2009-02-18 CITY OF BEVERLY PUBLIC MEETING MINUTES Board: Harbor Management Authority Date: February 18, 2009 Location: Beverly Public Library - Fogg Room Members Present Chair, Miranda Gooding, Charles Raymond, Greg Ward Paul Miedzionowski, Don Neuman, Maureen Troubetaris, Rinus Oosthoek, Wes Slate, Sylvan Menezes, George Simon Members Absent: None Others Present: Lou Bochynski, Eileen Sacco - Recorder Gooding called the meeting to order at 7:00 p.m. Approval of Minutes The minutes of the Harbor Management Authority meeting held on January 21,2009 were presented for approval. Oosthoek moves to approve the minutes of the Harbor Management Authority meeting held on January 21,2009 as amended. Slate seconds the motion the motion carnes. Report from Facilities Committee Ward reports that the Facilities Committee met this evening and are recommending that the summer rates for the commercial boaters be increased from $76 per foot to $80 per foot. He explains that this is slightly less than 5%, and notes that the HMA did not raise the rates last year. Oosthoek moves to accept the recommendation of the Facilities Committee and set the Commercial Fees for the 2009 season at $80.00 per foot. Slate seconds the motion. The motion carnes. Ward reported that the Facilities Committee discussed the electricity issue and the consensus was to let it ride for now until we get it cleared out. Bochynski explained the process of billing, meter reading, and the collection and processing of payments. Discussion ensues regarding the tracking of electricity and the accounting of the payments. Oosthoek states that it can be worked out. Ward reported that one recreational and two commercial tenants have been turned over to Mr. Monroe for collection action. Bochynski reported that he provided Mr. Monroe with documentation and he will be reviewing it. Harbor Management Authority February 18, 2009 Page 1 of 4 Finance Report Harbor Improvements Gooding reported that she, along with Oosthoek, Neuman, and others have been working with Vine Associates to break down the estimated costs of the marina improvements into phases. She reviews estimates for the proposed work noting that there are alternates included. She notes that if the stimulus money does not come in we need to know what we can afford to fund in order to get the work done at Glovers Wharf. She notes that the estimate of the work that needs to be done is $2 million dollars. Oosthoek questioned what had to be done to the area without the Black Cow project. Gooding explains that the apron and the bulkhead need to be replaced. Neuman notes that we have to deal with the water side in front of the McDonald's building, noting the bulkhead, gangway and floats have to be replaced. Ward notes that in order to keep the revenue coming in we have to replace the floats. Gooding notes that the Black Cow project is moving along explaining that they have filed with the Planning Board for site plan review and the public hearing is scheduled for March 17, 2009. She encouraged all members to attend the meeting to support the project. Miedzionowski review the monthly financial statement with the HMA members. Discussion ensued regarding the $40,000 that the city transfers out of the HMA enterprise fund to the city budget. Ward states that he hopes that the HMA will be able to keep those funds in the future. Status of Appropriation ReQuest from Citv Council Gooding reported that the appropriation request went before the Beverly City Council and the matter was referred to the Council budget analyst for an opinion. The budget analyst reported back that she did not think that the Harbor Management Authority is authorized to spend money and suggested that the Council get an opinion from the DOR. Gooding explained that an earlier opinion from the budget analyst stated that the HMA does have the authority to appropriate money, and there is no need to go to the Council for approval. She further explained that the action of the HMA is subject to revocation by the City Council by a 2/3 vote within 30 days of the action of the HMA. Gooding reported that Finance Director John Dunn has recommended that the HMA vote to ratify the FY09 budget and to also vote to increase the FY09 budget by $100,000 to fund ongoing engineering consulting contracts with Vine Associates. Harbor Management Authority February 18, 2009 Page 2 of 4 Ratifv Harbor Mana2ement Authoritv Bud2et Oosthoek moved to ratify the current fiscal year 2009 Harbor Management Authority budget, approved by the Beverly City Council in June 2008, authorizing the expenditure of $177,900 which amount was further augmented by $15,425 encumbrance carried forward from the previous fiscal period. Miedzionowski seconded the motion. The motion carried. Appropriation Oosthoek moved to increase the Harbor Management Authority fiscal year 2009 budget by $100,000 to fund ongoing engineering, consulting contracts with Vine Associates for harbor improvements. Ward seconded the motion. The motion carried. Approval of Revised Scope of Work for Vine Associates Neuman moved to approve the revised scope of work for Vine Associates to provide additional services for the Harbor Improvements and the Glovers Wharf Seawall. Oosthoek seconded the motion. The motion carried. Discussion ensued regarding the authority of the HMA and Gooding recommended that the HMA work on this noting that the role of the HMA is unclear in the charter. She suggests that a subcommittee review the charter to evaluate what makes sense. Ward, Oosthoek and Simon will serve on the subcommittee. Licensin2 Neuman reported that he talked to DEP regarding restrictions on piers and there are none. Menezes reported that he researched this and found that the only community that has restrictions is Barnstable and explained that the requirement is that people have to be able to walk under a pier. He explained that this is administered by the Barnstable Conservation Commission. Gooding stated that if people think it is a significant issue then we could move forward, but cautioned that if Barnstable is the only community in Massachusetts that has this, she questions if it is an easy thing to do. Neuman reported that a meeting was held with the Mayor, Tina Cassidy and Mr. McLaughlin regarding the walkway plans. Gooding reported that Tina Cassidy gave her a copy preliminary design report for the project and she emailed it to members. Discussion ensued regarding design that is preferable to the HMA. Oosthoek moved that the HMA recommend a modified alternative 3 proposed, in accordance with Bochynski's recommendations. Troubetaris seconds the motion. The motion carried. Update on Dred2in2 ProiectIFundin2 Neuman reported that the next step since the approval of the testing the permission to dispose at sea is for the engineering plan and the permitting process. He stated that Bourne Associates estimated that it will cost $75,000. He recommended that the HMA put it in the budget for next year and see what happens. He also noted that the money should come from the Seaport Council and notes that we are in line for some spare change from this years budget. Adiournment There being no further business to come before the Harbor Management Authority this eyeing, Slate moved to adjourn the meeting. Ward seconds the motion. The motion carries.
