1693-06-23[Selectmen June 23, 1693] At a meeting of the Selectmen of Beverly on 23 June, 1693, at the house of Joanne Hibbert widow, and relic of Robert Hibbert late of Beverly, deceased, then this agreement made between said Selectmen, and the above said Joanne Hibbert with respect to a town highway laid out over said Hibbert's land, the said highway giveth from the country highway, by Hazediah Smith's barn eastward to our town's common, about seventy -six poles over said Joanne Hibbert's land in breadth two polls, the which land of seventy - six poles and length & two polls in breadth the said Joanne Hibbert with the consent of her sons, viz.: John, Joseph & Samuel Hibbert, doth alienate, sell, set over and forever confirm unto said Selectmen, to be for a town way as aforesaid, for and in consideration of three acres and a half of said town's common land, next adjoining to the said Hibbert's land, and the above said Joanne Hibbert for herself, her heirs and successors, engage to make maintenance and keep use a sufficient fence, between said Hibbert's land now in her possession, and the above said highway seventy -six poles in length as is above expressed, and the said fence to keep up and maintain from time to time forever, and the above said way to lay and be an open drift way after the last of October next ensuing, and till then only for carting and witness, whereof we have hereunto set our hands, the day and year above written. Joanne X Hibbert John X Hibbert Joseph X Hibbert Samuel Hibbert signed and delivered in the presence of us, John Dodge, Samuel Balch, the land laid out to Joanne Hibbert, widow, and relic of Robert Hibbert, late of Beverly, deceased, for the payment of the town's highway mentioned in the next above record, it is adjoining to the said Hibbert's land eastward from said Hibbert dwelling house, and doth lay as followeth, viz.: nine pole and six foot in breadth at the south end, and twelve pole and six foot in breadth at the north end, and on the western side next to said Hibbert's fence, sixty pole in length, and in the other side fifty and four pole in length.
