THE MEETING WAS CALLED TO ORDER AT 8:07 P.M. (WAITING FOR QUORUM). BILL LISS MOTIONED TO PROCEED WITH THE PUBLIC HEARING SESSION AND GLENN TERRY SECONDED THE MOTION. ALL IN FAVOR. NOTICE OF INTENT FILED BY HARRY FAUST HOUSE CONSTRUCTION ON BOYDEN STREET LOTS A & B #5-445. REPRESENTING, JOHN E. COREY, ENGINEER OF COREY AND DONAHUE, INC. HOUSE CONSTRUCTION OF TWO SINGLE FAMILY DWELLINGS. THE PROPOSED HOUSES ARE 1-1/2" ABOVE THE FLOOD ELEVATIONS. A SILT FENCE WILL BE USED AS SHOWN ON THE PROPOSED PLAN. DISCUSSION HUGH HILL LANE LOT 2 SHELDON FRISCH. ABUTTER - JOE SAVY - STATED THERE IS A NO CUT ZONE AND SHOULD BE 50' FROM THE EDGE OF POND EXCEPT FOR BUILDING A HOUSE. THE DEP SET THE RULING AND NOW SHELDON FRISCH WANTS TO CUT THE TREES. REPRESENTING SHELDON FRISCH, ARCHITECT,THAD SIEMASKO, HE STATED THAT THE AREA THAT HAS BEEN CUT IS OF MINIMAL TO BUILD A HOUSE. MR. FRISCH HAS NO INTENTION OF TAKING ANY MORE TREES DOWN. THE FOUNDATION IS IN THE RIGHT PLACE. EVERYTHING IS BEING DONE IN THE RIGHT WAY. THE SUPERCEDING ORDER OF CONDITIONS OVERRIDES THE 50' CUTTING ZONE. ORIGINALLY IT WAS 50' FROM THE POND. JOE SAVY - STATED THAT FROM THE HOUSE ON DOWN, IT IS LESS THAN 40', 50' IN SOME INSTANCES. TOM FORD, ALSO PRESENT, WHO BOUGHT THE SUBDIVISION FROM MR. CARLMAN (BEFORE ALL THIS). AFTER MUCH DISCUSSION, ALL ARE IN AGREEMENT THAT NO FURTHER TREES WILL BE CUT. SHELDON FRISCH STATED THAT HE HAS DONE NOTHING INTENTIONAL OF CUTTING ANY TREES. REGARDING A NO CUT ZONE AS BEING RECORDED IN THE DEED, THAT IT SHOULD BE HONORED EVEN BY ANY OTHER FUTURE OWNERS OF THE PROPERTY. ALL SETTLED. DISCUSSION COLON STREET FLOODING CONCERNS NEIGHBORS. KEN ANASTASI OF 114 COLON STREET. MR. KOTUNSKI WHO LIVES BEHIND HIM. THE BACKSIDE OF THE HOSPITAL IS VERY HILLY. THE TEMPORARY TRENCH IS NOT DOING THE JOB OF CONTAINING THE WATER. THE AREA IS VERY LEDGY. BILL LISS - ASKED ABOUT THE UNDERGROUND PIPE AND WHEN IT WAS INSTALLED. MR. WOTUNSKI - STATED THE PIPE WAS INSTALLED 18 YEARS AGO, IT IS 4" IN DIAMETER. THE PIPE IS FLOWING THROUGH AND HE HAS BUILT A SMALL STORM DRAIN AND IS CONSIDERING TO RE-LANDSCAPE. BILL LISS - IS NOT SURE IF IT IS IN OUR JURISDICTION. CHAIRMAN COTREAU - STATED THAT THE STATE SENT THE NEIGHBORS HERE AND BILL LISS AGREES. BILL LISS - STATED THAT A PUBLIC HEARING IS NEEDED IF ANY WORK IS TO BE DONE.
