Decoulos stated that Article 3 is Administrative Organization. He also notes that he did not completely delete Article 4. Grimes states that removing the qualifications from the Ordinance is close to a policy decision and that the full Council should decide those matters, and that may be contentious. She also noted that it seems to be a major question that has he most effect on cleaning up the ordinance. Decoulos agreed that is may be something that the Council would want to consider but it would not effect cleaning up the Ordinance. Grimes states, that, she likes having the qualifications in the Ordinance. Hobin states that he does not think they are necessary, noting that it is not a decision that has to made right now. Hobin states that it should be up to the full council to approve what the Subcommittee presents. Grimes questions what the Subcommittee should present to the full Council. Decoulos suggests that the Subcommittee submit the revised Ordinance with a list of policy decisions that should be addressed by the City Council at the end of this process. Grimes questions why "Operating Officers" was deleted from Article 3. Decoulos explains that they are listed in other places, and you should not have things listed twice if you can possibly avoid it. Decoulos refers to table A in his letter dated June 30, 2008, and notes that the Administrative Code in the Charter gives the Mayor the authority to move departments around without changing the Ordinance. Discussion ensues regarding how the revised Ordinances will be organized. Decoulos states that it will be similar to Mass General Laws with a Chapter, Section, Paragraph and Subparagraph. Slate asks if there is a standard format. Decoulos explains that they could organize it into Chapters and Sections. Slate notes that he feels that a Table of Contents would be helpful. Decoulos states that he will go back and take a second look at the remaining ordinances if he can get approval of the merging of Articles 3 & 4. He states that he would spend 2 or 3 days reviewing and redlining the remainder of the document. He also notes that this work is part of his original contract and fee and there would be no additional charge for this. He states that he owes the Subcommittee hours. He again stated that his hourly rate would be charged for attendance and Subcommittee meetings and meetings with the City Council. Slate asks Decoulos how much time he anticipates needing to complete the review of the remainder of the Ordinances. Decoulos states that he would like to spend three days doing this, noting his schedule and suggests that he could have it for the Subcommittee City Council Ordinance Review Subcommittee Draft Minutes — February 4, 2009 Page 3 of 4 for a meeting on March 4, 2009. He suggests that he would like to bring a draft of the entire Ordinance with edits to the full Council before he does the formatting. Slate suggests that the Subcommittee give Decoulos some direction on whether they are comfortable with the merging of Article 3 & 4. Slate notes that he is comfortable with the discussion that the Subcommittee has held regarding these sections. Hobin agreed and suggested that he would like to see comments in the margins on the redline drafts for the remaining Ordinances. Decoulos states that it is a tedious process but he would do that where he feels it is necessary. Grimes states that she feels that the Subcommittee needs to discuss how they are going to move forward with this, so that they have a clear idea of what was done with Article 3 and Article 4, before presenting it to the full City Council. She states that she is not comfortable and recommends that the Subcommittee talk about this and get back to Atty. Decoulos. Slate agrees and suggests that the Subcommittee spend some time now at the meeting, discussing this. There being no further comments or discussions at this time for Atty. Decoulos, he left the meeting at this time. Hobin moves for a five minute recess. Grimes seconds the motion. The motion carries. The Subcommittee reconvened at 7:35 p.m. Slate questions how best to proceed from here on the merging of Article 3 & 4. Grimes states, that she does not have a problem combining them, if, it is because of duplication. She notes that the Subcommittee has not seen a draft of what Article 4 looks like with all of the changes. She states that she would like a clear idea of what Article 4 looks like before making a decision on the merging of Article 3 & 4. Discussion ensues regarding this process. Grimes states that she feels that Subcommittee needs to take a look at this carefully, noting that they have only been looking at the recommendation of a lawyer who admittedly did not have any input in the resulting draft. Discussion ensues regarding the timeline for this process. Slate states that he would like to have this done by summer. Grimes states that it is ambitious and a painstaking process, noting that people are busy and perhaps the Subcommittee may only get part of this completed. Slate stated that he envisioned that this Subcommittee doing the bulk of the work and continue the process to the end. Grimes suggested that Atty. Decoulos complete the redlining of the remainder of the Ordinances, since he has been paid for it, and the Subcommittee should take a look at that and they may have a better idea as to how long a process this might be, The next meeting of the Ordinance Review Committee will be on Wednesday, February 11, 2009 at 6:30 p.m., in the staff conference room at the Beverly Public Library. There being no further business to come before the Subcommittee this evening, Hobin moved to adjourn the meeting. Grimes seconds the motion. The motion carries. The meeting was adjourned at 8:30 p.m.
