Bertoni calls the meeting to order at 7:00 p.m. at Beverly City Hall, 3 d Floor Council Chambers,
191 Cabot Street, Beverly, MA.
REOUEST FOR DETERMINATION OF APPLICABILITY
New: 84 West Street — construct mudroom — Thomas Tribuna
Maxner reads legal notice. Mr. Tribuna explains he proposes to construct a 14'x14' single level
mudroom addition to be supported by five 10 -inch diameter sonotubes, no foundation is
proposed. The mudroom will replace an existing set of stairs and be located adjoining to the
existing house between the house and garage. Work will take place approximately 160 feet from
the MHW of the perennial stream Chubbs Brook and Bordering Land Subject to Flooding (i.e.
100 -Year Floodplain at elevation 14 NAVD). The total impact to floodplain is 2.72 square feet.
The runoff from new roof will go to downspout to crushed stone walkway.
Donnelly moves to issue Negative #2 Determination with excavated soil removed from site and
excavation equipment kept on asphalt. Seconded by Paluzzi. The motion carries 4 -0.

ABBREVIATED NOTICE OF RESOURCE AREA DELINEATION
Cont: 38 Standley Street — review and affirm extent and character of delineated wetlands
on site — Waring School, Inc. c/o Leah McGavern
John Dick, Hancock Associates, representing the applicant notes the Commission conducted a
recent site visit. He reports the difference between MHW (elevation 55) and wetland delineation
(elevation 58) is 3 vertical feet per Beverly GIS. The School is contemplating a subdivision of

land, subdivision approval not required or pork chop lot for this section of their campus. A
Natural Heritage filing may have to be done if Sweetbay Magnolia is found on the site, and that
the Standley Street OSRD subdivision was determined not to pose an impact to the species
habitat. Dick will provide a data sheet on soil tests done on site (flag #A3). The Commission
notes that if a development plan is brought forward the wetland delineation should be revisited.
Paluzzi moves to close the hearing. Seconded by Donnelly. The motion carries 4- O.Paluzzi
moves to issue an ORAD with delineation as presented. Seconded by Donnelly. The motion
carries 4 -0.

Cont: 43 Brackenbury Lane — demolish and reconstruct single- family house with addition,
driveway and utilitimprovements, construct in- ground swimming pool — Scott Rouisse
Bob Griffin representing the applicant reports on receipt of correspondence from an abutter on
issues that have to be responded to and requests a continuation. Paluzzi moves to continue the
hearing until March 1, 2016. Seconded by Donnelly. The motion carries 4 -0.
New: 49 & 51 Sonning Road — grade and restore ground surface within buffer zone
appurtenant to construction of new house outside the buffer zone — Joe Skomurski,
Skomurski Development, LLC
Maxner reads legal notice. Bill Manuell representing the applicant explains the proposal to level
off dirt piles, loam and seed within the buffer zone, and construct a single family house and
associated appurtenances outside the buffer zone. An Order of Conditions issued in 2005 for a
similar project has expired. The two lots are being treated as one and interior lot line will be
erased working through a subdivision approval not required with the Planning Board.
Manuell goes on to explain the resource area is a drainage ditch that comes from under Route
128. An excavated stream channel exits the headwall and cuts across the corner of the property

and continues to a swamp behind homes on Sonning Road. A filter sock would be located at the
25' No Disturb Zone and the NDZ will be allowed to revegetate naturally. He notes that all
impacted soil has been removed and contamination controlled at the site as part of Response
Action Outcome (RAO) with the DEP.
Resident from 53 Sonning Road inquired about water flow from the headwall and location of the
house. Manuell states that he thought area to the west of the property outside of the buffer zone
would be landscaped. He adds that monitoring wells would be removed from the site. Resident
of 44 Sonning Road inquired about proposed raising the grade of the parcel and discussion
ensues with these residents about runoff from the site and if clean fill was brought in. Maxner
explains that any grading outside of the buffer zone is reviewed by the City Engineer which will
occur when building permit is sought.
There being no further questions from the audience or Commission, Paluzzi moves to close the
hearing. Seconded by Squibb. The motion carries 4 -0.
New: 6 Quincy Park — construct coastal revetment and connect residence to City sewer —
Paul Earl & New: 11 Quincy Park — construct coastal revetment — Patricia Brandes
Maxner reads legal notices. Bob Griffin representing the applicants describes how similar coastal
revetment projects had been permitted in the area (5 Quincy Park and completed at 3 Wilson
Ave). A connection to City sewer is proposed for 6 Quincy Park with pump chamber. At 11
Quincy Park property stone steps are proposed to be incorporated into the revetment.
Griffin notes that for 6 Quincy Park, an Order for repairing the existing concrete seawall expired
in November 2014, and that work was not undertaken. The Order was never recorded and no
Certificate of Compliance was issued. Chapter 91 permitting will be required for both properties
since work will occur below MHW.
The Commission scheduled a site visit at 8:00 a.m. on Saturday, February 13, 2016.
Paluzzi moves to continue the hearing until March 1, 2016. Seconded by Donnelly. The motion

OLD /NEW BUSINESS
New: 16 Cole Street, DEP File #5 -1005 — Request for Minor Modification to Order of
Conditions —Anthony Lauring
Bob Griffin representing the applicant describes the revised plan to shift the location of the
driveway entrance to the north where there is a natural break in the stone wall and two catch
basins are proposed to capture driveway runoff as opposed to the grate per the special condition
in the Order issued in July of 2009. A sketch was provided showing which direction the water
will flow.

