Scanlon, Jr. Mayor Refer to Public Services #205 November 5, 2012 The Honorable City Council City Hall, 191 Cabot Street Beverly, Massachusetts 01915 Re: Affordable Housing Units at Enterprise Apartments, 81 Rantoul Street Dear Honorable Council: Page 2 of 4 You may know that the Inclusionary Housing Ordinance required that six of the forty -five apartment units in this project be reserved as affordable housing units. To comply with the Inclusionary Housing requirements, the developer, Windover Enterprise, LLC has prepared a Regulatory Agreement (RA) for signature by the City, the Massachusetts Department of Housing and Community Development (DHCD) and themselves and subsequent filing at the Registry of Deeds. The RA lays out the terms of unit affordability and monitoring for the project. Execution of this document will also allow the affordable units to become eligible for listing in the Subsidized Housing Inventory maintained by DHCD. City Solicitor Roy Gelineau has reviewed the RA and made suggested edits, which have been sent to DHCD and Windover for their consideration. Mr. Gelineau otherwise agrees with the document in content and form. The document is also under review by DHCD and it is intended that Windover, DHCD and the City will sign the RA upon each party's final approval. Please find copies of the draft RA and Mr. Gelineau's comments attached for your use. I hereby request City Council authorization to sign the attached Regulatory Agreement (RA) upon final approval as to content and form by Mr. Gelineau, DHCD and Windover relative to the Enterprise Apartments project at 81 Rantoul Street.
