Neuman called the meeting to order at 7:00 p.m.
Approval of Minutes
The minutes of the Harbor Management Authority meeting held on August 18, 2010 were
presented for approval. Troubetaris moved approval as amended. Gooding seconds the motion.
The motion carries (11 -0).
Public Input
Neuman suggests that the HMA open the meeting up for public input at this time.
Chris D'Alfonso addresses the HMA and reported that the boaters that he has spoken with at the
marina are very happy with the improvements. He noted that the consensus is that it is the best
marina in the area. He also noted that the construction on the land side has been a non issue for
them.
D'Alfonso also reported that boaters have been talking about having a social at the marina to
celebrate the new facility and invite members of the HMA. He explains that they have
discussed it with Rob Dever and member Bob Cook has offered to plan it. Discussion ensues
and it was decided that a social should be planned for early next season and the work would be
completed.
Report from Facilities Committee
Ward reports that the Harbormaster has moved into the McDonald's building. D'Alfonso
reported that the use of the bathrooms in the McDonald's building is working well. Neuman
notes that the Brown Building should be completed this fall.

D' Alfonso asks the HMA if cable TV would be available at the marina next year. He noted that
it was available to boaters before the construction and noted that the cable company said that
they would need a lot of boaters interested in cable to put a tap at the marina. Ward states that
he will bring the matter up at the next construction meeting. Neuman agreed and notes that it is
part of the services that the HMA would like to provide and they should look into it.
Ward reported that there are still problems with getting the transformer on the site moved by
National Grid.
Ward reported that a sample from the Ferry Way dredging has been sent to a lab and the results
are due back September 15 tH .
Ward reported that that if the piles are installed before the slips the slips will be limited and they
strongly advise against installing them in that manner. He explained that an inspection needs to
be done under the dock to plan how they should be installed.
Ward also reported that a lot of finish work is taking place at Glover Wharf and the seawall is
complete.
Rates for Recreational Marina
Ward reports that the rates for the recreational marina were discussed at length. He noted that
the rates have not been raised for three years. He also noted that a survey of area marinas shows
that Beverly is way under the others. He also noted that HMA discounted the contract this year
because of the construction.
Discussion ensues regarding the size of boats and size of the slips.
Gooding moved to accept the Facilities Committee recommendation for $150.00 minimum size
equal to finger length. Slate seconds the motion. The motion carries (11 -0).
The HMA discussed the time frame for payment plans for boaters at the marina. It was
suggested that a 25% deposit should be collected when agreement is entered into and the balance
can be paid over time, but should be paid in full by May 1 St.
Menezes moves to approve the payment agreement of 25% down and the balance to be paid by
May 1 St . Slate seconds the motion. The motion carried (11 -0).
Oosthoek asks when the current boaters have to acknowledge that they want to hold the slips
again. Neuman stated that he wants to review the lease agreement and then letters will be sent
out to the existing slip holders and the people on the waiting list. He also suggests that the HMA
should think about advertising. Menezes notes that the Willows and the Jubilee Yacht clubs
request notification by November 1 St.

Ward moves to notify slip holders that they should commit for the next season by December 1St
and after that they will be made available to another party. Troubetaris seconds the motion. The
motion carried (11 -0).
Ward reports that reading the electric meters is a real head ache. Raymond notes that there are
only four meters on the site. Neuman suggests that the HMA look into the use of electricity by
boaters and sort that out, noting that we need to know how that is working. Miedzionowski
notes that the financials show that we are collecting $2,000 from boaters, but the budget has
$10,000 in there. He suggests that more information is needed on this. Neuman agrees and
suggests that the matter be tabled for now. Dever will get more information and report back to
the HMA.
Recreational Marina Winter Rates
Ward reports that McPhereson is against having boating at the marina during this winter. He
explained that he thinks it will be dangerous with the construction on the commercial floats.
Neuman asks how many boats are usually there in the winter. D' Alfonso states that there are
usually two boats there in the winter but they were not there this summer.
Oosthoek states that since the Harbormaster and the Marina Manager are concerned about safety
hazards he recommends that the HMA accept their recommendation that there be no winter
rentals this year. Neuman agrees. The HMA did not set winter rates for 2010 -11 upon the
recommendation of the Harbormaster.
Ward reports that McPhereson reports that he has no problems with delinquent payments at the
marinas. Miedzionowski explains that McPherson updated him on the status of the rents as of
the August and September and they are up to date. Ward will check with McPherson on the
status before the next meeting. Neuman suggests that he would like McPherson to send updates
on payments to the HMA monthly.
Neuman reviews a list of items to be addressed with McPherson as follows:
Cable /Internet availability
Credit Card payments for slip rentals
Advertising for slips
Letters to existing slip holders and waiting list.
Financial Report
Neuman reports that he has had some discussion with Mayor Scanlon regarding the cost of the
dredging and it is difficult to know what funds might be available without know the enterprise
fund balance. He notes that the budget is tight
Neuman reports that there have been change orders on the project and the cost for Vine for the
permitting process has to be paid. He also notes that there should be enough money to finish the
project, but after that the HMA will be broke.

Miedzionowski reviews the finance report with the HMA. He notes that the reports show very
little income for the marinas. Neuman suggests that Miedzionowski should check with John
Dunn on that.
Miedzionowski states that he will send Ward an itemized list of expenses. Ward explains that he
has been signing some invoices but has not kept a tabulation of them. Gooding suggests that
Ward keep copies of the invoices that are presented to him for approval.
Grants Committee
Simon reports that he will be attending a grant writing workshop on Saturday in Turner Falls.
Licensing and Permits
Neuman reports on the status of the permitting for Port Marine. He explains the license renewal
process and notes that it is not legal for the city to renew and expired license, which the BPM
license is. He explains that the access to the street from the BPM goes with the license and
there is a concern about access should the license be denied.
Neuman reports that there is a hearing on the Black Cow on September 29 and 30 concerning
why the license should be issued to the HMA. He notes that the hearing officer will have to
respond in 30 days
Sandy Point
Slate reports that another clean up was held at Sandy Point Beach. He explained that the for the
last two cleanups the city picked up the trash. He noted that this time when the neighbors went
out to thank the men for doing so, they informed them that Public Services does not want to be
collecting this and they should be hauling it to the Standley Street. He stated that he is hopeful
that the DPS will collect the stuff one more time, noting that this has been a tremendous effort by
the residents of the neighborhood.
Old/New Business
Slate reminded the Commission that the City Council Subcommittee on Ordinances has been
reviewing ordinances and suggests that the HMA review theirs to be sure that the section in the
ordinances accurately reflect what the HMA make up and responsibilities are. He noted that if it
does not accurately reflect and it requires some enabling legislation that might be something that
the new State Representative should look at.

The next meeting of the Harbor Management Authority will be held on Wednesday, October 20,
2010.
