1868-10-10Commonwealth of Massachusetts Essex, ss.To one of the Constables of the town of Beverly.Greeting. You are hereby required in the name of said Commonwealth to notify and warn in the usual manner the qualified voters of said town to meet at the Town Hall on Saturday the tenth day of October instant at two o’clock afternoon for the following purposes viz. 1st. To choose a Moderator. 2d. To decide what action the Town will take, upon the petition of Betsy Wilson and others, and Joseph Wilson and others, for a Jury to reverse the award of damages to them upon the location of the Town way in continuation of Central Street, from Lovett Street, to and across Lothrop Street to high water mark; and also for a Jury to cause an alteration to be made in the laying out of said way. 3d. To see what action the Town will take in reference to providing and securing to its inhabitants the use of the water from Wenham Pond. 4th. To see if the Town will accept and allow of the Town way (as laid out and altered in the report of the Selectmen on file in the office of the Town Clerk) in extension of Abbott Street from Lothrop Street to high water mark. James Hill, Town Clerk At a legal meeting of the qualified voters of the town of Beverly, held (in pursuance of the warrant recorded on the next preceding page) at the Town Hall in said town, on Saturday the Tenth day of October, in the year Eighteen hundred and sixty-eight at two o’clock afternoon. - it was, Voted, to choose a Moderator by hand vote. Voted, that Henry P. Herrick be Moderator. Upon Article 2d. Voted, that the whole subject matter of this Article relating to the petitions of Joseph Wilson and others, and Betsy Wilson and others, for juries to revise the damages and to make alterations upon the extension of the Town way, known as Central Street, be referred to F. W. Choate, Warren Tilton, and Henry P. Moulton, with full authority to represent the Town in the premises; hereby instructing them to resist always, any alteration in the course of said way from the present straight line and to oppose any increase of the award of damages, but authorizing them to settle any just claim for damages, if any there be, of any parties who have been awarded no damages. Upon Article 3d. Voted, that the Selectmen are hereby authorized and instructed to enforce the rights of the Town, to be supplied with water from Salem Water Works, and that for that purpose they make such application to the Supreme Court, or to the Legislature of this Commonwealth, or take such other action in the premises as in their judgment they may deem best and that they employ counsel if they think it necessary. th Upon Article 4. Voted, that the whole subject of this article be recommitted to the Selectmen. The different Articles in the warrant having been acted upon, it was announced to the meeting that William E. Lovett of California) a native of this Town, had presented to the Town, an Elegant Engraving, representing the signatures of the Legislature of California upon the adoption of the amendment of the Constitution of the United States: abolishing slavery forever. Voted, that Saml. Porter, Warren Tilton & Charles Davis be a committee to accept in behalf of the Town the Engraving presented by Hon. William E. Lovett of California, and that they be authorized to make arrangement for a meeting of the citizens for a public reception of the same from the donor. Voted this meeting be now dissolved.
