2007-09-04 CITY OF BEVERLY PUBLIC MEETING MINUTES Date: Board: Location: Members Present September 4,2007 Harbor Management Authority Waterfront Don Neuman, Sylvan Menezes, Greg Ward, Charlie Raymond, Paul Miedzionoski Miranda Gooding, Maureen Troubetaris Lou Bochynski Members Absent: Others Present Recorder: Eileen Sacco There was no quorum of the Beverly Harbor Management Authority this evening. The meeting was called to order at 7:00 p.m. U odate on Meetin2 with Mavor Scanlon Mr. Neuman updated the Authority on a meeting he had with Mayor Scanlon. He noted that they discussed membership issues and he emphasized that there is a problem with the Authority getting a quorum to hold official meetings. He suggested that the members suggest candidates to the Mayor for possible appointment to the HMA. Mr. Ward suggested that Main Streets and the Chamber of Commerce be approached about possible members for the HMA. U odate on License Payments Mr. Neuman stated that he feels that the HMA should be getting a monthly statement from John Dunn. It was also suggested that the HMA check with Mr. Dunn to see if money is being collected from license holders and if not it should be collected. It was noted that 1/3 of the money is due for mitigation on city property. Mr. Neuman reported that Joe Leone does not want to manage the commercial marina. Mr. Neuman noted that he talked to Mayor Scanlon about this. Status of the Black Cow Mr. Neuman updated the HMA on the status of the Black Cow. He reported that an E&F hearing would be held in 10 days. He also noted that information provided to Coastal Zone Management was inadequate resulting in a delay of 2-3 weeks. He noted that Mr. Leone and Tina Cassidy are working on this and will provide CXM with the correct information. Draft Minutes Page 10f3 9/4/07 BHMA Meeting Mr. Neuman explained that there are issues with three parcels being integrated into one site. He noted that there are size issues, noting that the McDonalds site alone is just under the requirement. He also noted that the city is working on financial agreements and they have agreed to let him take a look at them before they are finalized. Ferry Way Landin2 Mr. Neuman reported that he has the latest plans and the pavement is included to sustain the industrial use. BPM N e20tiations U odate Mr. Neuman noted that the city has to respond to the last offer made by the Kinseys. He explained that the last estimate for dredging has been received and explained the process noting that the Army Corp of Engineers requires four samples and testing. He noted that Bourne Engineering is doing the work and $25,000 more is needed to complete it. Mana2ement of the Harbor Authority Mr. Neuman noted that Mr. Dunn's office is doing the billing but expressed concern about how the HMA will address delinquent payments. Paul Miedzionoski will meet with Lou Bochynski and see what needs to be done regarding finances. It was noted that meeting notices and mailing of correspondence needs to be addressed since some members received notification of the meeting and others did not. It was noted that while minutes to meetings have been addressed there are still issues with posting meetings, booking space at the library to hold meetings, and bill paying that needs to be addressed. Mr. Neuman noted that the HMA files are being kept in the City Solicitors office. A discussion was held on what might be the best way to direct the mail of the HMA members. Noreen will be informed regarding who to call if there is mail for the HMA at city hall. It was suggested that the contact person for HMA issues should be Lou and a letter regarding procedures should be sent to the Harbor Master through the Personnel Office. Other Issues A discussion was held regarding the length of boats docked at the moored at the marina. Mr. Bochynski reviewed the history and the reasons for the restriction on the size of boats. Mr. Neuman stated that he would like a list of reasons why a boat should not be here regarding size. Mr. Bochynski noted that City Solicitor Roy Gelineau has told him that it is difficult to enforce size restrictions because of past practice in allowing larger boats in certain circumstances noting that there is a 42' boat here that is over the allowed size. It was suggested that the matter be taken up by the Facilities Committee. Mr. Ward requested that a BHMA Facilities Committee meeting be scheduled for Friday, September 7,2007 at 5:00 p.m., at the waterfront. Draft Minutes Page 2 of3 9/4/07 BHMA Meeting Next Meetin2 It was suggested that the members of the Harbor Management Authority be surveyed to see what the best night for monthly meetings would be. It was noted that two City Councillors serve on the Authority and have been unable to make meetings because of other commitments. A meeting date for the next meeting will be set at a later time.
