1871-04-17Commonwealth of Massachusetts Essex, ss:To one of the Constables of the town of Beverly.Greeting. You are hereby required in the name of said Commonwealth, to notify and warn in the usual manner, the qualified voters of said town, to meet at the Town Hall on Monday the seventeenth day of April instant at eight o’clock afternoon for the following purposes. Viz. 1st. To choose a Moderator. 2d. To see if the town will reconsider their action, refusing to accept the Report of the Selectmen d (January 2 1871) laying out a town way substantially in extension of Lothrop from Hale Street, crossing Corning Street, to Cross Street or Cross Lane, opposite the “The Rock”, so-called; and then to see if the town will accept said Report, and layout and establish said town way; according to petition of Ezekiel F. Obear and others. 3d. To take action on the petition of the Bancroft heirs, for a Jury to revise their award for damages on Ocean Street. Hereof fail not, but make due return of this warrant, with your doings thereon before said time. Given under our hands and sealed this tenth day of April in the year Eighteen hundred and Seventy One. At a meeting of the qualified voters of the town of Beverly, held (in pursuance of the warrant recorded on the next preceding page) at the Town Hall in said town, on Monday the seventeenth day of April in the year Eighteen hundred and seventy-one at Eight o’clock afternoon. Voted, that a Moderator be chosen by hand vote. Voted, that Freeborn W. Cressy be Moderator. Upon Article 2d. d Voted, that the vote of the town passed January 2 A.D. 1871 whereby the town refused to accept the Report of the Selectmen laying out a town way in extension of Lothrop Street and establish said way as a town way be now reconsidered. 207 in favor of reconsideration 165 opposed. Voted, that the Report of the Selectmen laying out a town way in extension of Lothrop Street be accepted, and said way established as a town way forever according to said report, which is filed in d the office of the Town Clerk on the 23 day of December A.D. 1870, and is as follows. “Upon the petition of John K. Fielder and others, the Selectmen of the town of Beverly, having notified, met, and heard the parties dated proceed to layout a town way in said town as follows; viz. Commencing at the Southerly quarter of the Cemetery on the Northerly side of Hale Street, opposite Lothrop Street, and extending thence by the Southerly line of the Cemetery as the wall runs in a continuous straight line in a northeasterly direction about thirty six hundred feet to a point on the Southwesterly side of Cross Lane or Cross Street opposite the Great Rock, so-called laying said town way for its whole extent fifty feet wide. Southeasterly of the line described: reference being had to the survey and plan made by W. A. Williams Esq.. And we award damages as follows, the town to fence the way. Calvin Foster, eighty dollars, Richard Clark forty dollars, Andrew Woodberry, forty dollars, Issacher Foster no damage awarded, Isaac great one hundred dollars, William D. Voted, that the whole subject of this article be referred to the Selectmen, with instructions to represent the town, and to take such measures to protect the rights and interest of the town in the matter as they may judge expedient.
