2009-01-21 CITY OF BEVERLY PUBLIC MEETING MINUTES Board: Harbor Management Authority Date: January 21,2009 Location: Beverly Public Library - Fogg Room Members Present Chair, Miranda Gooding, Charles Raymond, Greg Ward Paul Meidzionowski, Don Neuman, Maureen Troubetaris, Rinus Oosthoek, Wes Slate, Sylvan Menezes, George Simon Members Absent: None Others Present: Eileen Sacco - Recorder Lou Bochynski John Hayes et aI., Bass Haven Yacht Club Gooding called the meeting to order at 7:00 p.m. Approval of Minutes The minutes of the Harbor Management Authority meeting held on November 19, 2008 were presented for approval. Troubetaris moves to approve the minutes of the Harbor Management Authority meeting held on November 19, 2008. Raymond seconds the motion the motion carnes. Discussion with Representatives of the Bass Haven Yacht Club John Hayes, representing the Bass Haven Yacht Club addressed the Harbor Management Authority and explained that they have concerns regarding a sand bar that is growing in the Bass River He explains that they have been collecting money from their members for the last few years and they are offering to do some maintenance work in the channel in the hopes of eliminating the sandbar. He notes that they met with the Conservation Commission and held a discussion with them to see if they would go along with doing the project as maintenance of the channel. He explained that he was hoping to submit a Determination of Applicability but the Commission did not agree with that. He also notes that he is positive that the material is sand and gravel and not the mud of the basin. He recalled that there was a break in the 48" drain line near McPhearson Park and that is when the sandbar started. He also noted that they feel that the sandbar is a navigational hazard and they are concerned about it growing farther into the channel. Hayes stated that they would like to propose to remove the sandbar and hopefully piggy back the project with the dredging project in the river. He also noted that they are not rich but they have some funds to contribute and they would also try to get some state funding for the project. Harbor Management Authority January 21,2009 Page 1 of3 Neuman discussed the status of the Authority's efforts to pursue the Bass River dredging project and the status of the samples being analyzed by the Army Corps of Engineers. He explained that there has been a determination made that the material dredged from the river could be disposed of at sea. He further noted that the cost estimates from 2005 was about $550,000 and it would be more now. Gooding noted that the HMA had planned on approaching BHYC and others once the samples had been finally analyzed. There was discussion about how the Authority might assist or cooperate with BHYC in its efforts to address the short-term problem of the sand bar. Neuman agreed to make some preliminary inquiries to David Bourne about the issue and to be in touch with BHYC representatives. Gooding stated that Neuman would look into this further and get back to them. She thanked the members of the BHYC for attending the meeting. Report from Facilities Committee Ward reports that the Facilities Committee met this evening and are recommending that the summer rates for the recreational boaters remain the same at $140.00 per foot. He also reviews the following recommended increases to services at the marina: Dingy Rack Storage Transient Dockage Meter Fee Administrative Fee Live Aboard Fee Work Through $190.00/$380.00 $ 2.00 per foot per night $ 50.00 annual $ 100.00 per agreement $ 30.00 per month $ 1.00 per trap Troubetaris moves to accept the recommendation on the Recreational Boating Fees for the 2009 season. Slate seconds the motion. The motion carries. Ward reports that a recommendation on the commercial fees will be made at a future meeting. Gooding reported that she followed up with the City Solicitor regarding people who are in arrears and they will be sending out another letter in the spring. Slate asks if there was any impact from the first letter. Bochynski will get that information for the next meeting. Finance Report Gooding reported that since the last meeting she and members met with Finance Director John Dunn and Dave Gelineau regarding the HMA budget. She explained that there will be an appropriation going to the City Council to go to the HMA budget to pay for the Black Cow Permitting and the services of Vine Associates. She notes that the city has rediscovered some grant money which is now a part of the HMA budget. Meidzionowski review the monthly financial statement with the HMA members. Harbor Management Authority January 21,2009 Page 2 of3 Licensin2 Gooding reported that the Hubbards have applied for a permit for a private pier in front of their residence. She reported that she talked with Amy Maxner, the Agent for the Beverly Conservation Commission and she informed her that the Hubbards are aware that they need a Chapter 91 License and are pursuing an Order of Conditions from the BCC first. She also noted that there was no real opposition at the Conservation Commission meeting. Menezes notes that the HMA does not have a policy regarding piers on water front property. Neuman suggests that the HMA should be sure to comment during the 30 day comment period and to make sure that DEP sends the notice. It was noted that there are several piers in the neighborhood. Slate reported that some neighbors have strong feelings about this. Gooding agrees and states that the HMA should make sure that they are aware of the Chapter 91 License process on this and take a stand. Oosthoek stated that he would research surrounding communities regarding regulations they may have for piers. Other Business Gooding reported that the Mass Highway meeting will be rescheduled at a time to be determined. Gooding noted that she sent an update on the Black Cow project to members. She states that the project is almost ready to go to the Planning Board and she expects that it will be filed in February and a public hearing will be held in March. Discussion ensues regarding the proposed plans and the third floor. It was noted that Mr. Leone may be depending on that floor as a significant part of the project. Adjournment There being no further business to come before the Harbor Management Authority this eyeing, Slate moved to adjourn the meeting. Ward seconds the motion. The motion carries.
