Public Meeting Minutes

Vice Chair William J. Alpine Jr. called the meeting to order at 7:30 a.m. in the absence
of Chairman Carbone who was excused from today's meeting.
The minutes of the January 17, 2017 meeting were approved and accepted as mailed.
Christopher and Danyelle DiGuardia of 30 Chase St. have applied for a keeping of animals
permit to obtain two female Nigerian dwarf goats on their property. They currently have a permit
for chickens. The goats will be contained within a six foot high fence and evergreens will
be planted around property in the future. Animal Control Officer Lipinski suggested a
conditional permit to start but added that there have been no issues with the goats on Federal
Street. Mr. Burke suggested two separate permits, one for chickens and one for goats.
Mr. Burke advised them that the Board will discuss it and contact them with the decision.
Attorney Stephen Lovely representing Ann Chainey owner of 41 West St. did not appear at the
meeting after requesting a hearing per the Chapter II of the State Sanitary Code. Tenants of the
apartment appeared and voiced concern over violations that have not been taken care of by
owner. The Board sustained the order and it shall be carried out within the time period allotted in
the original order. Mr. Burke will send a letter to owner stating the violations must be corrected
and reinspected or the matter will go to the Housing Court.
Victor Capozzi, the Director of the Italian Community Center, spoke on behalf of the
smoking regulations pertaining to private clubs. He would like the clubs to be included in
the regulations as "no smoking" areas. He says there is food served and people are smoking
in the same room. He said it is in violation of State Regulation. Joyce Redford informed the
Board that it might be a matter for a Public Hearing. This matter will be continued at the
next Board meeting.
The Board resumed the discussion of amending the tobacco regulations for adult -
only tobacco shops. Signage shall be posted at all entrances stating persons under the age
of 21 are prohibited. A violation of both 1 and 2 of Section D will constitute two violations
and result in two penalties.
Ms. Higgins motioned to accept the proposed amendments for the purpose of sending them
to the Solicitors Office for review and comments.
Ms. Higgins motioned to accept the Keeping of Animals permit at 30 Chase St., and Mr. Alpine
seconded.
Mr. Burke reviewed the 2019 Best Management Practice Plan for Beverly provided by
Northeast Massachusetts Mosquito Control & Wetlands Management District. The public
may opt out of the spraying by using the website and filling out a waiver.
Mr. Burke had a few updates for the Board.
Mr. Burke and Teresa Kirsch visited the middle school and high school with Emergency
Prepardedness consultant, and M. Foster and J. Hill of Beverly Emergency Management to
identify large dispensing sites for an emergency.
They also attended a regional meeting on potential amendments to the Body Art Regulation.
Topics included language for apprentices, micro blading and micropigmentation.
Mr. Burke and the staff will be attending several trainings and recertifications; CPO licensing,
training on 2013 Food Code adopted by the state recently, and annual DEP /Title 5 seminar.
The next scheduled meeting is March 14, 2019.
Ms. Higgins motioned to adjourn meeting, Mr. Alpine seconded.
