Pursuant to the Planning Board's approval of 112 Rantoul Street, Barnat Development, LLC has contributed $38,000 to the City of Beverly for purposes outlined above. This contribution requires City Council approval before any of the funds can be expended for the prescribed purposes pursuant to Chapter 44 section 53A of the Massachusetts General Law. Please initiate action on this at your next City Council meeting on September 5, 2017. If you have any questions, please contact Aaron Clausen, City Planner, relative to the contribution. Planning Director Michael Collins, Commissioner Public Services Greg St. Louis, City Engineer Referred to Finance & Property #477 September 5, 2017 The Honorable City Council 191 Cabot Street Beverly, MA 01915 Re: Home Rule Petition seeking amendment of Chapter 7 of the Acts of 2009 Dear Honorable City Council: In 2008, this Honorable City Council passed order #253 petitioning the Legislature of the Commonwealth of Massachusetts to approve special legislation issuing two additional liquor licenses to establishments in the City of Beverly. The order requested that the special legislation grant licenses to Joseph A. Leone, d /b /a the Black Cow for a restaurant at 1 Water Street and to American BBQ LLC d /b /a the American BBQ at 950 Cummings Center, Suite 96 -X. The General Court passed the requested legislation as Chapter 7 of the acts of 2009. As you are aware, the Black Cow project never came to fruition and therefore a license was never issued at 1 Water Street. In order for the license to be issued to a new restaurant at 1 Water Street, Chapter 7 of the acts of 2009 must be amended by deleting the words "Joseph Leone, d /b /a The Black Cow, for" This amendment will allow the City to issue the license to whatever restaurant is ultimately built at 1 Water Street. I request that the Council proceed with the appropriate action to approve this Home Rule Petition, so that the Act may be amended and the license may ultimately be issued. Cahill Mayor That the Legislature of the Commonwealth of Massachusetts be requested to amend Chapter 7 of the acts of 2009 by striking out in the first sentence the words, "Joseph Leone, d /b /a The Black Cow, for" A copy of Chapter 7 of the Acts of 2009 is attached. HOME RULE PETITION Voted, to authorize the Legislature of the Commonwealth of Massachusetts to amend Chapter 7 of the acts of 2009 in order that the City of Beverly may issue the liquor license intended for a restaurant at 1 Water Street. In Chapter 7 of the acts of 2009, Joseph Leone, d /b /a the Black Cow, was named as the intended recipient of the liquor license. The Black Cow project never came to fruition, and therefore the liquor license never issued. The City of Beverly is now looking to have the ability to issue the liquor license to a new restaurant at the same property. The Legislature may reasonably vary the form and substance of the requested legislation within the scope of the general public objectives of this petition.
