You are hereby required in the name of said Commonwealth to notify and warn (in the usual manner)
the qualified voters of said Town to meet at the Town Hall in said Town, the Third day of March next
at Nine o’clock A.M. for the following purposes, viz.:

1. To choose a moderate.

2. To choose Town officers for the ensuing year, grant them pay and take such action on the
Reports of the several Boards of Town Officers, and of Committees.

3. To take action upon a suit of the Commonwealth, for the board and expenses of Charles L.
Stackpole in the State Lunatic Hospital at Taunton from March 15,1867.

4. To act on the question of an appropriation for the expenses of Memorial Day in decoration of
Soldiers’ Graves under direction of Post No. 89 of Mass. Grand Army of the Republic.
th
5. To act on the several reports of the Selectmen on file, laying out and widening Town ways as
follows, viz.:
A new Town way from Cabot Street opposite Thorndike Street running into the way known as
Milton Street, widening the same to Rantoul Street:-
A Town way in continuation of Lovett Street from Robert Patch’s estate to near the angle in Bartlett
Street by the estate of Josiah L. Foster.
Widening the Town way known as Lovett Street on its Northwesterly side between May and Central
Streets.
Widening the Town way known as Lovett Street on its Northwesterly side between Central and
Washington Street.
A new Town way from near the culvert on Neptune Street, to the Sea near the Lighthouse lot at
“Hospital Point.”
A new Town way from near the culvert on Neptune Street, to Hale Street opposite Corning Street.
A new Town way from Bow Street near P. S. Webb’s stable and continuing in the way known as
Home Street to Rantoul Street, including the way known as Ashland Avenue, from Home to Federal
Street.

6. To see if the Town will purchase a new Steam Fire Engine and Apparatus and provide a House
therefore: also to see if the Town will procure a site and build thereon a suitable building for the
Hook and Ladder Truck per petitions of Seth Norwood and others, and of W. W. Hinkley and others.
Also to see if the Town will cause a Hose Tower to be built for the drying and care of Hose; also to
see if the Town will provide better Armory accommodation for the Beverly Light Infantry, in
connection with either of the proposed buildings.

7. To see if the Town will cause a Gas Light Post to be placed at the corner of Cabot and Fayette
Streets, per petition of Curtis R. Moulton and others.

8. To see if the Town will allow the bill of Samuel D. G. Standley for refreshments at the Ober and
West fires, according to his petition.
th
9. To action with reference to a new code of Bylaws for the Town.
th
10. To see if the Town will direct and authorized the Selectmen to select, layout, take or purchase
for a School House Lot; to the erect a new School House upon, all the land or any portion thereof,
lying between Essex and Briscoe Streets, and bounded Southerly on Church Street; now in
occupation of Lewis and Johnson; Timothy and Abby Connolly; John B. Wilde; Israel F. Lee; and
Benjamin Raymond; including either or all of these named estates; also to take action upon building
a new School House for the neighborhood now accommodated by the Briscoe School House, and
upon enlarging the Washington School House and otherwise providing requisite school
accommodations.

11. To adopt such measures, grant such sums of money and take such action in regard to Schools
and School Houses throughout the Town as may be deemed expedient

12. To adopt such measures, grant such sums of money and make such regulations in regard to the
repairs and improvements of the Highways and Town ways throughout the Town as may be deemed
expedient
th
13. To grant such sums of money, to be raised and assessed upon the polls and estates in the Town,
for the defraying the debts of the Town, and for the expenses of the current year, as may be deemed
expedient and make all necessary regulations and allowances, respecting the same. Also to authorize
the Town Treasurer, to hire on the credit of the Town, such sums of money from time to time as may
be necessary to meet the liabilities of the Town, and to provide State Aid for the families of
Volunteers.

14. To see if the Town will approve the Jury List as revised by the Selectmen.
Hereof fail not, but make due return of this warrant with your doings thereon before said time.

