Such improvements will be funded through a loan order in the amount of $500,000, the debt service of which will be paid by Beverly Golf & Tennis Enterprise Fund. The Main Streets organization has worked for some time on initiatives aimed at aiding that effort. One of these is the creation of a residential Tax Increment Financing district, better known as a residential TIF District which would nearly coincide with the same geography on which your Honorable Council previously voted favorably to increase the building height limit to 75 . As you know, TIFs are a form of patient capital which offer temporary real estate tax incentives in the form of reduced real estate taxes to developers on approved construction projects. These incentives which shrink and disappear over time are seen as promoting economic development. Specifically, increased residential units in the downtown are expected to create additional demand for commercial businesses throughout the downtown. The City of Beverly has approved a very limited number of commercial and industrial TIFs over the years. The TIF granted to Cummings Center has been hugely successful spawning much greater total investment than otherwise would have been the case. Today the Cummings Center is fully taxed as if the TIF had never existed but the size of the tax bill is much greater because the TIF promoted greater investment. Attached is a proposal for your review which, if approved, would create a geographical TIF district. While the law puts negotiating power for TIF terms in the hands of the mayor, I request that the Council develop separate language in the form of an ordinance to ensure that all approved TIFs offer the same benefits so as to eliminate any prospect of favoritism in dealing with different developers. Deviation from that policy could only occur with both the approval of the City Council and the Mayor. I believe this proposal deserves your thorough attention and ask that you call for a public hearing on the matter. Scanlon, Jr., Mayor Refer to Finance and Proaerty #147 June 18, 2012 The Honorable City Council 191 Cabot Street Beverly, MA 01915 Dear Honorable Council: As you well know, the City of Beverly has focused significant attention on storm drainage issues. In total, five projects of size have been accomplished. These are Chase Street, Lawrence Brook, Chubbs Brook, Raymond Farms and North Beverly Brook. During the so- called Mother's Day Storm of 2006, the Chubbs Brook Project worked well until the seventh consecutive day of rain when water came over the top of a detention basin and wreaked havoc downstream. At that time, we determined we would make further improvements and we have worked hard to gain approvals to bolster that project. The good news is that recently FEMA, the Federal Emergency Management Agency approved a request made by Beverly for a Hazard Mitigation Grant to improve the flood protection in this area. The grant will offset a total of $730,725 of our costs. Roland Adams of our Engineering Department deserves special credit for his work successfully pursuing this grant. The scope of the work to be done is significant and we have also chosen to include improvements to our fire fighting capability in Beverly Farms as part of this same project. A letter from Commissioner Mike Collins regarding the work to be done is attached to provide additional detail. The scope of work is as follows: 1. Modifications to Dix Park to allow increased temporary storage during flood conditions. Estimated cost - $50,000 2. Create significant increased temporary storage capacity in what is known as Storage Area #4 by means of installing a concrete wall. Estimated cost - $175 3. Replace the culvert under Haskell Street to create far better flow characteristics. This change will greatly reduce flooding along Haskell Street and Goodwin Road as well as in and around the Beverly Farms cemetery. Estimated cost - $600,000 4. Appropriate funds for Drainage Area #5 development on property further upstream for greater detention basis storage capacity - $225,000. The land is privately owned but the owners are very willing to allow temporary water storage creation. 