We have received a request from Dom's Trattoria, 1 West Street to change the 15-minute parking 6:00 a.m. to 7:00 p.m. to 15-minute parking 6:00 a.m. to 8:00 p.m. This would affect the three spaces in front of #1 West Street. Dom's Trattoria is primarily a take out restaurant and the additional hour of 15 minute parking would assist their evening hours business. We looked into this request and concur with them. Please take the necessary action to amend Chapter 14, Section 123 as follows: Delete: Sec. 14-123, Fifteen-minute parking West Street, three (3) spaces in front of #1 West Street, between the hours of 6:00 a.m. to 7:00 p.m., 7 days a week. We have received complaints of a Livery (limousine) business, licensed by the City of Beverly, being operated as a Taxi business, in violation of Chapter 13, Article III. Chapter 13, Article III regulates Taxi businesses and Article IV regulates Limousine businesses. The taxi regulations under Article III are much 31 more stringent than the limousine regulations under Article IV. Some of these regulations are that taxis are required to have meters regulated by the City Sealer of Weights and Measures, the fares are set by City Ordinance Sec 13-81, have a staffed office during operating hours and the vehicles are subject to inspection by the police department. None of these regulations apply to livery (limousine) businesses under Article IV. We have received complaints that Dennis Soper and Brian Davis, dba NDARYD Transportation, 100 Cummings Center, Beverly, Ma. are operating as taxis in violation of Chapter 13, Art. III. Soper has a Livery (limousine) license issued by the City of Beverly, # 2007-06, for one vehicle, a 1995 Mercury Grand Marquis, sedan, Ma. registration LV47420. The business on this license is NDARYD Transportation. Soper and Davis have an application for a second Livery license pending approval by the Beverly City Council. The business is also listed as NDARYD Transportation on the application. On February 28, 2007 in response to complaints regarding NDARYD transportation, Beverly Police detectives observed Soper parked in the taxi stand on Park St. in his Mercury Marquis with a "taxi" sign affixed to his vehicle. Also observed at the same time in the taxi stand was Brian Davis in a 2001 Ford Crown Victoria, Ma. reg. LV40450. This vehicle is apparently unlicensed by the City as a Livery vehicle. At this time Mr. Davis would be considered an unsuitable person to be issued a license by the Beverly Police Department. These vehicles are essentially being operated as taxicabs in violation of current City ordinances. This has led to disputes with other legitimate taxi businesses. Due to the facts presented, we request the Council revoke Livery license 2006-6 and deny the pending application for the second license. Very truly yours, Christopher J. We have received requests for the intersection of Hale Street and Dane Street to be made a 4-way stop intersection. There have been numerous accidents at this intersection and we concur with the request. Please take the necessary action to amend Chapter 14 Section 86 as follows; Add: Sec. 14-86 (b), Obedience to isolated stop signs.
