2010-08-18CITY OF BEVERLY PUBLIC MEETING MINUTES Board: Harbor Management Authority Date: August 18, 2010 Location: Beverly Public Library — Fogg Room Members Present Paul Miedzionowski, Rinus Oosthoek, Charles Raymond, Greg Ward, Don Neuman, Maureen Troubetaris Sylvan Menezes, George Simon, David Suminsby Members Absent: Miranda Gooding, Wes Slate Others Present: Sean Hanlon Recorder: Eileen Sacco Neuman called the meeting to order at 7:00 p.m. Approval of Minutes The minutes of the Harbor Management Authority meeting held on July 21, 2010 were presented for approval. Ward moved approval. Siminsby seconds the motion. The motion carries. Report from Facilities Committee Sean Hanlon was present at the meeting and addressed the HMA relative to the possibility of installing a boat ramp or public pier at the end of Congress Street, at the bottom of Goat Hill. Discussion was held regarding the possibility and inaccessibility of the site for dredging. Ward reported that the 22 construction meeting was held for the Glover Wharf project and the work is progressing. He noted that there are still problems removing transformers but National Grid should be removing them next month. Ward reported that most of the pilings have been installed and the cement deck will be laid next week. Neuman reported that the $40,000 estimate from Vine has been discussed and explains the differences in the bids for the design work on the commercial floats. He notes that a design study needs to be done and he hopes to have more information on this for the next meeting. Neuman reported that discussion have been ongoing concerning the fence for the Glover Wharf site. He explains that a pressure treated picket fence is planned by Mass Highway and it has been suggested that the HMA go with that as well, noting that it is nothing fancy and is durable Harbor Management Authority August 18, 2010 Page 1 of 4 and rugged and low cost. Discussion ensues regarding the location of the fence and Neuman notes that wherever the fence is located now will be the location of the new fence. Simon questions if there is any news on dredging. Neuman reports that the cost of permitting will be a cost to the city. He explains that Vine is in discussions with the city regarding the cost of the design and permitting of the Commercial project. Ward reports that the Brown building is empty and its contents have been moved to the McDonald's building. He explains that the move to the McDonalds building will be in the next couple of weeks. Ward reports that there are six slips open in the Recreational Marina. He noted that he does not see any problems with renting them all next year, Ward reports that the reconfiguration of the Commercial Wharf will result in an additional one or two slips. Dever reported that a another cleanup of Sandy Point is scheduled for August 22, 2010. Dever requested guidance from the HMA on how to handle the unpaid fees for the Commercial Wharf. Neuman stated that it is a legal matter and should be referred to Roy Gelineau. Winter Rates for Recreational Marina Ward reported that the Facilities Committee recommends that the HMA charge the same rates for the winter at the Recreational Marina as they did last year. Discussion ensues regarding whether or not "Live Aboard" should be allowed due to the lack of facilities. Neuman noted that the Brown Building should be up and running so "Live Aboards" should not be a problem. Ward moved that the winter rate for the Recreational Marina for be $ , October 1, 2010 through March ? ?, 2011, Suminsby seconds the motion. The motion carries. Dever leaves the meeting at this time (7:30 p.m.). Neuman requests that the Facilities Committee take a look at the usage of electricity and the amounts that are billed back to the HMA. Financial Report Miedzionowski reports that he is still waiting for information on the full HMA budget for FYI I from Finance Director John Dunn. He notes that he and Oosthoek met with Dunn to review the year end budget for the HMA for FYI 0. Miedzionowski will email information to members when he receives it. Harbor Management Authority August 18, 2010 Page 2 of 4 Neuman states that he would like to get a best estimate from Mayor Scanlon on where the HMA stands in terms of the budget for the projects to get an idea of what is needed to finish the proj ects. Miedzionowski reviews the income for the Recreational and Commercial marinas. He noted that the money received for slips in July was $112,000. He also noted that the operating expenses in FYI were $128,000 which is more than the income. Discussion ensues regarding the budget for the Facilities Operations Manager (Dever). Neuman states that the number looks like the old number for the previous manager. Oosthoek explains that the FYI number is for Dever. Neuman states that he would like to know what the actual cost is. He explains that it looks as if there is a short fall for this year in recreational slip income. Miedzionowski will check on that. Oosthoek reports that the Waterways and Enterprise budgets should always have $100,000 in there. Miedzionowski advised the members to keep in mind that there is a line item of $100,000 for dock maintenance. Ward suggests that it might be a good idea for the HMA to ask the city to stop the $40,000 that comes out of the HMA budget. Grants Committee Menezes reports that he and Simon met with Kate Newhall in the Planning Department and she is going to keep the HMA in mind for grant opportunities. Menezes reported that there is a grant RFP for trail development for a grant up to $50,000 with an 80/20 split for a contribution. He explains that it could be an opportunity to get a bridge designed at grade level for access at Bridge Street. Discussion ensues regarding the status of that. Troubetaris will try to get more information from Roy Gelineau on an eminent domain land taking. Neuman suggests that the HMA meet with Gelineau to see if there are legal issues that would prevent this from moving along. He also suggests that if it is an issue of cost that perhaps the HMA could help. Licensing and Permits Neuman reports that he needs six signatures on a document from Tina Cassidy specifying that the Black Cow will conform to the amendment to specifically allow the Black Cow to be built and that that is the current plan. He will circulate the document to members this week for signatures. Troubetaris asks if they need a Chapter 91 License or if they are grandfathered. Neuman explains that it was granted before 1984 so they could apply for amnesty. Harbor Management Authority August 18, 2010 Page 3 of 4 Bass River Dredin Suminsby states that the ENF has been submitted for the Bass River dredging. He states that he will ask for a PDF of the entire package and share with members. He notes that Bass Haven is footing the bill for the permitting for the dredging of the Bass River from top to bottom. Hanlon questions how far out they will be dredging. Neuman explains that they are permitting from the mouth to Stop and Shop. He notes that there is an agreement that the material can be dumped at sea and explains the plan. He also notes that funding for this has yet to be determined. Hanlon asks if the dredging will go toward utilizing Congress Street. Neuman explains that years ago the HMA had an interest in doing something down there at the Ventron site but now it is privately owned. He explains that it is a mud flat at low tide and four feet deep at high tide. Menezes notes that the area to be dredged does not include the end of Congress Street. Old/New Business Neuman suggests that he will check with the administration to see how the administration of HMA affairs is going. Oosthoek stated that the agendas and minutes of the HMA meetings will be up on the website. Ward states that he has been reviewing the bills as requested and he hopes to start doing that on a monthly basis. Oosthoek requested that the HMA get monthly reports on the slip payments for the Commercial and Recreational Marinas. Troubetaris asks if the situation with the Dinghy that was removed from Sandy Point was resolved. Ward reported that a dinghy was removed from Sandy Point and taken to the airport for storage. He explained that there was a misunderstanding as the owner did not want to pay the storage fee because he thought it was included in the mooring fee. He noted that once it was cleared up the man agreed to pay the fee and the dinghy was returned to him. Next Meeting The next meeting of the Harbor Management Authority will be held on Wednesday, September 15, 2010. Adjournment There being no further business to come before the Harbor Management Authority this evening, Troubetaris moved to adjourn the meeting. Simon seconds the motion.
