LICENSE BOARD MINUTES — MARCH 5, 2015
The meeting of the Beverly License Board was called to order on Thursday, March 5, 2015 in the
City Council Chambers at 6:30 pm.
In attendance at the meeting were: Board Members Richard Kelley, John Roccio, Joseph Trainor,
Police Liaison Sgt. William Page and Clerk, Martha Lewis.
1. Acceptance of the Minutes from Meeting of February 5, 2015
The minutes of the meeting held on February 5 were reviewed. No comments or changes
requested. Mr. Roccio made a motion to accept the minutes as submitted. Mr. Kelley
seconded the motion. Motion passed 3 -- 0.
2. Change of DBA, Change of License Type and Change of Location — Endicott College dba
Gully's, William Schimpf, Manager for sale of wine and malt beverages.
In attendance from Endicott were President Richard Wylie, Counsel Karen Abbott, Campus
Police Chief Charlie Femino, Manager William Schrimpf and Trustee Tom Alexander, Esq.
Chairman Kelley recapped the Board's concerns that were expressed at the February 5th
meeting: increased capacity from 50 people to up to 186 people; staffing levels, specifically
the number of floor supervisors; the elimination of food service; drinks to be less expensive; 2
outside guests allowed per student; open to all students vs. 21+ only.
Atty. Alexander spoke on Endicott's behalf, not as their attorney but as a Trustee of the board.
He explained that there had been issues on Rantoul Street involving Endicott students.
Endicott tools the initiative and moved the students back on campus. They are in the process
of building a 300 bed dorm which is set to open in August. The school decided to invest in
the Student Social Center to bring the students back on campus by providing a space to gather
and socialize; they believe this will allow them to keep an eye on students. He addressed the
staffing concerns stating that the Manager of Record, William Schrimpf is also an Assistant
Dean of Students. In addition there will be 2 full time employees on the floor in addition to
TIPS certified waitstaff and bartenders. Campus security will check i.d.'s at the door. He

also noted the amount of investment -- $850K for Social Center, $25M dormitory and new ice
rink venue, all to keep students on campus.
Chairman Kelley noted the addition of food to the social center and he noted that it was
helpful to know that Mr. Shrimpf is also a dean of students in addition to the manager of
Gull's. He also noted that the person responsible for i.d. check at the door will be a full time
staff member from the campus security. If there is a crowd, Endicott has committed to adding
more campus security staff to oversee the floor.
Dr. Wylie explained that the college desired to close the small pub which had a capacity of 50
and move it to the middle of the campus, providing greater visibility. He stated that the
college took the concern about the food not being available and is committed to providing
food — pizza, hamburgers, etc. He also shared that other local schools offer social centers that
are open to students (all ages). He listed Stonehill (cap. of 200 pp), Fitchburg (cap of 200 pp),
Wheaton (cap. of 160), Babson. He believes that reducing alcohol in the residence halls is
important. Allowing under 21 students to mix at the social center is key so that they don't get
left behind in the dorms.
Dr. Wylie also explained that there will be a reservation system put in place. Students would
make a reservation to come to Gully's in advance. This will provide the College with an idea
as to how many to expect. There will be 1 adult person to each 50 students. He also
continued that if students violate rules, they are disciplined and held accountable. He pledged
that they will use TIPS certified servers and their student employees are in the hospitality
program and are well- trained. In addition to the student employees, there will be adult
supervisors.
Chairman Kelley noted that the campus police is located close to the Social Center. Mr.
Trainor asked for further clarification on the staffing ratio. He wanted to be sure he
understood the staffing. Dr. Wylie responded to Mr. Trainor's concerns assuring him that
there would be 1 adult supervisor for every 50 students, plus TIPS certified servers. Students
will be well supervised.
Chairman Kelley noted that the maximum occupancy number is 186, there might never be
that many students in the social center at one time. He also noted that there had been concern
about the supervision. The Board does not want something to happen. The difference in
occupancy from 50 to 186 and it is likely that most evenings will be quiet with a limited
crowd.
Sgt. Page stated that the Grove /Lodge was very quiet; the capacity was up to 50 people. He
noted the police visited that location only two or three times. Mr. Trainor asked if 23% of the
campus was 21 +, why not introduce the center in increments. Atty. Alexander replied that it
would defeat the strategy. If you do not allow the under 21 students in, you are pushing them
off campus or into dorm rooms to drink.
Mr. Roccio expressed his concern for the number of guests students are allowed to bring in
(two guest per Endicott student). Dr. Wylie responded that if students can't bring in friends
who are visiting, where will they go? He assured Mr. Roccio that all guests must be
registered by campus security. Endicott students accompany their guests at all time. They are
held responsible and accountable for the actions of their guests.

