2010-01-05 CITY OF BEVERLY PUBLIC MEETING MINUTES Date: Board: Members Present January 5,2010 Conservation Commission Tony Paluzzi, Bill Squibb, Dr. Mayo Johnson, Kate Glidden Members Absent: Chair David Lang, Gregg Cademartori, Mary Reilly Others Present: Amy Maxner - Environmental Planner Recorder: Eileen Sacco Paluzzi calls the meeting to order at 7: 15 p.m. at Beverly City Hall, 191 Cabot Street Street, Beverly, Ma. LLC Maxner notes that a final easement plan is in the process of being prepared and this will need to be continued to the next meeting. Johnson moves to continue the matter to the next meeting of the Commission on January 26, 2010. Squibb seconds the motion. The motion carries 4-0. ReQuest for Determination of Applicabilitv New: Route 127 (Hale Street) Resurface Existin2 Roadway. Reconfi2ure/Rebuild Draina2e. Sewer and Utilities Within Ri2ht of Way - Mass DOT. Hi2hway Division Andrea Norton of Mass DOT is present for the applicant. Maxner reads legal notice. Norton addresses the Commission and explains that Mass DOT is proposing roadway maintenance and resurfacing for a section of Route 127, parts of which include drainage and utility work. She explains that this is routine maintenance from the edge of road to edge of road and explains the process. She notes that new frames and grates and covers will be installed for catch basins and utilities as needed. She also notes that any materials removed will be immediately containerized and hauled offsite. Maxner questions if they are proposing repaving the streets or adjustment of paving surfaces and asks what kind of drainage work is proposed. Norton states that they will be repaving the surfaces of the roadway and will only be adjusting surface elevations of catch basins and utilities to be flush with the new pavement. Norton states that it should be a relatively quick project noting that the weather will be a factor. Paluzzi asks when they plan to do the work. Norton explains that when the project timeline will be dependent upon the paving suppliers and weather. She notes that they want to start as soon as they can and estimates that the work will be done in mid March or April. Maxner notes her suggestion that erosion control measures be installed and inspected prior to work. Members agree to this condition. Paluzzi opened to public comment. There is no one present who wishes to comment on this matter. There being no further questions or comments regarding this matter, Johnson moves to issue a Negative 3 Determination with erosion control inspection condition as discussed. Squibb seconds the motion. The motion carries 4-0. Recess for Public Hearin2s Johnson moves to recess for public hearings at this time. Squibb seconds the motion. The motion carries 4-0. Cont: 114 Hart Street - Jeff Lawler Maxner informs the Commission that the applicant has requested that the matter be continued to the February 23,2010 meeting, and no discussion of the matter will be held this evening. Johnson moves to continue the matter. Squibb seconds the motion. The motion carries 4-0. New: 150 Sohier Road - Shaw Environmental Raymond Cadorette of Shaw Environmental is present for the applicant. Cadorette addresses the Commission and explains that they are proposing to install three monitoring wells adjacent and underneath Building # 3, one being within the 100-Foot Buffer Zone to bank of an intermittent stream. He notes that this project is outside the 25' NDZ. He explains that there is an intermittent stream that receives runoff and discharge from Route 128 on the site. He notes that the wells will be drilled at a 450 angle. Maxner asks how much excavated material is estimated. Cadorette states they estimate about four yards of material and it will be containerized. He also notes that once they get the data from the wells they will know what to expect. Maxner asks if the wells can function to treat groundwater. Cadorette states yes they can. There being no further questions or comments regarding this matter, Johnson moves to close the public hearing. Squibb seconds the motion. The motion carries 4-0. Orders of Conditions 150 Sohier Road - Shaw Environmental Johnson suggests standard conditions. Squibb recommends a special condition that all excavated material be containerized onsite and shall be removed in a timely manner. There being no further questions or comments, Johnson moves to approve the Order of Conditions for 150 Sohier Road. Squibb seconds the motion. The motion carries 4-0. Old/N ew Business National Grid Pole Replacement Alon2 McPhereson Drive Maxner informs the Commission that National Grid is requesting that the Commission determine that the replacement of three telephone poles on McPherson Drive immediately adjacent to the Bass River to be exempt from filing as it is routine maintenance of public utilities. She notes that she provided an aerial photo map of where the poles are located. Members review the map. Johnson moves to approve the request of National Grid to determine that the replacement of these poles is routine maintenance and is exempt from filing. Squibb seconds the motion. The motion carries 4-0. 188 Elliott Street - Church of the Nazarene Maxner explains that Kristan Farr, the Danvers Conservation Agent followed up on a violation at the Church of the Nazarene on Elliott Street while Maxner was on vacation between Christmas and New Years. She explains that the church's parking lot is immediately adjacent to a wetland and both straddle the Beverly/Danvers line. Maxner explains that she and Farr met with Church officials today and explains that the church was looking to fix some flooding and icing problems in their parking lot which receives overland flow from the up gradient wetland. She explains that they suspect that a pipe receiving flow from street drains and the wetland has become clogged and that is why the overflow is happening. Maxner explains that the church had a French style drainage trench dug around the perimeter of the parking lot. She notes that work was definitely done within the buffer zone but she is not sure if the wetland was directly impacted, but it is possible. She notes that she and Farr agree that handling this under an Enforcement Order is most appropriate and recommend that the church have the wetland delineated and develop a clear plan for how they want to handle the Beverly Conservation Commission January 5, 2010 Meeting Minutes Page 40f4 flooding issue. She also noted that she checked with the Engineering Department and from a city drainage standpoint only maintenance of the pipes up to the town line has been done in the past. She also noted that when Elliott Street was reconstructed there was an undersized drainpipe that was replaced with a larger pipe to handle the street drainage from the Beverly Hills and Sunset Avenue neighborhoods. Johnson moves to issue an Enforcement Order for 188 Elliott Street, Church of the Nazarene, and that they be required to provide a wetland delineation and to file a plan with the Commission detailing the work to be done and remediation if necessary. Squibb seconds the motion. The motion carries 4-0. Approval of Expenditures '" Expenditure of$160.80 for mileage for Amy Maxner - 804 miles from May 2009- December 2009. Johnson moves to approve the expenditure. Squibb seconds the motion. The motion carries 4-0. '" Expenditure of $5,000 - Conservation Administrators Annual Stipend. Johnson moves to approve the expenditure. Squibb seconds the motion. The motion carries 4-0. Election of Officers Maxner suggests that the matter of electing Officers for the Conservation Commission for the year 2010 be tabled to the next meeting. Johnson moves to table the election of officers to the next meeting. Squibb seconds the motion. The motion carries 4-0. Approval of Minutes There are no minutes presented for approval this evening.