At a legal meeting of the qualified voters of the Town of Beverly, held (in pursuance of the warrant
recorded on the next preceding pages) at the Town Hall in said Town on Monday the Third day of
March in the year Eighteen hundred and seventy-three, at Nine o’clock A.M. the meeting was called
to order at the time appointed, and the Clerk read the warrant therefore, and it was

Prayer was then offered by Rev. S. Jackson of the Methodist Church.

Then in open Town Meeting, immediately after the election of Town Clerk, James Hill above named
was sworn to the faithful discharge of his duties as Town Clerk of Beverly by and before me.

The Auditors’ Report was excepted. And the Reports of the Selectmen, Overseers of the Poor,
Engineers of the Fire Department, and Trustees of the Public Library were read and accepted.
A motion was offered by Robert R. Endicott, “that all the articles of the warrant from Article 3 to
Article 12, inclusive, be laid on the table until after the consideration of the 13th Article,” for the
purpose of allowing him to offer a motion under the article “that all the appropriations made and all
the indebtedness incurred at this meeting should be assessed on the polls and estates the present
year.” This motion was put to the meeting, and upon a division of the house was lost. 320 voting
in favor, 519 opposed.
Upon Article 3.Stackpole Case.
Voted that the Selectmen be authorized to defend the interest of the Town in the suit of the
Commonwealth against the Town, for the board of Charles L. Stackpole at the Lunatic Asylum at
Taunton, and to employ Hon. Benjamin F. Butler as associate counsel with Hon. F. W. Choate in
managing the case for the Town.
Upon Article 4.Grand Army Petition.
Voted, that the prayer of the petition be granted, and that the sum of one hundred fifty dollars be
appropriated for the expenses of Memorial Day in decorating Soldiers’ Graves to be expended under
the direction of Post No. 89 of the Grand Army of the Republic.
Upon Article 5.Reports of Selectmen laying out certain Streets.
The Report of the Selectmen laying out a new Town way from Cabot Street opposite Thorndike
running into the way known as Milton Street, and by said Milton Street widening the same to Rantoul
Street having been read. - a motion for indefinite postponement, and a motion for taking the question
by yeas and nays having been severally put to the meeting and lost. - it was
Voted, That the Report of the Selectmen laying out said way may be accepted and said way laid out
and established as a Town way forever according to said Report, which is as follows.-
“The Selectmen of the Town of Beverly, upon due notice and hearing, have laid out a Town
way in said Town, as follows viz: Beginning on the Northwesterly side of Cabot Street, at the
Easterly end of the divisional line between the estate of the late Eben Smith, senior, and the estate of
Benjamin Raymond, and run thence northwesterly by said divisional line one hundred sixty-five feet
to an angle; thence westerly in a line parallel with the line which is in continuation of the Westerly
portion of the Northerly line of the way known as Milton Street as now fenced out and plotted and
sixty feet Southerly from there, and continuing in the same direction parallel with said Northerly line
and sixty feet Southerly therefrom at right angles about 1188 feet from said first named angle to
Rantoul Street; laying said Town way sixty feet wide Northeasterly of its first described line and sixty
feet Northerly of its line last described at right angles with each; and extending the said Northeasterly
and Northerly lines to run into each other at the angle on that side of said Town way. And we award
damages as follows, viz.:
To Benjamin Raymond six thousand dollars.
To owners of Weld estate one thousand dollars.
To Augustus N. Clark three hundred and fifty dollars.
To Daniel Waite two hundred dollars
To Hervey Lunt one hundred dollars.
To Andrew D. Creesy one hundred and thirty dollars.
To Hannah L. Rantoul one thousand dollars.
To William Endicott three hundred and fifty dollars.
The shade trees on the Southerly side of said way may remain for five years if the owners so desire,
Benjamin Raymond to have six months to remove his buildings, and all other obstructions to be
removed within three months from date.”