Chairman Kelley suggested Endicott reduce the number of guest to see how it goes. Atty.
Alexander asked for how long? One Year? Chairman Kelley suggested a semester or two on
a trial basis. Dr. Wylie countered that students are allowed to have 2 guests on campus, if
only one can get into the social club, what happens to the other student? Mr. Roccio asked if
the college disciplines the students. Dr. Wylie assured him that they are disciplined for any
damages and /or abuse of privileges. He stated that Endicott had the capacity to hold students
accountable for their actions. Dr. Wylie understands the responsibility he has to the City and
students. He is aware that alcohol abuse is running rampart not only at Endicott but other
places as well. He will pull the license if there are any problems.
Sgt. Page noted that the Beverly Police was not opposed to moving the license. However
based on the most recent incidents where 8 students were transported to the hospital, clearly
there is a problem on campus. He suggested that the college make the following
considerations: 1. At any event that will be serving alcohol, the police liaison should be
notified ahead of time; 2. Require 1 campus police and two crow control managers (at a
minimum), he believes the proposed number is not adequate given the size of the floor, it will
be difficult to monitor. He gave the example of Murphy's in Salem where the capacity is 288
and they employee 9 doorman and 6 bartenders at all times. He continued that the police
should be notified when there is an emergency on campus and he suggested they exclude the
students under 21 at the events that alcohol is being served. (Tuesday and Wednesday from
7:00 pm —11:00 pm no alcohol is served). Also he suggested reducing the occupancy to 75
people for the first year.
Dr. Wylie responded. He explained that there was a fundraising dance for the baseball team
on campus. One person from the dance was transported to the hospital, the other 7 calls for
transport to the hospital was from the residence halls. The purpose of building the Social
Center is to provide the students with someplace to go. By excluding student under 21, it
would be diminishing what they are trying to accomplish.
Chairman Kelley noted Endicott's planned changed to the security force to become a police
department on campus. Mr. Charlie Femino, Endicott's Director of Security confirmed they
will have police power and are trained at the academy. Mr. Trainor asked if there will be a
campus police officer on duty at all times. Mr. Femino responded that they will be there
when called for i.e. if there is a special event. Mr, Trainor replied that he thought the plan
sounded loose especially when compared to the staffing at The Pickled Onion, he believes
the Endicott staffing is lite.
Atty. Alexander stated that this is a campus social club not a bar. They will only serve
alcohol three days per week. He detailed the staffing — 3 servers plus 2 bartenders plus 2 full
time employees plus an additional person per every 50 students on the floor. He said it's not a
"loose" plan. He continued that Endicott has three licenses and have had no incidents with
those licenses. On a number of nights, it will be quiet maybe 30 — 50 people. Other nights
when there are special events, there will be a bigger crowd and he assured the Board that they
will have additional staff on duty.
Chairman Kelley replied the he is reassured as Mr. Schrimpf is also the Dean of Students. He
continued that the center may never get to full capacity, but the Board's concerns are valid.
Mr. Roccio added that he has no doubt that communication will be improved. Chairman
Kelley added if the board's worse fear occurs, the Board can take action on the license.

Dr. Wylie believes the center will make a difference on campus. They know their students,
they can control the students and hold them accountable. He assured the board that they will
do whatever they can, they will not risk their reputation.
There was discussion among the board about placing staff requirements as condition to the
issuance of the license.
Chairman Kelley made a motion to approve the application for change of dba, change of
location and change in type of license with the staffing as follows: security at door checking
i.d.'s, a floor supervisor (increased to 1 additional staff per 40 additional students over 50
people), 2 — 3 servers. Mr. Trainor seconded the motion. Motion passed 3 — 0.
3. Change of Manager, Transfer of Stock, New Stockholder and Change in LLC — Pikey, Inc.
dba The Pickled Onion, Peter Kelly, Manager
Mr. Kelly submitted amended forms. The percentages in ownership were corrected to reflect
the same ownership as filed annually and documentation submitted. Mr. Trainor made a
motion to approve the application. Mr. Roccio seconded. Motion passed 3 — 0.
4. One Day License Applications. A total of 5 one day licenses were approved. All applications
were reviewed for hours and in order. Mr. Trainor made a motion to approve the five
applications submitted for a one -day license. Mr. Roccio seconded the motion. Motion
passed 3 — 0.
5. All Other Business
ABCC notice regarding the inclusion of continuing care retirement communities as an on-
premise license type was received and placed on file.
Next meeting is scheduled for Thursday, April 9, 2015 at 6:30 pm in City Council Chambers, Third
Floor, City Hall, 191 Cabot Street.
Hearing no further business, Mr. Roccio made a motion to adjourn the meeting. Chairman Kelley
seconded the motion. Meeting adjourned at 7:50 pm.