5. As mentioned in the most recent State of the City address, there is a need to enhance fire fighting capability in the Beverly 7/13/2012 Regular Meeting Page 4 of 14 Farms area. While Haskell Street is torn up to replace the culvert described in No. 3 above, we wish to replace the existing six inch water line in Haskell Street with a twelve inch pipe with four times the water flow capacity. This improvement and the subsequent street paving post installation will cost $400,000. The total of the above is $1,450,000 of which $730,725 will be paid for by the grant. I would ask that your Honorable Council approve this request with a contingency bringing the total appropriation to $1,700,000. These improvements will provide value for decades to come in terms of flood protection and fire fighting capability and make good on our promise to the citizens of Beverly Farms to do all in our power to reduce flooding concerns. Attached also is a form of loan order for the needed appropriation. Please set a Public Hearing to discuss the appropriation needed to perform this work. Very truly yours, William F. Offenses and Miscellaneous Provisions Sec. 22.40 Waterways Regulations The harbormaster, deputy harbormaster and assistant harbormaster shall, in their 7/13/2012 Regular Meeting capacity, as special police officers of the city, subject to the direction and control of the chief of police, insofar as they are acting as special police officers, enforce the following waterway ordinances, in addition to any Laws of the Commonwealth and United States federal government pertaining to waterways of the city: (a) The speed limit for boats traveling in the area between Foster's Point and the number 8 NUN shall be five (5) miles per hour, and shall be posted as such with a sign indicating "No Wake Area ". The fine for violating this section shall be fifty dollars ($50.00) for each offense. (b) All boats in Beverly waters shall properly display current registration numbers or have current documentation on board. The fine for violation of this section shall be fifty dollars ($50.00) for each offense. © Boats docked at the Ferry way public landing in excess of the posted time limits shall be subject to a fine of fifteen dollars ($15.00) for the first offense, thirty dollars ($30.00) for the second offense, and fifty dollars ($50.00) for each subsequent offense. (d) Willful abandonment of any boat in city waterways or placing a boat on an unauthorized mooring shall be prohibited. The fine for violation of this section shall be fifty dollars ($50.00) per day. (e) Each mooring in city waters shall clearly display the mooring number assigned by the harbormaster and shall comply with the rules and regulations of the office of the harbormaster. Copies of such rules and regulations shall be provided annually to individuals receiving or renewing their mooring permit. The fine for violation of this section shall be fifty dollars ($50.00). (f) The number of boats tied tied to a mooring or the rafting of boats on a mooring shall not exceed the number of boats assigned to each mooring by the harbormaster. The fine for violating this section shall be twenty five ($25.00). (g) Sail boarding shall not be permitted west of the number 10 NUN to the Veteran's Memorial Bridge. (h) Boats shall maintain a distance of three hundred (300) feet from public beaches and shall not be operated in a manner that would endanger themselves or others. The fine for violation of this section is fifty dollars ($50.00). Sec. 22.41 Glover Wharf Regulations The harbormaster, deputy harbormaster and assistant harbormasters shall, in their capacity s special police officers of the city, subject to the direction and control of the chief of police, insofar as they are acting as special police officers, enforce the following Glover's Wharf Regulations, in addition to any Laws of the Commonwealth and United States federal government pertaining to Glover's Wharf. Failure to the regulations is subject to the posted fine. (a) For the purpose of this section recreational boat slips shall mean shall mean those floating docks at the Glover Wharf Marina on the other side of the fence along the concrete platform and east of the recreational boat gate. The "J" area shall mean the area from the recreational boat gate to the end of the transient dock and the "Apron" shall mean the fence along the length of the concrete platform. (b) The following restrictions shall apply the the "J" and "Apron" areas: (1.) No casting anytime (2.) No access from 10 pm to 6 am excepting persons currently leasing a recreational boat slip and their guests, dinghy rack holders and transient docked boaters. (3) Trash In /Trash Out policy applies as it does in all parks. (4) Fishing will be designated by posted signs and in those and Page 9 of 14 7/13/2012 Regular Meeting in those areas only. (5)Boats may tie up temporarily at the transient dock tie -up and not to exceed the posted time limit. © For the purpose of this section the "Pier" shall mean the public pier. And the following restrictions shall apply: (1) No Casting anytime. (2) No access from 10 pm to 6 am. (3) Trash In /Trash Out policy applies as it does in all parks. (4) Fishing will be designated by posted sign. (d) The following restrictions will apply to the recreational boat slips: (1) Only persons currently leasing a recreational boat slip and their guests are allowed access.
