1991-01-03CONSERVATION COMMISSION BEVERLY, MASSACHUSETTS MINUTES JANUARY 3, 1991. MEMBERS PRESENT: Chairman Peter Gilmore, Vice Chairman George Batchelder, Nancy Lodge, Joe Manzi, Glenn Terry and Vincent Cotreau. Meeting called to order at 7:45 P.M. Chairman Gilmore began with Lot 10, 'Beaver Pond. Carl Balsley from Hayes Engineering. Vinnie Cotreau motioned "non-significant" for the proposed change. Glenn Terry seconded it. All in favor. Thos. Connors of 9 Landers Drive, spoke of the piping and of water concerns. Wants to be reassured of not being flooded. Chairman Gilmore assured him that the DPW Commissioner stated that there wcu[d be no problem. ORDER OF CONDITIONS 6-month extension. Metca!f and Eddy #5-232, BEVERLY SEWER TUNNEL. George Batchelder motioned in favor of granting the extension and Nancy Lodge seconded it. All in favor. CITY OF BEVERLY #5-281, BRIDGE STREET AT BASS RIVER. One year permit extension. Vinnie Cotreau motioned to grant it and Glenn Terry seconded it. All in favor. PUBLIC HEARINGS AS FOLLOWS: Vinnie Cotreau motioned to recess for the public hearing session and Joe Manzi seconded it. All in favor. #5-366 BRIDAL PATH LANE Continued. Dan Finn, Trustee. Rick Waite, Meridian Engineering. Dr. Doberstein, Botanist from Lolito Engineering. George Batchelder inquired about the flooding potential. Peter Gilmore concerned seme hydraulic connection with stream, subject to flooding at certain times. The stream has the capacity to hold 5 cubic feet per second as stated by the engineer. The chairman would like it in writing or on the plan. A verification of no flooding. George Batchelder stated a 100 ft. contour towards the house. Basement level - 102' -2- Engr. stated they are staying a minimum of 10-ft. from the wetlands. Nancy Lodge feels it is very close. Dan Finn-At 102, the stream is going downhill has never seen it crest over the bank, drops away very fast. George Batchelder questioned the bridge footing? The bridge is 25 feet long. No footings will be used, only 2 sonic tubes at the edge of the wetlands. There will be clearing on the west side of the stream. Joe Manzi motioned to close the hearing, Vinnie Cotreau seconded it. All in favor. #5-367 THE BEVERLY Continued. Lot 55, Tozer Road. Present-Attorney John Rose. Engineer, Kevin Deloye from Vanesse Hangen Brustlin Engr. The hay bales have been extended, brought up the slope on the southside of the property. MWRA (gas traps) has been added to the plans. Snow fence was added to hay bales line for stability. A continuing maintenance program including annual visual repairs, catch basins, hoods and all types of maintenance work. Also submitted re: internal parking. Detention tank proposed, more details, capacity (6,000 gallons), precast tank, 2-i0" outlets, define elevations to mitigate i0 and 100 yr. storms. Also, a weir cn top cf structure to mitigate a 100 year storm. Sorbet, attached by hooks, to inside of tank, to mitigate against oils, etc. Letter from Mansco detailing construction re: the wetlands. V!nnie referred to the south of the wetlands, the pond and the hydraulics, the way the water will come out. Deloye sta~ed that everything from the hill flows straight down to the wetlands. A lot of the land is open. Steve Connolly, Owner of the property, concurs with Engr. Deloye. George Batchelder concerned with the discharge. He feels the water flows onto the neighbor's preperty. Deloye: The only contour change is to install the level spreader. Nancy Lodge questioned the water flow, etc. Overland flow will go into the tank. Joe Manzi re: the dissipator, a 12" rise, holding capacity? Deioye: The level spreader will lessen the impact, the purpose of the holding tank is to mitigate against the increase. George Batchelder questioned the sorbet? Deloye displayed it and how it absorbs oils and contaminants. Does not collect heavy metals. George Batchelder stated that the DPW Commissioner will review and submit his comments (next week). Deloye: The tanks are precast, additional sections may be added to the tanks. Vinnie Cotreau questioned loading and weight capacity. Deloye: HS 20 LOADING. Gilmore: It is a Building Inspector's question. -3- DPW Commissioner: re: dissipators, they should be installed at the downstream end of the slope. Will channelize the flow. George Batche!der questioned the water supply after development? Will there be enough of it? DPW Commissioner suggested to put in a rip rap line channel down into the wetlands. Deloye: A 12" rock line channel to prevent erosion. George Zambouras stated that without the line channel, erosion is a possibility. Chairman Gilmore suggested that the applicant prepare an alternate plan showing the change in the discharge points. Will then have both plans to view. George Batchelder questioned the basement excavation and the equipment to be used on the