Essex, ss. To one of the Constables of the town of Beverly, Greeting.
You are hereby required in the name of said Commonwealth to notify and warn in the usual
manner the qualified voters of said Town to meet at the Town Hall on Tuesday the thirtieth day of
June, instant at One o'clock, afternoon for the following purposes.
First. To choose a Moderator.
Second. To see if the Town will vote that no license shall be granted in this Town which shall
authorize the sale to be drunk on the premises, of either distilled or fermented liquors, or both.
Third. To see if the Town will consent to the laying out of a highway or Town way upon or through
the Old burial ground, so-called, which is bounded Northerly on Hale Street, Southerly on lands of
A. D. Kilham, and of the Town, and otherwise on land of the Bancroft heirs and others.
Fourth. To see if the Town will accept and allow of the Town way in extension of Central Street
easterly from Lover Street, over lands of Kilham, Lefavour and Wilson, crossing Lothrop Street and
continuing to high water mark, according to the Report of the Selectmen on file in the office of the
Town Clerk.
Fifth. To see if the Town will accept and allow of the Town way in extension of Dane Street,
Southerly from Hale Street, over land of the Bancroft Estate, and of the Harris Estate to high water
mark.
Also, a Town way in extension of Dane Street northwesterly from Cabot Street, over lands
of Batchelder, Lee, Pickett, Foster, Rich and Chase, crossing Runtoul Street and over lands of Gage
and others, to high water mark, according to the Reports of the Selectmen on file, in the office of the
Town Clerk
Sixth. To see if the Town will accept and allow of the Town way extending from High Street near
lands of Joseph E. Ober, over his land, and lands of Haven, Obear, Lefavour, Larcom and others, to
Hale Street, at land of David Larcom. Also to see if the Town will discontinue any portion of the
northerly end of High Street, upon a substitute being provided.
Seventh. To see if the Town will accept and allow of the Town way, the open way known as Park
Street, extending from the stable estate occupied by J. S. Eveleth, Northerly to near the dwelling
house of John F. Burnham.
Also, as Town ways the several open ways, extending from said Park Street easterly to
Rantoul Street, according to the Reports of the Selectmen on file in the office of the Town Clerk.
Eighth. To see what action the Town will take in relation to the recent law directing the laying out
of Essex Bridge between Beverly and Salem as a highway.
Hereof fail not but make due return of this warrant with your doings thereon before said time.

Beverly June 30, 1868. Pursuant to the foregoing warrant I have notified the persons therein
directed.

At a legal meeting of the qualified voters of the Town of Beverly held, (in pursuance of the warrant
recorded on the two next preceding pages) at the Town Hall on Tuesday the thirtieth day of June in
thc year Eighteen hundred and sixty-eight.
Voted That a Moderator be chosen by hand vote, and William W. Hinkley was thus chosen
Moderator, (several other gentlemen having been previously chosen & declined)
Voted, unanimously, that no licenses shall be granted in this Town which shall authorize the sale,
to be drank on the premises of either distilled or fermented liquors, or both.
Voted, that the Selectmen be instructed to prosecute all violations of the laws in regard to the sale
of intoxicating liquors.
Upon the 3d article of the warrant.
Voted, that the whole subject of this article be indefinitely postponed.

Upon 4th article of the warrant, in relation to the Extension of Central Street (after
Selectmen's Report had been read)
Voted, that the Report of the Selectmen laying out said way be accepted, and that said way be
established as a Town way forever, according to said report.
The following is the Report of the Selectmen laying out said Central Street extension.
"Upon the petition of Shadrack Fisk and others for a Town way from Lovett
Street in extension of Central Street, to high water mark, having notified all parties interested, and
viewed the premises and heard all parties who desired to be heard, the undersigned Selectmen of
Beverly upon the completion of said view and hearing did proceed to lay out said Town way in
manner and form following: Commencing at a stake in the Southeasterly side of Lovett Street, which
is in continuation ora straight line extending from the comer of the Burley Estate on Cabot Street,
to the corner of the Briant Estate of Lovett Street a course of South 40° 15' east, thence running from
said stake on the same course over lands of the Kilham heirs, Lefavour, Wilson heirs and Lefavour
to Lothrop Street, thence in the same direction crossing Lothrop Street and over land of the Wilson
heirs to high water mark, laying a way forty feet wide southwesterly of the line described and so that
the southwesterly line of said way shall not extend any further than to the finish on the north east side
of the post at the N. E. end of the iwn fence which extends in front ball of the dwelling house of the
said Wilson heirs, nor to any point within two and one half feet of said dwelling house,
And we have awarded damages to the following parties as follows-
To the Kilham heirs, three hundred and forty dollars ($340)
To Israel Lefavour, three hundred and fifty dollars $350
To the widow and heirs of John Wilson seven hundred & sixty dollars $760.
The owners of the land to have until the first day of November next to take of their trees, fences and
buildings from said way."

