MEETING WAS CALLED TO ORDER AT 7:45 P.M.. THE PUBLIC HEARING SESSION MOTIONED BY VINNIE COTREAU AND SECONDED BY GLENN TERRY. ALL IN FAVOR. FIRST CONTINUED PUBLIC HEARING DEP FILE #5-422. EDWARD KRUKONIS LOT 210B COMMON LANE. REPRESENTING FROM HANCOCK SURVEY ENGINEERING CO. OF DANVERS MR. BILL MANUEL, ENGR. HE SPOKE OF A STEEL GARAGE AND SHEDS BEHIND THE STRUCTURES, OTHER DEBRIS THAT WAS REMOVED. FILL, FIREWOOD AND STONES TO BE REMOVED ALSO. THE LARGER STONES WILL BE USED FOR THE DRIVEWAY CONSTRUCTION. THE EXTRA FILL WILL ALSO BE USED FOR HOUSE CONSTRUCTION. VINNIE COTREAU WENT TO THE SITE VISIT, THE AREA IS PARTIALLY CLEANED UP AND THE APPLICANT AGREED NEVER TO STORE ANYTHING BEYOND 20-30' BEYOND THE SHEDS (ALL HARKED ON THE PLAN). THE WETLAND WAS ACCURATE AND ALL THE PROBLEMS HAVE BEEN ADDRESSED. (APPROX.700 SQ.FT.). PETER GILMORE - RE: THE DRIVEWAY ON LOT 210, HOW WILL IT BE USED TO AVOID THE WETLANDS. VINNIE COTREAU-STATED THE HAZARDOUSHATERIALSAND ALL THE MACHINERY HAVE BEEN CLEANED UP. LOAM PILE STILL EXISTS THERE. PETER GILMORE - THE APPLICANT IS TO AMEND THE NOTICE OF INTENT AND TO INCLUDE ALL WORK TO BE DONE ON THE OTHER LOT. THIS HEARING IS CONTINUED-OCTOBER 15. THE DRAINAGE HAS BEEN CHANGED AND IS NOW DISCHARGING IN A SOUTHERLY DIRECTION. THE DISCHARGE PIPE IS ALONG THE SWALE. THE CONCRETE RETAINING WALL IS CHANGED ON THE SOUTHERLY SIDE. THE ELEVATION FLOOD IS 49.19./ DUCTILE IRON PIPE WILL BE GOING INTO THE PUMP STATION. THE EXISTING WATERLINE IS FROM TEMI ROAD AND BACK TO OLD TOWN ROAD AND CONNECTING TO HATHAWAY AVENUE, THEREFORE, ELIMINATING PIPE NEAR THE WETLANDS. RE: THE ROADWAY CONSTRUCTION AND THE WETLAND MITIGATION TO WORK, THE LOW FLOW PERIOD, DOUBLE STAKED HAY BALES, EXCAVATION IS TO TAKE PLACE FIRST. TWO TO THREE FEET OF MATERIAL IS TO BE PLACED IN NEWLY EXCAVATED AREA AND REGROWTH COULD START THIS FALL. VINNIE COTREAU - GRASS SWALE, RIPRAP BY THE DRAIN, NOT ON THE PLAN. PETER OGREN - THE CONSTRUCTION EQUIPMENT AND MATERIALS ARE NOT STORED AT NIGHT ON THE SITE. NANCY LODGE - IF THIS IS IN LAND COURT, HOW WILL BUILDING OCCUR? PETER OGREN - WE ARE BUILDING ON BEVERLY'S SIDE OF THE LINE. CLAYTON SMALL - QUESTIONED MULTIPLE CULVERTS. PETER OGREN - RE: THE LITTLE BROOK 4-5' WIDE BEING LOWER THAN THE BORDERING VEGETATED WETLANDS? PETER OGREN - WE WILL PUT A 72" PIPE THERE OF THE BEST DESIGN. CLAYTON SMALL - QUESTIONED A BRIDGE/WILDLIFE-15' HIGH RETAINING WALL/STUDIES OF LIFE IN THAT AREA. PETER OGREN - A BRIDGE WITH AN 80' SPAN - VICINITY OF $3-400,000, ECONOMICALLY UNREASONABLE. CHAIRMAN GILMORE - WHEN WAS THE BROOK DISCOVERED? ALSO, HOW MANY LINEAR FEET OF BANK ARE YOU TAKING? PETER OGREN - 94 LINEAR FEET. CHAIRMAN GILMORE - IF IT IS OVER THE THRESHOLD, A HABITAT STUDY MUST BE DONE. IT IS ELIMINATED ON THE NOTICE OF INTENT/DEFINED OVER THE THRESHOLD. ALSO, WHAT IS THE ACTUAL CUT OF THE ROADWAY? PETER OGREN - BASICALLY 40', 32' OF THE ROADWAY, WILL ASK THE PLANNING BOARD TO SHRINK THE ROADWAY DOWN. (CONTINUED) -3- GENERAL PUBLIC RENEE MARY - IS IT LEGAL TO CUT THROUGH A WETLAND? ALSO HOW WILL WE BE ASSURED THAT THE WATER SUPPLY WILL NOT BE AFFECTED? PETER OGREN - THE GROUNDWATER WILL SEEK ITS OWN LEVEL, THE RETAINING WALLS ARE BELOW GRADE AND WILL PLACE PIPES AS NOT TO IMPEDE THE SURFACE FLOW AND ALSO FOR THE GROUNDWATER. NANCY LODGE - HERE CONCERNS ARE WITH WILDLIFE. JOE MANZI - WE HAVE ENOUGH INFORMATION AND DOESN'T SEE ANYTHING ELSE. AT THIS TIME, HILDE FEUERBACH AND CHAIRMAN GILMORE DISCUSSED THE LIMITED PROJECT/WAIVER OF THE WILDLIFE STUDY. GENERAL PUBLIC RENEEMARY - CLAYTON SMALL WOULD BE DENIED THE WILDLIFE STUDY.
