Essex, ss:To one of the Constables of the town of Beverly. Greeting.
You are hereby required in the name of said Commonwealth to notify and warn in the usual manner
the qualified voters of said town to meet at the Town Hall on Monday the twenty third day of
October current at Seven o’clock P.M. to act on the following articles, viz.:-
1st. To decide the manner of choosing a Moderator, and to choose the same.
2d. To act on the several reports of the Selectmen, now on file in the office of the Town Clerk, laying
out the following named town ways viz.:- I. the way known as Myrtle Street, extending from Rantoul
Street near C. H. Kent’s Wheelrights shop, to Cabot Street, near the Old “Goodridge House”; - II.
A way extending from Ober Street near Hospital Point, into the way, heretofor known as Thorndike
Avenue, and by said Avenue to Hale Street; - III. A way extending from Hale Street opposite
Corning Street to the United States Light House Lot at Hospital Point.
3d. To see if the Town will take possession and control of the burial grounds, heretofor of the
Second Parish in Beverly, now the Second Congregational Society in Beverly and take or purchase
other lands adjoining for the purpose of enlarging the burial grounds, in that part of the Town, and
establishing the same upon the same system of the burial grounds and cemeteries of the Town
according to the petition of the people of said Parish or Society.
4th. To act on the following petitions viz.: - Henry Wilson and others and Moses F. Foster and
others for new Hose Carriage and House at North Beverly; Larkin West and others for new Hose
Carriage and House near Chapman’s Corner; George M. Hildreth and others for new Hose Carriage
House at corner of Rantoul and School Street; Nathan Hull and others for new truck and fixtures for
a first-class Hook and Ladder Apparatus; John H. Woodberry for new Hose Carriage at Beverly
Farms.
5th. To see if the Town will cause a new School House to be built at Beverly Farms, and authorize
the sale of the present School Houses there and the land under and adjoining each.
6th. See if the Town will establish bylaws in regard to fast driving in the streets, and also, bylaws in
regard to other matters relating to the protection of the public.
Hereof fail not, but make due return of this warrant with your doings thereon before said time.

At a legal meeting of the qualified voters of the town of Beverly held (in pursuance of the warrant
recorded on the two next proceeding pages) at the Town Hall in said town, on Monday the twenty-
third day of October in the year Eighteen hundred and seventy-one at seven o’clock, afternoon, it was
Voted, That a Moderator be chosen by hand vote.
Voted, That Freeborn W. Cressy be Moderator.
Upon Article 2d.In relation to laying out certain town ways.
The Report of the Selectmen laying out the way known as Myrtle Street was accepted, and it was
Voted, That said way be laid out, and established as a Town way forever according to said Report
which is as follows.
“Upon the petition of Warren Woodbury and others, the Selectmen of the town
of Beverly having notified, met and heard the parties interested, did proceed to laid out a Town way
in said town as follows; Commencing on the Easterly side of Rantoul Street, about sixty-eight feet
Northeasterly from the Northerly corner of the estate of Seth Friend Jr. at the Southerly corner of the
way known as Myrtle Street and run thence Easterly as the Southerly line of said Myrtle Street runs
about 625 ½ feet to Cabot Street’s new line at that point, the same being sixty feet at eight angle from
the former Northerly corner of Joseph H. Herricks Estate, laying said town way forty feet wide
Northerly of said described line, including said Myrtle Street way, together with lands, taken from
Thomas B. Smith, and other owners of the old “Goodridge Estate” and we award as damages four
hundred dollars to Thomas B. Smith, and to the other owners of said Goodridge Estate, one hundred
dollars; and we award no other damages.

The following Report of the Selectmen was presented in red.
“Upon the petition of Philip Hammond and others, the Selectmen of the town of Beverly, having
notified, met and heard the parties interested, did proceed to laid out a Town way in said town as
follows viz.: Commencing at a stake on the Northerly side of Ober Street forty-five feet Easterly of
Mrs. Rogers’ estate and run then in a direct line East northerly about Fourteen hundred feet to the
northwesterly corner of the Estate of Michael W. Shepherd, by the Avenue sometimes called
“Thorndike Avenue”; thence in about the same direction by the Northerly line of said Shepherd estate,
about two hundred and twelve feet to a corner of said Avenue by land of W. D. Pickman; and thence
northerly as the easterly line of said Avenue runs, as fenced out by land of said Pickman and others
to Hale Street; laying said way forty feet wide, northerly of the two first described lines, and Westerly
of the last line named so far as the Williams and Lovett land, so-called extends, and otherwise as said
Avenue is now laid out and used.
And we award damages to no person, as the owners agree hereto.”

