1871-01-02Commonwealth of Massachusetts Essex, ss:To one of the Constables of the town of Beverly.Greeting. You are hereby required in the name of said Commonwealth to notify and warn the qualified voters of said town, in the usual manner, to meet at the Town Hall on Monday the second day of January next, at seven o’clock afternoon for the following purposes. Viz.: 1st. To choose a Moderator. 2d. To see if the town will approve and allow of a town way in extension of Lovett Street, from Abbott Street, crossing Ocean Street and Dane Street to Hale Street, near “Galley’s Bridge”, so- called, according to report of the Selectmen on file with Town Clerk. 3d. To see if the town will accept and allow of a town way, substantially in extension of Lothrop Street; from Hale Street, crossing Corning Street to Cross Street or Cross Lane, opposite to “Big Rock”, so-called according to report of the Selectmen on file with the Town Clerk. 4th. To see if the town will approve and allow of the town way in alteration, widening and new location of Balch Street, according to Report of Selectmen on file with the Town Clerk. 5th. To see if the town will sell all its right, title, interest and estate in and to a lot of land described in the deed of Hazadiah Smith and others to the town Recorded Book 167, Leaf 266, and known as the “Hospital Lot.” Hereof fail not, but make due return of this warrant, with your doings thereon before said time. At a meeting of the qualified voters of the town of Beverly, held in pursuance of the warrant recorded on the next preceding page, at the Town Hall in said town on Monday the Second day of January in the year Eighteen hundred and seventy-one at Seven O’clock afternoon. Voted, by hand vote, That Freeborn W. Cressy be Moderator. Upon Article 2d.Extension of Lovett Street. Voted, That the Report of the Selectmen be accepted, and said way established as a town way forever according to said Report. (193 in favor 174 opposed) which Report is as follows. “Upon the petition of I. Lefavour and others, the Selectmen of Beverly, having notified, met and heard the parties, did proceed to lay out a town way in said town as follows, viz.: Commencing at a point on the Northeasterly side of Abbott Street, directly in a line with the Northwesterly line of Lovett Street, and run thence Northeasterly in a direct line to the southeasterly corner of the estate of John W. Abbott, and thence in the same direction to Hale Street, the whole distance being about Seventeen hundred feet; laying the said town way for its whole extent fifty feet wide, southeasterly of the line described, reference being had to the survey and plan made by W. A. Williams Esq..- The slopes of cuts and fills to be upon the abutters. And we have awarded damages as follows. - the town to fence the way. William Endicott and children five hundred dollars To Betsy Wilson and children Nancy L. Lefavour Mary E. D. Allenno damages are awarded Charlotte L. Morgan John I. Baker Bancroft Heirs Seth Norwood Selectmen Freeborn W. Cressy of N. H. Webb Beverly rd Beverly Dec. 23, 1870. Upon Article 3.Extension of Lothrop Street. The Report of the Selectmen laying out said way was read an emotion “that said report be accepted, and the way laid out and established as a town way in accordance therewith” was put to the meeting and lost.(85 voting in favor, 95 opposed.) th Upon Article 4.Widening and new location of Balch Street. Voted, That the Report of the Selectmen be accepted, and said way laid out and established as a town way forever, according to said report. Which Report is as follows, “Upon the petition of John Bell and others, the Selectmen of the town of Beverly, having notified, met, and heard the parties did proceed to lay out, alter and widened the town way in said town known as Balch Street, as follows, viz.; Commencing at the Easterly end of the partition wall between the lands of the Davis estate and of John Bell, by the gate at the entrance of the old “Ryal Side Road”, so called, upon the Westerly side of said Balch Street, and run thence in a direct line easterly above 2650 feet to a point in the present Balch Street, twenty-five feet Northerly of the northerly corner of the barn of the Estate of the late deceased Azor Dodge; and thence in the same direction about 150 feet to Cabot Street; laying the same town way twenty-five wide on each side of said line, and retaining in said town way so much of the old way, as lays between the newly described way and the lands of John W. Bell and John D. Standley, reference being had to a survey and plan of W. J. Berry. The slopes and cuts to be upon the abutters. And the fences and other obstructions to be removed by the town, and the way to be fenced by the town. And we award for damages The John B. Hill and sister, two hundred dollars The John D. Standley forty dollars To owners of the Dodge Estate of abovesaid, twenty dollars To John Bell and owners of the Davis Estate we award no damages. John I. Baker Selectmen Freeborn W. Cressy of N. H. Webb Beverly Beverly, Dec. 23, 1870. th Upon Article 5.The “Hospital Lot.” Voted, That the Town Treasurer be authorized to convey to the United States Government all the right, title and interest of the town, in and to the lot of land conveyed to the town by deed of Hazadiah Smith and others, recorded in Essex Registry of Deeds Book 167, Leaf 266 on condition that said lot shall revert to the town, whenever the Government shall cease to occupy the same for a light house. And that he sell and convey the same at such price as he shall deem expedient. Voted, That this meeting be dissolved. A true record. Attest.James Hill. Town Clerk.
