1853-10-24Commonwealth of Massachusetts Essex, ss. To one of the Constables of the town of Beverly, Greeting. You are hereby required, in the name of said Commonwealth, to notify and warn the qualified voters of said Town to meet at the Town Hall on Monday the twenty fourth day of October instant at one o’clock afternoon for the following purposes: - 1st. To decide the matter of choosing a Moderator and to choose the same. 2d. To see if the Town will accept and allow of any or all of the laying out, extensions and widening of certain town ways according to the several reports of the Selectmen thereon now in the office of the Town Clerk, to wit: the laying out of the way which extends from near the house of Simeon Beckford on Cabot Street to Rantoul Street, and heretofore known as Burley Court, - the extension of Federal Street to Rantoul Street, - the laying out of the new town way from Hale Street near James Cressy’s house, to Endicott and Abbots streets near A. D. Kilham’s garden, and the extension of Abbott Street by the house of Abraham Hatfield to Lothrop Street, and thence by the house of Jesse Dame to low watermark on the Beach, - the widening of Dane Street between Essex and Hale Streets, - the extension of Charnock Street in a direct line from Cabot Street to Essex Street, - and the laying out of the new town way at Beverly Farms extending from Hale Street nearly opposite the house of Obed Woodbury, to Hart Street nearly opposite the house of Joseph E. Ober. 3d. To see if the Town will discontinue that portion of the old location of Charnock Street, which extends from Essex Street, to the new southerly line of said street as recently laid out by the Selectmen. 4th. To take such measures as may be deemed necessary in regard to grading and naming any of the ways or streets in town. 5th. To see if the Town will sell the present Work House establishment and any or all of the lands connected or used therewith, wherever situated, and purchase any other lands or estate for a new or more suitable Work House establishment, and erect buildings thereon, and authorize any person or persons to do, execute and perform any and all acts and deeds in behalf of the Town necessary to a accomplish either or all of these purposes. 6th. To see if the Town will authorize some person or persons to sell and convey all the right, title and interest in and to the real estate of the late John Glover, which was set off to the town upon an execution against said Glover, and which has not already been sold by the town. 7th. To see if the Town will authorize some person or persons, to sell and give a quitclaim deed of all the right and title the Town may have to half an acre of land on Paul’s Point. 8th. To see what measures the Town will take in regard to discontinuing, or altering the course of the drain which runs upon Messrs. R. & J. Pickett’s new wharf estate, from across Water and Davis streets. Hereof fail not, but make due return of this warrant with your doings thereon before said time. At a legal meeting of qualified voters of the town of Beverly, held, pursuant to the warrant recorded on the pages 401-2, on Monday the twenty fourth day of October, in the year eighteen hundred and fifty three at one o’clock afternoon - Voted, to choose the Moderator by hand vote, and Stephens Baker was thus elected. Voted, to accept and allow of the town way laid out by the Selectmen according to the following report thereof, to wit; upon the petition of Daniel Foster and others, for laying out the way hereto for known as Burley Court as a town way. Notice having been duly given to all parties interested, we the undersigned, Selectmen of the town of Beverly, did proceed to view the premises and hear the parties, and, upon the completion of said view and hearing, proceeded to layout said town way in manner and form following, to wit, commencing with the northerly line of the easterly line of Rantoul Street, 38 feet northerly of the monument at the angle on said street, and run thence South o 47 East, over and by lands of William H. Lovett and wife, Mark Dennett, Samuel Adams, John Dennis and Simeon Beckford to a point on Cabot Street, two feet and nine inches from the southeasterly corner of said Beckford’s house: commencing next with the southerly line of said town way, at the easterly line of Rantoul Street, sixteen feet three inches southerly of the monument o aforesaid, and run thence South 48 East, over and by lands of Abraham Edwards and the heirs of Isaac Rea, to a point on Cabot Street one foot from the northeasterly corner of the dwelling house of said Rea heirs. And we have awarded no damages consequent upon the laying out said town way. And in consideration that there is a Burley Street in town, we are of the opinion that the name of this way should be changed from Burley Court to Edwards Street. OberBeverly Alpheus Davis Voted, to accept and allow of the town way laid out by the Selectmen according to the following report thereof, to wit; Upon the petition of Ezra Ellingwood and others, for the continuation of Federal Street as a town way. Notice having been duly given to all parties interested, we the undersigned, Selectmen of the town of Beverly did proceed to view the premises and hear the parties, and upon completion of said view and hearing, decided to continue said Federal Street to Rantoul Street; and have accordingly laid out the same as a town way in manner and form