Upon Article 5. Extensions of Dane Street.
After a reading of the Report of the Selectmen, a motion to indefinitely postpone the whole subject
of the article, was lost. 68 voting in favor & 80 opposed to such motion, and it was
Voted, that the Report of Selectmen laying out said ways be accepted and said ways established as
Town ways forever which Report is as follows.
Upon petition of Isaac Appleton and others for a Town way in extension of
Dane Street from Hale Street Southerly to high water mark, and for a Town way in extension of said
Street northwesterly from Cabot Street to high water mark. Notice having been given to all parties
interested, the undersigned Selectmen of Beverly met and viewed the premises and heard allparties
who appeared, and upon the completion of said view and hearing did proceed to lay out said Town
ways in manner and form following - First commencing at a stake on the Southerly side of Hale
Street which is in continuation of a straight line extending from the comer of Butman and Dane
Street, at the Cemetery, to the corner of Dane & Hale Street by the Harris Estate as the fence now
stands South 45° East and distant sixty-eight feet from last named comer, thence running from said
stake on the course of South 27° East on a straight line over land of Bancroft seven hundred and
eighty feet to Lothrop Street; and in the same direction crossing Lothrop Street, fifty-three feet; and
continuing thence in the same direction over said Bancroft's land and the land of said Harris Estate;
thence in the same direction over said Harris Estate land to high water mark, laying said way fifty
feet wide southwesterly of the line described.
And on this part we have awarded damages to the owners of the Bancroft
Estate $300, allowing till the first day of August next for the removal offences and crops.
Second. Commencing at a stake 3 53/100 feet Southwesterly from a point in the Westerly side of
Cabot Street which is in continuation of a line with the S. W. side of a dwelling house of Israel F.
Lee, thence from said stake running N. 77° west over land of said Lee 123 7/10 feet to the boundary
line between lands in the occupation of Joseph Foster and of Thomas Pickett, thence in the same
course over land in said Pickett's occupation 372 feet to a stake 8 feet northeasterly from said
Foster's land by land of Samuel Chase, thence in the same course over land of said Chase 490 feet
to Rantoul Street, at a stake 87 feet northeasterly from a point on Rantoul Street which is in
continuation of the line of the northeasterly side of William T. Trask's dwelling house, thence
continuing from said stake in the same direction across Rantoul Street and over lands of Osmond
Gage and children to high water mark, laying said way from Cabot Street N. westerly for its whole
extent forty feet wide southwesterly of the lines described. And awarded damages as follows,
To Israel F. Lee $450 four hundred and fifty dollars
Jonathan Batehelder 50 fifty dollars
Thomas Pickett and
other owners of land in 50 fifty dollars
his occupation
Samuel Chase 150 one hundred fifty dollars
Osmond Gage & children 150 one hundred and fifty dollars
Joseph Foster & children 100 one hundred dollars
and we allow the owners of the land between Cabot and Rantoul Streets until Thursday of August
next to take off their fences, trees and crops, and to the owners of the land laying northwesterly of
Rantoul Street until the first day of July in the year eighteen hundred and sixty-nine to remove the
clay in said land."

