2014-01-22Beverly Planning Board Minutes January 22, 2014 CITY OF BEVERLY PUBLIC MEETING MINUTES Board: Planning Board Meeting Date: Tuesday, January 22, 2014 Location: Beverly City Hall Members Present Chairman Richard Dinkin, John Thomson, Ellen Flannery, Ellen Hutchinson, John Mullady, James Matz, Ned Barrett, David Mack Members Absent: Wayne Miller Others Present: Assistant City Planner Leah Zambernardi Recorder: Eileen Sacco Dinkin calls the meeting to order at 7:00 p.m. Dinkin suggests that the Planning Board take the agenda out of order this evening and move to Election of Officers for the year 2014. Election of Officers for 2014 Election of Chair of the Planning Board Dinkin calls on Thomson to assume the chair at this time. Thomson assumes the chair and asks that nominations be placed for the office of Chair of the Planning Board for 2014. Flannery nominates Richard Dinkin for the office of Chairman of the Beverly Planning Board for the year 2014. Mack seconds that motion. Mullady suggested that the Planning Board should wait for all of the new members of the Board to be present when holding the elections. Dinkin states that he did not think it was necessary to do so and explains the role of the chair. The Vice Chair serves as chair in the absence of the Chairman. Thomson asks if there are any further nominations for the office of Chairman. There are none. Thomson declares the nominations closed. Thomson calls for a vote on the motion to elect Richard Dinkin as Chair of the Planning Board for the year 2014. The motion carried (5 -2), with Dinkin abstaining. Pagel of 3 Beverly Planning Board Minutes January 22, 2014 Election of Vice Chair of the Planning Board Dinkin assumes the Chair and asks for nominations for Vice Chair of the Beverly Planning Board for 2014. Flannery nominates John Thomson for the office of Vice Chair of the Planning Board for 2014. Matz seconds the motion. The motion carries (8 -0) with Thomson abstaining. Special Permit #135 -13 — Cummings Center Northwest Parking Deck Driveway Exit — Six Month Review of Traffic and Circulation Issues, if any — Beverly Commerce Park LLC Steve Drohosky of the Cummings Center addresses the Board and reports that the exit was built in accordance with the approve plans and opened on July 8, 2013. He noted that it fits in nicely and has been successful with no complaints. He also reported that cars are not trying to use it as an entrance. Drohosky reported that there have been no complaints and noted that there have been no issues with traffic on Balch or McKay Street as a result of the exit. He shows the Board photos of the area. Mack asks if there has been any feedback from the neighbors who were opposed to the project. Drohosky reported that the Marshall's live right across the street and he has not heard from them other than snow removal issues which have been addressed. He noted that he has not talked to Mr. Burnham who was also in opposition to the project, nor has he conveyed any concerns. Thomson asks if the stop sign at the exit is being observed. Drohosky reported that it is being adhered to and noted that the speed bump is working as well. He also notes that he has not seen anyone cut through the deck to exit the Cummings Center. Drohosky reported that they met with the Parking and Traffic Commission and they are satisfied that the exit is working as intended and they have sent a letter to the Board as well. Barrett states that it was his understanding that before the changes were made, people were using this as an entrance to the garage. Drohosky explains the new exit further. Dinkin asks if there are any further questions from the Planning Board. There are none. Mack: moves to release this matter from the jurisdiction of the Planning Board as there are no further concerns regarding this matter. Mullady seconds the motion. The motion carries (8 -0). Old/New Business Zambernardi reported that the proposed zoning amendment to prohibit fast food restaurants in the overlay district died in committee at the end of the year and Councilor Martin has Page 2 of 3 Beverly Planning Board Minutes January 22, 2014 resubmitted it to the City Council. She explains that the matter will require a joint public hearing of the City Council and the Planning Board and the City Council has suggested Monday, March 3, 2014 as a date for the public hearing. Thomson: moves to recommend to the City Council that it set a date for the joint public hearing for Monday, March 3, 2014. Flannery seconds the motion. The motion carries (8 -0) Barrett requested a copy of the proposed zoning amendment. Zambernardi will email him a copy. Dinkin asked if the text of the amendment has changed from the last one. Zambernardi states that the language is the same. Approval of Minutes The minutes of the Planning Board meetings held on November 18, 2013 and November 19, 2013 were presented for approval. Mullady moves to approve the minutes of the November 18, 2013 and November 19, 2013 Planning Board meetings as presented. Hutchinson seconds the motion. The motion carries (7- 0), with Matz abstaining. Adjournment There being no further business to come before the Planning Board this evening a motion was made by Flannery to adjourn the meeting, seconded by Hutchinson.
