1998-06-30BEVERLY CONSERVATION COMMISSION MINUTES OF MEETING JUNE 30, 1998 A regular meeting of the Beverly Conservation Commission was held on June 30, 1998 at 7:00 p.m., third floor, City Hall, 191 Cabot Street. Those Present were: Richard Benevento, Dr. Mayo Johnson, Jay Donnelly, and Patricia Grimes. Also present was Assistant Planning Director Debbie Hurlburt, and Susan Akerman, Secretary to the Commission. Meeting called to order by Acting Chairman Benevento at 7:00 p.m. Reguest for Determination of Applicabilities: 111verson Road - construction of a 3-season Dorch/Barnico Mr. Barnico addressed the Commission and explained a proposal to construct a simple 3-season porch at 11 Iverson Road. Mr. Barnico explained that the porch will be approximately 40 feet from the intermittent brook at the rear of his property, but that it will be no closer than the existing house foundation, that the area is not very intrusive, the brook is protected by trees and bushes, and that it will be built on concrete sono tubes. Richard Benevento asked if the distance between the porch and the brook will be all lawn. Mr. Barnico responded yes. Jay Donnelly suggested that Mr. Barnico also use haybales and silt fencing during construction to protect the brook. Mr. Barnico stated fine. Jay Donnelly asked if the proposed deck area grade was equal to the road grade. Mr. Barnico stated that all the work can be easily done from the road. Dr. Johnson stated that he visited the site and that this will be a reasonable project. There being no further questions or comments regarding this matter, a motion was made by Pat Grimes to issue a Negative Determination #3 with the condition that hay bales are used during construction, seconded by Dr. Johnson and approved unanimously. A motion was made by Pat Grimes to recess for the purpose of holding public hearings, seconded by Dr. Johnson and approved unanimously. Public Hearinqs Continuation: 38 Paine Avenue poolhouse/Seeliq retaininq wall, inqround pool & A motion was made by Pat Grimes to continue the public hearing on 38 Paine Avenue to the Commission's special meeting scheduled for July 7, 1998, seconded by Dr. Johnson and approved unanimously. Continuation: Svlvester Avenue house construction/Trentini A motion was made by Pat Grimes to continue the public hearing on Sylvester Avenue to the Commission's special meeting scheduled for July 7, 1998, seconded by Dr. Johnson and approved unanimously. Continuation: L.P. Henderson Road - Mini Storage Facilitv/T Ford Company Debbie Hurlburt read a letter from the applicant Thomas Ford, requesting an extension of this public hearing to the Commission's August meeting. (On File) A motion was made by Pat Grimes to continue the public hearing on L.P. Henderson Road - Mini Storage Facility to the Commission's meeting scheduled for August 11, 1998, seconded by Dr. Johnson and approved unanimously. New: 181 Elliott Street - construction of Darkin~ qara~e/Beverly Commerce Park Bruce Oveson with Cummings Properties addressed the Commission and explained a proposal to construct a 3-level parking garage at the Cummings Center. Mr. Oveson noted that this is the same parking structure that has been going through the Planning Board. Mr. Oveson explained that the garage is located in a flood plain, that the structure will be 120' x 420', that it will be a concrete structure with a pile foundation and that they have applied for a Chapter 91 Waterways License. Jay Donnelly asked if the proposed garage foundation would disturb the existing culvert. Mr. Oveson stated no. Jay Donnelly asked if they anticipate any interferences between the culvert and the proposed utilities. Mr. Oveson stated no. Mr. Oveson reviews the landscaping and noted that there will be no increase to the impervious area. Debbie Hurlburt suggested that the Commission schedule a site visit. A motion was made by Pat Grimes to continue the public hearing on 181 Elliott Street to the Commission's special meeting scheduled for July 7, 1998, pending a site visit to take place on Monday, July 6, 1998 at 6:00 p.m., seconded by Dr. Johnson and approved unanimously. New: 171 West Street - uDqrade seDtic sVstem/Cushinq A motion was made by Pat Grimes to continue this public hearing on 171 West Street to the Commission's special meeting scheduled for July 7, 1998, seconded by Dr. Johnson and approved unanimously. A motion was made by Pat Grimes to table the remainder of the agenda to the Commission's special meeting scheduled for July 7, 1998, seconded by Dr. Johnson and approved unanimously. Adiournment A motion was made by Pat Grimes to adjourn the meeting, seconded by Dr. Johnson and approved unanimously. Meeting was adjourned at 7:30 p.m.