Upon Article 6. Petition of J. Perry & others for way at Farms.
After a Reading of the Report of Selectmen
Voted, that said Report be accepted, and said way established as a Town way forever, as laid out in
said report, which is as follows.
"Upon petition of James Perry and others, to lay out a Town way commencing
at High Street by land of Joseph E. Ober, to some point on Hale Street, having notified ail parties
interested and viewed the premises and heard all parties who desire to he heard, the undersigned
Selectmen of Beverly upon the completion of said view and hearing did proceed to lay out said Town
way in manner and form following. Commencing at a stake on the southwesterly side of High Street
by land of William Batchelder and Joseph E. Ober, thence over land of said Ober on a course North
23° west 179 feet to a stake thence turning and running South 54° west over land of said Ober 485
feet to land of F. Haven, thence on the same course over land of said Haven, heirs of Asa Ober,
Josiah Obear and wife 517 feet to a stake, thence on a comer South 43° west over land of Josiab
Obear and wife, David Larcom and Francis Larcom, 830 feet to a stake 39 feet N. westerly from land
of Isaac Prince and wife, thence on a course South 20° 20' west over land of David Larcom 457 feet
to a stake on Hale Street northerly side, 160 feet easterly from land of Jolm Brady, laying said way
on the first line described forty feet wide N. easterly of said line, and laying the residue of said way
fifty feet wide northwesterly of the lines described, and we award damages as follows
To Joseph E. Ober one hundred dollars
Franklin Haven one hundred dollars
Heirs of Asa Ober Jr. twenty dollars
Josiah Obear and wife sixty dollars
Francis Larcom one hundred and fifty dollars
David Larcom two hundred dollars
The owners of said land to have until the first day of September next to remove trees,
fences and crops."

Selectmen of the

Voted, that that portion of High Street, extending from Hart Street to the first angle, be discontinued
upon a substitute being provided to the satisfaction of the Selectmen.
Upon Article 7. Park Street and streets leading thereto.
The Report of the Selectmen having been read.
Voted, that said Report be accepted, and the ways therein described established as Town ways
forever, according to said Report which is as follows.
"Upon a petition of Jolm Lefavour and others for laying out as Town ways,
the way known as Park Street and the several open ways connecting it with Rantoul Street. Notice
having been given to all parties interested the undersigned Selectmen of Beverly met and viewed the
premises and heard all parties that appeared and upon the completion of said view and hearing did
proceed to lay out said ways as Town ways in manner and form following. Commencing with said
Park Street by the North Easterly side of the Stable Estate, occupied by J. S. Eveleth one hundred
and eighty feet at right angles from Rantoul Street, and run thence North Easterly parallel with
Rantoul Street and one hundred and eighty feet northwesterly thereof to a point in a line with the
Southerly side of Federal Street, laying said way 45 feet wide northwesterly of the line described.
Also, laying out as a Town way the open way opposite Pleasant Street between Rantoul and Park
Streets as now fenced out 180 feet in length and 40 feet in width. Also the way opposite Railroad
Avenue extending from Rantoul to Park Street as now fenced out 180 feet in length and 90 feet in
width, at right angles with Rantoul Street. Also the open way opposite the way known as Milton
Street extending from Rantoul to Park Street at right angles 180 feet in length and fifty feet in width.
Also the open way opposite the way known as Wallis Street as fenced out extending from Rantoul
to Park Street at fight angles, 180 feet in length and 40 feet in width. Also, the open way opposite
Federal Street extending from Rantoul Street to Park Street in a line with Federal Street 40 feet wide
and 225 feet in length.
And we awarded damages to no one, judging no one to be damaged thereby.

Upon Article 8. Essex Bridge.
Voted, that the whole subject of this article be referred to the Selectmen with full power to act as
they may judge for the best interest of the town.
A motion was then made that the vote passed at a previous stage of this meeting whereby the whole
subject of Article 3 was indefinitely postponed, be rescinded.
A motion to dissolve the meeting was lost. 64 in favor 76 opposed.
A motion to lay the motion for rescinding on the table, was lost 64 voting in favor 76 opposed, it was
Voted, that the town will consent to the laying out of a highway or Town way upon or through the
Old Burial Ground so-called, according to Article 3 of the warrant for this Meeting.
Voted, that the meeting be dissolved, and it was so declared by the Moderator.
