9-6-2018 meeting minutess: City of Beverly, Massachusetts Public Meeting Minutes Board: Board of Health Subcommittee: Date: September 6, 2018 Place: Beverly Council on Aging, Arts & Crafts Room Board members present: Frank S. Carbone Jr. MD, Susan Higgins Board Members Absent: William J. Alpine Jr. Others present: William Burke, Director of Public Health, Teresa Kirsch, Public Health Nurse, Bruce Doig, Community Services Director Recorder: Kathleen McCullough Chairman Carbone called the meeting to order at 7:30 a.m. The minutes of the June 20, 2018 meeting were approved and accepted as mailed. Danyelle Diguardia of 30 Chase St. has applied for a Keeping of Animals permit to have 12 chickens. She acquired the chickens last year. There have been no objections from her neighbors and the children enjoy them. There is a compost bin for the waste. Officer Matt Lipinski has looked at the site and approved the coop. Francine Whu of The Boston Smoke Shop 321 Cabot St. has requested a hearing by the Board of Health. A compliance check by the North Shore /Cape Ann Tobacco Alcohol Policy Program was conducted on July 23, 2018 and they sold to a minor violating Tobacco Sales regulations. This was the second violation within a 36 month period. Mr. Burke asked the Solicitor for advice. Their opinion about the second violation was that it should not be considered a second violation because the first was in December 2017 and under different ownership. Also, the regulations do not address any signage of adult -only retail tobacco stores which would prohibit people under 21 from entering the store. They recommend that the regulations be amended to address these issues. Ms. Whu said they are in the process of retraining all employees. The Board discussed wording the permits for the adult only shops to include "over 21 ". Mr. Burke will send out letters to all four adult only smoke shops informing them of the changes in the regulations and that the Health Department will consider entry of anyone under the age of 21 as a distinct violation. Concurrently we are waiting for any further input from Tobacco Control. A vote was taken on approving the Keeping of Animals permit for Danyelle Diguardia. Ms. Higgins was concerned that the footage was too close to the abutter's property (21 feet). Mr. Burke said that we have granted permits without having the exact number of footage from abutters. Ms. Higgins motioned approval of permit conditionally based on closeness to neighbors. Mr. Burke had a few updates for the Board. There was a positive West Nile Virus mosquito sample. The species was a predominant bird biter. A supplemental trap was deployed for additional surveilance. The district will advise as further results are received. At the May 9 meeting the Board approved a Keeping of Animal permit for Maureen Tanzella of 29 Eastern Ave. There were several neighbor attending the meeting that opposed the permit because there have been issues with her property such as abandoned vehicles, tires and a unused pool. The Board issued the permit but would review the matter at the September meeting. Mr. Burke reported that he has not received any complaints to date about the chickens The Dental Clinic is up and running at their new location in the Beverly High School. On July 18 the Health Department found the 11 Charles St. multi - family building unfit for human habitation and determination of immediate danger and ordered to vacate. The Building Department has since secured the building. Teresa Kirsch, Public Health Nurse has planned the first flu clinic for October 9t''. There will be a first responders clinic on September 26t''. She has purchased both high dose, regular dose and flu mist vaccine this year.
