The Planters Subdivision roads and Thackery Way were accepted by the City Council as city streets in January, 2000. Very truly yours, Debra Hurlburt Planning Director Referred to Legal Affairs and Accounts #79 City Council City Hall Beverly, MA Dear Honorable Council: On January 4, 1999 the City Council adopted Order #24, providing for the taking of certain property belonging to Richard Maestranzi and others in connection with the capping of the landfill. Notice of the taking, which is required to be recorded in the Registry of Deeds within 30 days of the vote, was not recorded until December 19, 2001. The recorded Notice is itself deficient in the number of respects, including misidentification of the parcels taken and references to a plan different than the Plan that was actually recorded with the Notice. To correct these errors I request that the City Council make a “confirmatory taking” of the property and record that “confirmatory taking” within the required 30 days. I have attached a proposed order for your consideration and I will be happy to answer any questions that you have. Very truly yours, Peter H.