Donnelly moves to approve the Minor Modification. Seconded by Paluzzi. The motion carries 4-

The Commission took a recess at 8:35 p.m. and reconvened at 8:38 p.m.
New: Planning Board Request for Comments — 11 -15 Sunnycrest Avenue OSRD Site Plan
Application — PD Building, LLC
Bob Griffin describes the ANRAD process filed with the Commission last year for this property
and sub-division plan for 6 new houses and 50% of land will be preserved' as open space with a'
fenced -in detention basin for'stormwater management. The conservation land will be transferred'
by the developer to the City. The cul -de -sac is 150 feet;, long with reduced frontage on some of
the lots. No work will occur in the buffer zone. Stormwater calculation report was provided to
the City Engineer. The boundaries of the open space will be marked and walked with Planning'
Department staff to define limit of work edge. The Commission will send a letter to the Board'
encouraging them to require marking the limit of work' and edge of open space.',
New: Planning Board Request for Comments — 130 Sohier Road Site Plan Review
Application — Lockwood Investment, LLC
Bob Griffin speaks to the renovation of the 4 -acre site of the roller skating rink, the Roller
Palace. The level site is 80% impervious with roof and parking spaces. The property will be sold'
to Lockwood Investments for a proposed transitional care facility. There are no wetland'
resources in close proximity to the site and effort will be done to ensure there is no impact on
drainage (no increase in runoff volume) on nearby Cell Signaling property. The site will be
landscaped more than it is now with the existing, property. Impervious surface will be decreased'
by 15 -20 %. There are undersized drainage pipes' coming into and leaving the property causing
runoff to pond during existing rainstorms.' Subsurface infiltration basins will be installed to
capture ponding',surface water and reduce runoff The Commission' will send a comment letter to
the Planning Board encapsulating the Commission's points of discussion.
New: 46 L.P. Henderson Road, DEP File #5 -1144 — Request for Minor Modification to
Order of Conditions —Alan Battistelli
Alan Battistelli addresses the Commission and describes his request to improve turnaround'
driving area on left side of the hangar building so vehicles can avoid the 25' No Disturb Zone.'
There would be no change in the existing fence. Paluzzi moves to approve the minor
modification as discussed. Seconded by Donnelly. The motion carries 4 -0.',

The School's attorney has requested to continue discussion to March 1, 2016. Paluzzi moves to
continue. Seconded by Donnelly. The motion carries 4 -0.

New: Planning Board Request for Comments — 55 Cherry Hill Drive Site Plan Review &
Special Permit Applications — Krohne, Inc.
Maxner notes that this project is an addition to an existing building and installation of a circular'
drive through the site. The Commission will write a comment letter to the Planning Board
requesting the applicant verify offsite wetlands and limit of buffer and consult with the City',
engineer. The Commission expressed interest in receiving more information on this project.
New: Annual Election of Officers — Chair & Vice Chair
Donnelly moves for Chris Bertoni to continue as the Chair and Robert Buchsbaum to continue as
Vice Chair. Seconded by Paluzzi. The motion carries 4 -0.
New: Review of Minor Project Permits Issued by Agent
None were issued since last meeting.
New: Expenditure Approvals:
Paluzzi moves to pay $120 to Amy Maxner for mileage reimbursement. Seconded by Donnelly.
The motion carries 4 -0.
Donnelly moves to pay $6,000 to Amy Maxner for the Conservation Administrator's annual
stipend for 2015. Seconded by Paluzzi. The motion carries 4 -0.
Paluzzi moves to pay Jeffrey Roelofs $350 special counsel to the Commission for his continued
work in litigation relative to appeal of the 50 Dunham Road ANRAD. Seconded by Donnelly.
The motion carries 4 -0.
Paluzzi moves to pay $6.45 to Amy Maxner for cost associated with mailing the Recreational
Trails grant application for parking lot next to Phillips Preserve. Seconded by Squibb. The
motion carries 4 -0.
Approval of Minutes
Paluzzi moves to approve the March 31, 2015 minutes as amended. Seconded by Donnelly. The
motion carries 4 -0.
Paluzzi moves to approve the April 28, 2015 minutes as presented. Seconded by Donnelly. The
motion carries 4 -0.

Maxner read an email from Jacqueline Bokor, Beverly resident and parent of Waring School
student, who expressed interest in doing minimum cutting of bittersweet at Standley Street.
Paluzzi moves to approve cutting bittersweet at Standley Street compost facility with permission
from the City and JRM before any work occurs. Seconded by Donnelly. The motion carries 4 -0.
Adjournment
Donnelly moves to adjourn at 9:45 p.m. Seconded by Squibb. The motion carries 4 -0. The next
regular meeting of the Conservation Commission is Tuesday, March 1, 2016 at Beverly City
Hall, 3 d Floor Council Chambers, 191 Cabot Street.