Voted, That the Report of the Selectmen laying out a new Town way from near the culvert on
Neptune Street to the Sea, near the “Light House lot” on Hospital Point, be accepted and said way
laid out and established as Town way forever according to said Report. Which Report is as follows
“The Selectmen of the Town of Beverly, upon due notice and hearing, have laid out a Town way in
said Town as follows. Beginning at Stake No. 1 on the Southerly side of Neptune Street forty feet

distant, in the direction of North 70 East from the Easterly side of the Culvert on the Southerly line
of said Street, and run thence on an arc of a circle of 275 feet radius Southeasterly and Southwesterly

to Stake No. 2, which is distant 195 feet in the direction of South 10 East from Stake No.1: - thence
from Stake No. 2, on an arc of a circle of 303 feet radius Southwesterly and Southeasterly to Stake
o
No. 3, which is distant 400 feet in the direction of South 12 15' East from Stake No. 2: - thence from
Stake No. three, on an arc of a circle of 320 feet radius Southeasterly and Southwesterly to Stake No.

4, which is distant 315 feet in the direction of South 12 15' East from Stake No. 3: - thence from
Stake No.4 on an arc of a circle of 185 feet radius Southwesterly and Southeasterly about 200 feet
to Stake No. 5, by the Westerly side of the United States Light House Lot, and 190 feet
Southwesterly of the Northwesterly corner of said lot; and thence Southwesterly by the Westerly line
of said lot to the Sea: laying said Town way from Neptune Street to Stake No. 5, forty feet wide
Westerly of the lines described: and from Stake No. 5 to the Sea 70 feet wide, Westerly from said
Light House Lot. We allow three months for the removal of trees, fences and other property from
the limits of said Town way, and we award no damages.”

we award damages as follows.
To David L. Foster, two hundred dollars.
Chester Merritt one hundred & eighty dollars.
Thomas Woodberry’s Heirs one hundred and seventy dollars.
Luther Woodbury one hundred and seventy dollars .”
Voted, that the Report of the Selectmen laying out a new Town way from Bow Street, near P. S.
Webb’s stable, continuing the way known as Home Street to Rantoul Street, and including the way
known as Ashland Street from Home to Federal Street be accepted, and said way laid out and
established as Town ways forever, according to said Report, which report is as follows.
“The Selectmen of the Town of Beverly upon due notice and hearing have laid out a Town way as
follows, viz.:- Beginning by the Stable Estate in occupation of Philip S. Webb on the Northerly side
of Bow Street, at a point about twenty feet Easterly of the Southerly end of the former division line
between the lands formally of Abraham W. Wallis and Jeremiah Wallis, and run thence Northerly
parallel with said former division line and twenty feet Easterly thereof, about one hundred and twenty
feet to a point fifty feet Southerly of the Southerly line of the estate of Alpheus Trask Estate, and at
right angles therewith, thence turning at nearly a right angle and run Westerly in a line parallel with
the Southerly line of said Trask Estate and of the other Estates which are in a line with that, and fifty
feet Southerly thereof about 715 feet more or less to Rantoul Street: laying said Town way forty feet
wide westerly of its first described line, and the same with Southerly on its line last described,
including the way known as Home Street, so far as it comes within this description.”
“We have also upon said notice and hearing, laid out as a Town way Ashland Street,
connected with the above, beginning on the Southerly side of Federal Street at a point twenty-seven
and a half feet easterly of the Easterly line of William P. Cleaves’ Estate and run thence Southerly in
a line parallel with said Cleaves Estate line about one hundred and eighty-eight feet to Home Street
as above laid out, laying said way forty feet wide Easterly of the line described. And we award no
damages.”

Voted, to now adjourn, and the Moderator declared the meeting adjourned to 7 o’clock PM.

