale had done the inspection. Mr. Alpine motioned to approve the lifeguard waiver and Ms. Higgins seconded the vote. Mr. Pete Harkins attended the meeting seeking a variance for "Federal Food Code: 6- 202.15 Outer Opening, Protected" for his Backbeat Brewing Co. at 31A Park Street. He will be offering a limited food menu with pasties stored in sealed cases and assembling breakfast sandwiches in the morning. The sandwich prep area is sealed off with self- closing stainless swinging doors and a sliding window pass through for food once prepared. He plans to have a patio outside and a sliding window for patrons to pick up their orders. There will be a control fence around the perimeter of the patio and a self- closing door. He will have a pest control company monitoring for flies and rodents. He is anticipating having the depot train traffic and will also utilize pop -ups. The dumpster will be sixty feet away from restaurant. All other City Departments have approved his proposal. Mr. Alpine motioned to conditionally grant this variance for from Federal Food Code 6- 202.15 with the proposed structural safeguards (self- contained food prep areas with self- closing doors and pass through window); limited menu; increased monitoring for pests by a licensed pest control firm and other standard language pertinent to such a variance. Seconded by Ms. Higgins. Vote unanimous. The Tobacco Regulations were reviewed. All agreed that the parental language be omitted as discussed previously. The Board was in favor of accepting the new wording in the regulations. Mr. Alpine motioned to adopt the changes to the regulations and Ms. Higgins seconded the vote which made it unanimous. Joyce Redford discussed the issue of T. D. Family Market, 409 Cabot St. having flavored products behind the counter when she did a compliance check. There was flavored product in bags, hidden products in boxes, blunt wraps, flavored cigars and vape pens. All of these products are banned for sale in stores except Adult Only Tobacco Stores. This is the third offense which carries a fine of $300 and 30 day suspension of license. Q6 in the regulations states "the foregoing fines and penalties in no way limit the Board of Health's ability to suspend or permanently revoke an establishment's Tobacco Product Sales Permit if the seriousness of the circumstances or events underlying any violation warrant such suspension or revocation in the discretion of the Board ". The Board has taken into consideration that this is a serious offense. Mr. Burke will issue third violation notice /fine and make permit holder aware of Section Q.6. Ms. Redford also addressed her findings at the private clubs. Three of the clubs do not allow smoking and four still have a smoking room. Some of the clubs have been approached by their insurance companies regarding smoking being a fire hazard in the clubs. Mr. Burke had a few updates for the Board. The Household Hazardous Waste Collection was held on Saturday April 20. In total the number of cars was 320 compared to 203 for 2018. Forty -seven of those were from Salem. The preliminary total cost for this year was $11,423 versus $10,386 from last year but many more cars were served this year. Mr. Burke thanked all who helped including Ms. Higgins. Teresa Kirsch has been in Washington D.C. for a few days for a grants training. She also has been reviewing camp applications and will inspect them when camps open. Mr. Burke will go before the City Council on Tuesday May 28t' for the next years' budget hearing. The budget remains unchanged after the meeting with the mayor on April 18. Mr. Reale has started inspections of the seasonal pools. Many of the pools will be opening on the Memorial Day weekend. The beach water inspections will begin the week of June 10' and continue for 12 weeks. Code changes in utilization of the geometric mean will require the geomean to be calculated on the last five samples versus the last five non -rain event samples. This may translate into more postings. The rooming houses are now having the semi - annual inspection of common areas. The rooms are inspected in the fall. All employees have attended a training for Google email. The city is switching from the current Microsoft email server to a more friendly Google email server. The switch will occur over the long holiday weekend. Mr. Reale, Mr. Goodwin, and Mr. Burke attended an annual CSP seminar on Housing, Recreational Waters, Camps and offered CEU's to those attending. The Medication Disposal Collection was held on April 27, 2019. There were 104 participants. The Police disposed of 356 lbs. of unwanted medication, much of it collected at the Police Station.
