BHMA Minutes October 19 2016Harbor Management Authority Minutes of October 19, 2016 Meeting CITY OF BEVERLY PUBLIC MEETING MINUTES Board: Harbor Management Authority Date: October 19, 2016 Location: Beverly Public Library -Fogg Room Members Present: Chair Paul Earl, Rinus Oosthoek, David Suminsby, George Simon, Emily Flaherty, Don Neuman, Paul Miedzionoski, Estelle Rand, Members Absent: Scott Houseman, Pat McAleer, Chris D'Alfonso, Rob Dever (Marina Manager) Others Present: Greg Howard Recorder: Brett Bauer Earl called the meeting to order at 7:00 pm Approval of Minutes Oosthoek motions to approve the September 14, 2016 meeting minutes. Seconded by Neuman. All approved, motion passes unanimously (6 -0). Facilities Committee Report New developments: Earl reports that the A/C is in at the Harbormaster building. The walls are scheduled to be completed next. Dever hopes to start moving out of the McDonalds building in a couple of weeks. The problem with the marina bathrooms has been identified and they will be fully operationally soon. The commercial tenants will be able to monitor the bathrooms during the winter to help determine maintenance needs. Oosthoek recommends refraining from distributing key cards for the bathrooms until a cleaning contract is in place. Suminsby raises the question of rates for recreational slips and sees no reason to raise the rates. Earl and Simon agree. Earl adds that he sees no reason to offer the discount to returning customers. Oosthoek adds that this was originally started when slips were vacant through the season. Oosthoek motions to remove the promotional discount for returning tenants. Neuman seconds. Simon asks for a discussion and states that he is in favor of the discounts. There being no further discussion, a vote is taken. Oosthoek seconds the motion. The motion passes (7 -0). Financials Report Earl reports that all tenants have paid at this point, $95,000 total. They are one slip short of full. Next year, Earl suggests being more aware of those on the waiting list. An open slip could be offered to a smaller boat that may be willing to pay the fee for a larger slip. Neuman adds that city owned boats should not be occupying slips, giving the appearance that all slips are occupied. Neuman requests clarification about two commercial slips that had not been fully paid. Earl confirmed that they are now all paid in full. Recreational Floats Neuman reports that costs of the piling project are expected to rise from $400,000 to $500,000. Seaport grants will require a 20% share. The permits are being reviewed and everything is moving along. Grants Opportunities Flaherty expects to hear back soon regarding the grant for Obear Park. Flaherty has spoken with Greg St. Louis regarding a coastal pollution project, but this will likely wait until next spring. It could include a rain garden at Congress Street beach, but there are concerns that it would be one more thing to maintain. Rand has spoken with local artists that applied for grants through the cultural council regarding murals for the public walkway. After looking at the walkway recently, she felt a mural on each side of the walkway might be appropriate. She suggested that the HMA consider providing some financial support. Earl will put discussion on the November agenda. Rand also noticed the homeless population moving into this area. Earl noted that the City is aware of this development. Bass River Dredging Neuman reports that the regulatory agencies are insisting that new sampling is needed and are showing no signs of flexibility. Oosthoek asks if we have talked with Danvers or Salem about any future dredging plans they may have, or how it may have been done in the past. 2 1 Page Harbor Management Authority Minutes of October 19, 2016 Meeting Dinghy Storage Regulations Neuman added language to the Recreational Slip Agreement that states items left on the floats must be removed within 24 hours after being warned either verbally, by email, or in writing. If not removed within 24 hours, a fine of $35 per day will be added to the amount due. A second and subsequent violations would incur a fine of $35 per day without a 24 hour warning period. Neuman motions to approve changes to section 19 with minor changes to section 21 of the Residential Slip Agreement as proposed. Oosthoek seconds the motion. Simon asks for a discussion and questions how this will be enforced without daily coverage at the marina. Oosthoek suggests an additional warning be added. Earl motions to amend by requiring two warnings by email or letter, followed by a fine if items are not removed within 24 hours of the second warning. Oosthoek seconds the motion to amend. The motion as amended is approved (8- 0). Slip Contract Review Oosthoek proposes new language regarding late fees to the Slip Agreement that include: 1) 15% of the slip fees paid at time the agreement is executed. 2) 100% of the total slip fee paid before placing a boat in the slip. 3) $100 admin fee will be added each month to the unpaid balance owed. 4) For boats remaining in the slip after October 15, $50 per day will be charged. Oosthoek motions to approve changes to sections 3, 15, and 18 as proposed. Rand seconds the motion. There is some discussion as to whether the admin fee is enough to persuade tenants to pay fees in a timely manner. Rand asks if the fees are comparable to other marinas. Earl responds that all other marinas collect fees up front or slips are not permitted to be occupied. Neuman motions to amend by changing the admin fee to $200 per month. Rand seconds the motion to amend. The motion as amended is approved (7 -1). Master Plan Update Simon and Oosthoek mentions that the HMA should continue to emphasize improving public access. Earl will keep the Master Plan update on the agenda for one more month to allow sufficient time for further review and comments. Public Info Map and Signage Flaherty is still waiting to meet about the placement of the public info signage. The placement of the signage should be coordinated with any mural projects along the public walkway. Earl adds 3 1 Page Harbor Management Authority Minutes of October 19, 2016 Meeting that an attempt should be made to determine whether grant money is available for the sign placement. Storm Water Permit for GW Neuman proposes that the HMA bring this item to the attention of the City. Earl agrees, and will send a communication. Public input A member of the public in attendance inquires about the potential for development of a restaurant at Glover Wharf. Oosthoek comments that an RIP had been issued for development of a restaurant on the harbor, but only one bid was received, and it did not qualify. A new RFP should be issued. Adjournment There being no further business before the Harbor Management Authority this evening, Neuman makes a motion to adjourn. Oosthoek seconds. Motion to adjourn approved unanimously (8 -0).
