1857-07-20Commonwealth of Massachusetts Essex, ss: To one of the Constables of the town of Beverly. Greeting. You are hereby required in the name of said Commonwealth to notify and warn in the usual manner the qualified voters of said town to meet at the Town Hall on Monday the twentieth day of July current, at Two o’clock for the following purposes. Viz.:- 1st. To decide the manner of choosing a Moderator, and to choose the same. 2d. To see what measures the town will adopt relative to an indictment against the town for nuisance, whether by defending the suit consequent thereon, or settling the same, or in any other manner deemed best for the interest of the town. Hereof fail not, but make due return of this warrant with your doings thereon before the time. Given under our hands and the seal this Sixth day of July in the year Eighteen Hundred Fifty Seven. Pursuant to the foregoing warrant I have notified the persons therein named as therein directed by posting notices thereof at or near each of the public meeting houses in town according to the Town Regulations. James Hill, Town Clerk At a legal meeting of the qualified voters of the town of Beverly held in pursuance of the warrant recorded on the next preceding page, at the Town Hall on Monday July 6,1857, at Two o’clock afternoon. Voted. To choose a Moderator by hand vote, and Frederick W. Choate was thus chosen. The 2d Article of the warrant being taken up, the indictment and summons thereon were read, by which there appeared to be some discrepancy between them. It was then moved by Zachariah Cole.-“ That the town employ able counsel and defend the suit consequent upon the indictment now pending against the town.” Joseph E. Ober Esq. then made a motion. “To refer Mr. Cole’s motion to a Committee of one from each school district to report at some future meeting” After some discussion it was Voted. That this meeting be dissolved. (85 in favor, 67 opposed) and it was so declared by the Moderator. A true record. Attest.James Hill, Town Clerk