slope? Contractor Chas. Chevro from MANSCO explained, on the plan, the procedure. Peter Gilmore questioned blasting? Chevro stated that no blasting will occur. The fence is reinforced to catch anything from going into the wetlands. Tank design change to be submitted. Hearing continued on January 17th. (2-weeks). #5-368 KELLEHER CONSTRUCTION REAR 13 BRIMBAL AVENUE. Representing, Attorney Nancy O'Connell, also, from Hayes Engineering, Carl Balsleyo House Construction and a driveway within 100 feet to an inland bank resource area type. Utilities will connect out to Brimbal Avenue. The house-70' to the top of the bank, to maintain many of the large trees that are already on the lot. The area will be stabilized with hay bales. Vinnie Cotreau questioned Shat the hay bales are not all the way down? Engr. explained the trees 6'6", etc., no need to extend the hay bales. George Batchelder questioned the paved area? Engr. stated, yes, all paved driveway (11' wide). The runoff is in an easterly direction and is easterly from high point of the driveway. Vinnie Cotreau questioned the elevations? Engr: Cellar floor elevation-65' Pond elevation-61.9/62. Top of the bank-66' The 100-yr. flood will be contained within the banking of the pond. GENERAL PUBLIC Don Walter-15 Brimbal Ave. Re: Water concerns. the island under water, very recently. All pu~lps. Showed photos of the abutters have -4- George Batchelder-Could some of this be street runoff-concerned with impervious area being added to the site. Don Walter stated that Kelleher has already altered the land with fill. A very fragile area. Francis Cleary-17 Brimbal Avenue-same flood and water concerns. Chairman Gilmore-The applicant may take on some activities, provided no impact is in a resource area. We cannot deny someone to do something in a 100-ft. buffer zone. He continued to explain that a high water table is something that we have no control over. Eric Overberg-170 Colon St., Concerns re: any changes resulting in flooding. Also commented that Mr. Kelleher has done a good job on the outlet, but that it still.floods. Peter Gilmore would like, in writing, a botanist's report. George Batchelder would like to see a calculation of volume of flood storage from the paved driveway and at house site, the water table location, to outline the contour lines on the southside depression. Also, written material on the wetlands evaluations, etc. At this time, Vincent Cotreau suggested a SITE VISIT. George Batchelder wants all the information prior to the site visit. Chairman Gilmore to Don Walter-You have the right to hire a botanist, we cannot tell the applicant to pay for it; and we will decide what to do regarding the project. Mr. Kelleher explained how he would change the driveway, etc., anything that the Commission would choose. Also, stated that it is all ledge, could even build a slab house, if so, so as to avoid excavation. Eric Overberg still continued to state his flooding concerns. Alderman Sandra Reinecke (Ward 4) being present, wanted a history of the pond. Nancy Bollis ll Brimbal Avenue-Re: water concerns, stated that the Hannah School has problems also. Chairman Gilmore stated at this point that there is no water extending the site, and that the water flows over the bank. -5- Vinnie Cotreau has no problem. Kelleher wants to cooperate, so long as he mitigates the water. SITE VISIT scheduled for Saturday Morning, January 12th at 10:30. Hearing is being continued for two weeks-January 17th. COVE CROSSING DISCUSSION-Alan Berry, Applicant present. Also present, Atty. Ed Patten representing. Glenn Terry excused himself due to a conflict of interest. His daughter is employed with the applicant. Re: Plan B-by H.W. Moore Associates. That the Commi-~ion concur with DEP that Plan B and Plan C (requiring more replication) be accepted and for the 2 (DEP and the Commission) come to a conclusion. Attorneys from DEP want more replication. Vinnie Cotreau motioned to concur with DEP and Joe Manzi seconded the motion. Revision of present Plan B to be clarified and submitted to the Commission as soon as possible. Chairman is authorized to execute settlement documents as devised by DEP. All in favor. Discussion re: refuse at the rear of the high school. Chairman to send a letter to Superintendent Gene Perron. To table Lot 76A-Kennel Mill Drive until January 17. / The re-naming of the Phillips Nature Preserve in North Beverly. 1880-1882-John Phillips, Sr. After some discussion a motion was made. Vinnie Cotreau motioned to leave it as it is, Glenn Terry seconded it. A letter to follow to Anne Phillips Bryant who originally made the inquiry. All in favor. Nancy Lodge in opposition. Robin Levesque to check with Leo Panunzio of the Health Department regarding 20 Fosters Point/Septic System. Vinnie Cotreau motioned to send an Enforcement Order and Joe Manzi seconded it.