Where upon it was
Voted, that said way be laid out, and established as a Town way forever, according to the foregoing
Report.
The following Report of the Selectmen was presented and read.
Upon the petition of William W. Hinkley and others the Selectmen of the town
of Beverly, having notified, met and heard the parties interested did proceed to laid out a Town way
in said town as follows: viz.; Commencing in the Southerly side of Hale Street directly opposite the
Westerly line of Corning Street, and run thence in a direct line South easterly about Fifteen hundred
and sixty-three to a stake by the Easterly line of a Town way laid out by us on petition of Philip
Hammond and others, laying the said town way for this extent fifty feet wide Northeasterly of the line
described; running thence from said last named course with a more southern inclination by the courses
and curves as now staked out and plotted forty feet wide to the “United States Light House Lot.”
And we award damages as follows.
To David L. Foster, two hundred dollars.
To O. H. Merritt one hundred & Format That Spelled out
To Thomas Woodberry’s Heirs, one hundred & thirty five dollars
To Luther Woodberry two hundred dollars.
And to no other person.

A motion that said Report be accepted and the way laid out and established according to the
foregoing Report, was put to the Meeting and decided in the Negative.
Upon Article 3.In relation to Burial Grounds at North Beverly.
On motion of Hon. John I. Baker
Voted, That upon a release to this town by the Second Congregational Society of Beverly, (the
successors to the Second Parish in Beverly, formerly of the Salem and Beverly Precinct, ) of the burial
grounds heretofore belonging to, and in the control of said Parish or Society, the Selectmen are
hereby authorized to take possession of the same in behalf of the town, and that the same authority
be given to the Selectmen for the time being, in regard to the enlargement and extension of said burial
grounds, as is given to said Selectmen in regard to any of the burial grounds of the town, by vote of
the town of April 2d 1844. And the Board of Health for the time being are authorized to layout said
lands into family burial lots, and give deeds of the same, expanding the receipts upon the
improvements of the grounds, as they now are authorized by the aforesaid vote to do in regard to the
other burial grounds in town.
Upon Article 4.New Hose Carriages and Houses.
On the petitions of Henry Wilson and others and Moses F. Foster and others for a new Hose Carriage
and a House for the same to be located at North Beverly.
Voted, That the prayer of the petitioners be granted.
On petition of Larkin West and others for a New Hose Carriage and House for the same to be located
near Chapman’s corner.
Voted, That the prayer of the petitioners be granted.
On the petition of George M. Hildreth and others for a new Hose Carriage House to be located at
the corner of Rantoul and School Streets.
Voted, That the prayer of the petitioners be granted.
On petition of Nathan Hull and others that the town would procure a first-class Hook & Ladder
Truck.
Voted, That the prayer of the petitioners be granted.
On petition of John H. Woodberry and others for a new Hose Carriage, to be located at Beverly
Farms.
Voted, That the prayer of the petitioners be granted.
Voted, That the Selectmen and the Engineers of the Fire Department as a Joint Committee, are
hereby authorized and instructed to carry into effect all the foregoing votes passed under the 4th
article of the warrant.
Upon Article 6th.In relation to bylaws.
Voted, That the Selectmen be a committee to draft some suitable bylaws, and report the same at the
next annual meeting.
Upon Article 5th.In relation to School house at the Farms.
On motion of Joseph E. Ober Esq..
Voted, That the Selectmen and School Committee be authorized and instructed to locate and build
a new School House at Beverly Farms, where in their judgment it will best promote the interest of
the Schools in that locality, and to cause the old School House there to be sold at public auction, with
the land under and adjoining, the Town Treasurer to give deeds thereof in behalf of the town.”

Voted, That the Selectmen be authorized to use the credit of the town to such an extent as may be
necessary to carry into effect any and all the votes passed this meeting.
Voted, to dissolve this meeting.