following, to wit; commencing at the westerly terminus of the present northerly line of Federal Street at or near the corner boundary line between H. D. Whitney & wife, and the Smith estate, and run thence in a o continuous line with said northerly line of Federal Street about North 63 West over said Whitney’s land 217 feet to Rantoul Street; laying said town way forty feet wide southerly of the line described. And we have awarded damages consequent upon the laying out of said town way, To Haskett D. th Whitney and wife, fifty dollars. Witness our hands hereunto this 15 day of October A.D. 1853. Wm. H. Ober The Reports of the Selectmen laying out town ways from Hale Street to Abbott and Endicott Streets, and continuing Cabot Street through to Lothrop Street and thence to the beach, were postponed to the next March meeting. And their Report widening Dane Street was indefinitely postponed. Voted, To accept and allow of the town way laid out by the Selectmen according to the following report thereof, to wit; upon the petition of Thomas Burke and others for the continuation of the town way known as Charnock Street, through in a direct line to Essex Street. Notice having been duly given to all parties interested, we, the undersigned, Selectmen of the town of Beverly, did proceed to view the premises and hear the parties, and upon completion of said view and hearing, proceeded to layout said town way in continuation as prayed for in manner and form following, to wit; commencing at the northerly line of Charnock Street by the boundary line between Daniel Trow’s and Moses Stickney’s estates, and run thence in a direct line with said northerly line of Charnock Street, o South 56 ½ East over lands of M. Stickney, W. Standley & children, and Samuel M. Thissell to Essex Street; laying said Town way 40 feet wide Southerly of the line described, and reserve into the Standley estate the use of the well on their premises, so far as the same can be, consistent with the necessary and convenient uses of said way. And we have awarded damages consequent upon said laying out of town way - To William Standley and children, two hundred and ten dollars - Samuel M. Thissell, ten dollars. Ober of Alpheus Davis Beverly The town refused to accept the report of the Selectmen laying out a town way at Beverly Farms, and referred the same to the next March Meeting by a vote of 58 to 54. Voted, (upon the 3d Article) To discontinue that portion of the old location of Charnock Street, which extends from Essex Street to the new southerly line of said Charnock Street, as recently laid out by the Selectmen. Voted, (upon the 4th Article) To authorize the Selectmen to grade the several town ways which have been accepted by this meeting. Upon the 5th Article, relative to a Work House establishment, the Committee previously appointed, reported, and the whole subject was referred to Edward Pousland, Joseph E. Ober, Aaron Dodge, John Meacom and Shadrack Fiske, to report a detailed plan of operations to the next March Meeting. An unsuccessful effort was made to reconsider the vote accepting Edwards Street, in order to establish different lines of location from those reported by the Selectmen. The voters from Beverly Farms having come in by the afternoon train, a motion was made to reconsider the votes refusing to accept the report laying out a town way in that portion of the town and referring the same to the next March Meeting, and after some explanation and discussion of the subject, those votes were with much unanimity reconsidered, and it was - Voted, to accept and allow of the Town way laid out by the Selectmen according to the following report thereof, to wit: Upon the petition of Nathaniel P. Allen and others for a town way at Beverly Farms. Notice having been duly given to all parties interested, we the undersigned, Selectmen of the town of Beverly, did proceed to view the premises and hear the parties, and upon the completion of said view and hearing did proceed to layout said town way in manner and form following, to wit: commencing at a point on the northwesterly side of Hale Street about 284 feet southerly of the corner o of Hale and Hart Streets, and run thence North 57 West 588 feet over lands of Foster, Burnham, o Allen, Pierce, Larcom, Williams, & Perry to an angle; thence North 42 ½ West about 143 feet over o lands of Perry and Trowt to an angle; thence North 19 West about 78 feet over land of Batchelder o an angle at land of Joseph E. Ober; thence over said Ober’s land North 16 West about 140 feet to o an angle, and thence North 55 East about 223 feet to Hart Street. Laying the said town way forty feet wide northeasterly an easterly of the lines described. And we have awarded no damages th consequent upon laying out of said way. Bennett, Town Treasurer be authorized to give a deed of quit claim to the heirs of John Glover, of all the right, title and interest of the town in and to the real estate of the late John Glover, which was set off to the town on an execution against said Glover, and which has not already been sold by the Town, upon said heirs paying him the sum of ten dollars. Upon the 7th Article, after some discussion, the same was indefinitely postponed, when Capt. Josiah Lovett 2d publicly forbid any person passing over his land to Hospital Point in any other than the ancient way. The 8th Article was referred to the Selectmen with authority to do what they think right in the premises.
