RE: 12 Lawnbank Road, "Ancient Highway" right of way
Dear Mr. Gelineau,
At its February 3, 2004 meeting, the Conservation Commission voted to seek your opinion
regarding the so-called "ancient highway" right of way as it pertains to the proposed work on the
single-family home located at 12 Lawnbank Road.
During the meeting, it was brought to the Commission's attention that an ancient right of way
exists along the top of bank running from Bay View A venue west to Brackenbury Lane.
Apparently, during the 1950's the County Commissioners were petitioned by a group of Beverly
residents to locate this right of way, and were able to do so up to the easterly property boundary
of 12 Lawnbank Road, as the owners at that time refused to reach an agreement with the
Commissioners.
Please find attached supplemental information provided to the Commission that may aid in your
determination of the status of this "ancient highway" with regard to the subject property. Please
advise the Commission as to the legal status of the right of way, and of action the Commission
should take in helping resolve this issue if appropriate.