Upon Article 6.Steam Fire Engine & Apparatus etc..
A motion to defer so much of this article as refer to a Steamer be referred to the Engineers to report
thereon at the adjournment was lost (130 voting in favor 164 opposed)
Voted, to reconsider the vote whereby the meeting refused to refer the subject of a Steamer to the
Engineers.
Voted that so much of this article as relate to a Steam Fire Engine be referred to the Engineers of the
Fire Department to report thereon at the adjournment of this meeting in April.217 in favor 63
opposed.
On motion of Edwin Foster, it was
Voted, “that the Engineers of Beverly, be and are a Committee to procure a piece of land suitable for
a Hook & Ladder Truck house and build the same in the vicinity of the Town Hall as near as
practicable.”
Voted, that the credit of the Town be used for that purpose.
Voted, that the Selectmen be instructed to fit up the present High School House for a Hose Tower,
or build a Tower in some other suitable location.
Voted, That the subject of an Armory be referred to the Selectmen to report of the adjournment of
this meeting in April as to what better accommodations can be provided.
Upon Article 7.Petition of C. R. Moulton & others for Gas Light Post.
Voted, That the prayer of the petition be granted.
Upon Article 8.Petition of S. D. G. Standley for allowance of his bill.
Voted, That the petitioner have leave to withdraw.
Upon Article 9.Bylaws.
Voted, That the whole subject of this article be postponed to the adjournment of this meeting in April.
Upon Article 10.School House & Lot.
Voted, that the town designates as a suitable place for the erection of a School House and necessary
buildings, all the land lying between Essex and Briscoe Streets and bounded southerly by Church
Street, in this town, now in occupation of Lewis & Johnson Timothy and Abby Connolly, John B.
Wilde, Israel F. Lee, and Benjamin Raymond, and if the owners of said the land or either of them,
refuse to sell the same, or demand therefore a price deemed by the Selectmen unreasonable, then said
Selectmen are authorized and directed to proceed to select and lay a School House lot in said locality,
and to appraise the damages to the owners of said land, in the manner provided for laying out Town
ways, and appraising damages sustained thereby, but said lot so taken shall not exceed in the whole
eighty square rods exclusive of the land occupied by the School buildings, under Chapter 38, Section
38 of the General Statutes.
Voted, that the School Committee be instructed [to] build a suitable School House to accommodate
the neighborhood of the Briscoe School, immediately after said land shall have been secured and
purchased.
Voted, that the School Committee be authorized to enlarge the Washington School House at the
corner of Rantoul and Elliott Streets according to the recommendation in the Selectmen’s Report.
Upon Article 11.Schools.
Voted, that the sum of Eighteen Thousand Five Hundred dollars be appropriated for the ordinary
expenses of the Schools and School Houses throughout the Town current year.
Voted, that the High School be located in the same place as last year.
A motion that the School Committee employee a Superintendent of Schools was indefinitely
postponed.
Upon Article 12.Highways.
Voted, that the sum of Seven Thousand Dollars be appropriated for the ordinary repairs of the
Highways and Town ways throughout the Town the current year.
Voted, that the sum of twenty-five cents per hour, for each man, and twenty cents per hour for each
horse and cart and twenty cents per hour for each pair of oxen and cart be allowed and paid for all
labor performed upon the Highways the current year.
Voted, that the Surveyors of the different highway wards be hereby instructed to employ the teams
belonging to the Town, on the Highways as far as practicable when said teams are not otherwise in
use.
Voted, that the Selectmen be instructed to commence upon the construction of the way from Cabot
Street opposite Thorndike Street, to Rantoul Street, within six months after the location.
Voted, that the Selectmen be instructed to commence upon the construction of the way this day laid
out from Hale Street opposite Corning Street to Neptune Street within six months after the location.
Upon Article 13.Money grant.
Voted, that the sum of Twenty Five Hundred dollars be appropriated for expenses of the Health
Department the current year.
Voted, that the sum of Five Thousand Five Hundred dollars be appropriated for the Expenses of the
Fire Department the current year, Two Thousand dollars of which is to be expended for new Hose.
Voted, that the Town Treasurer be authorized to borrow on the credit of the Town upon notes
approved by the Selectmen, such sums of money as may from time to time be found necessary to
meet the liabilities of the Town, and the payment of State Aid to the families of Volunteers.
Voted, that the Town Clerk in addition to the usual duties required of him by law, shall be Clerk of
the Board of Selectmen, of the Overseers of the Poor, of the School Committee, of the Board of
Health, of the Engineers of the Fire Department and shall attend the meetings and keep a record of
the proceedings of Each Board. He shall prepare all notices, warrants and other papers required of
him, and generally perform such other duties as may be prescribed by the Selectmen. The records
of the Several Boards shall be kept in separate books and shall be kept in his custody. All votes,
resolves, and other doings of each Board shall be duly recorded and all reports or other documents
which the Board may so order. The records shall be duly indexed with marginal references. The
doings of each meeting shall be recorded within three days of its session. All papers left or deposited
with the Clerk shall be carefully preserved and regularly filed by him.
Voted, that the Salary of Town Clerk be Five Hundred dollars.
Voted, that the Salary of the Town Treasurer be Three Hundred dollars.
Voted, that the sum of One Hundred Thousand dollars, be raised and assessed upon the polls and
estates within the town for the purpose of defraying the debts of the town, and the expenses of the
current year.
Voted, that the Collector of Taxes receive one percent of all monies collected by him and paid into
the Treasury of the town, which shall be in full compensation for his services.
Voted, that the Collector of Taxes deliver or cause to be delivered at the last and usual place of abode
of each inhabitant of the town, who may be taxed, or to such inhabitant in person, as soon as
practicable after the taxes have been assessed a list of the taxes assessed upon such person,
accompanying which list shall be a notice of the time and place where the Collector will be present
to receive the taxes, and also a notice of the meetings of the Assessors to determine upon abatement.
No discount shall be allowed on any taxes paid, and interest at the rate of one percent a month shall
be charged upon all taxes not paid on or before the first day of December next, which interest shall
be added to and considered a part of said taxes, and that so far as practicable the Collector shall on
the first day of January next, put in suit all taxes then due and unpaid, commencing with the highest
and so on to the lowest tax.
Upon Article 14.Jury List.
Voted, that the consideration of the Jury List be postponed to the adjournment in April.
Voted, that this meeting now adjourn to the first Monday of April next at one o’clock afternoon.
And it was so declared by the Moderator adjourned to that time.

