1694-06-15[Town Meeting June 15, 1694] At a general town meeting of the freeholders and freeholders of the town June the 15th, 1694. At a general town meeting of the freeholders & other inhabitants of the town of Beverly legally warned & qualified as the law directs, it was then voted and agreed to, by general vote of the inhabitants then convened, that whereas the selectmen of Wenham have arrested the selectmen of our town, for not perambulating with them [as they say] on l0 ' of April last past; it was voted as above said, that the town will and doth hereby agree, to assist the said Selectmen of our town of Beverly, by bearing what cost & charge shall arise to the said Selectmen, in defending and prosecuting of the case above said, from court to court, until the matter shall be issued. At the same town meeting June the 15th, 1694, Lieut. Andrew Elliott, Deacon John Hill, Capt. John Dodge and Lieut. William Dodge, was chosen a committee to act in the town's behalf with respect to any matter of difference that is or shall arise between our said town of Beverly and the town of Wenham with respect to the bounds and line between the said towns, as also any person or persons encroaching on our town's common, and the said committee is hereby empowered to sue, and defend, and to prosecute in the town's behalf for the maintenance & gaining of the town's right, in reference to the bounds, and lines, and encroachments above said, and to choose, appoint and agree with any attorney or attorneys to assist them in the matter above said. At the same town meeting June 15, 1694, it was also voted and agreed to that the selectmen of our town of Beverly, have hereby power and order from our said town to make a rate or rates to be paid in money, for the defraying all such cost and charge, as shall arise in the management of the difference between Wenham and our said town about the bounds and line between them and us, as well in the case already commenced by the selectmen of Wenham against our selectmen as any other.