The Engineers of the Fire Department report verbally, that a new Steam Fire Engine, of the same kind
and capacity of the one recently purchased by the City of Salem, can be procured for the sum of
$4200, but make no recommendation in regard thereto.
Voted, That the further consideration of the subject of a new Steam Fire Engine be indefinitely
postponed.
The Selectmen reported verbally in regard to an Armory, but had no special recommendation to
make.
A motion of Jeremiah Murphy, “that the Town purchase the Estate of Timothy and Abigail Connolly,
and that the Selectmen be directed to pay therefore the sum of Forty Five Hundred dollars" was put
to the meeting and lost.
Voted, that the whole matter of the purchase or taking for a School House lot, the Estate of Timothy
and Abigail Connolly be referred to the Selectmen.
Voted, that the vote under Article 8th passed at the March meeting in reference to the petition of S.
D. G. Standley, be reconsidered.
Voted, that the whole subject be referred to a Committee of Five, to report thereon to the Selectmen,
and if they think it a just claim, the Selectmen are instructed to pay it.
Voted, That John Pickett, Andrew E. Story, Israel Trask, William W. Hinkley, and Thomas B. Smith
be that Committee.

The Jury List as revised by the Selectmen was read, and the name of Ezekiel F. Obear (he being
ineligible by reason of being a Constable) was stricken out, and the name of Israel W. Wallis was
substituted, and as amended was accepted (and may be found recorded on the next page)
Voted, that the meeting be dissolved.
