1870-09-06Commonwealth of Massachusetts Essex, ss:To one of the Constables of the town of Beverly.-Greeting. You are hereby required in the name of said Commonwealth to notify and warn the qualified voters of said Town, (in the usual manner) to meet at the Town Hall on Tuesday the Sixth day of September next at Seven O’clock afternoon for the following purposes, viz.:- 1st. To decide the manner of choosing a Moderator, and to choose the same. 2d. To give opportunity to the inhabitants of the town to vote that no person shall be allowed to sell ale, porter, strong beer or lager beer in this town. 3d. To see if the town will vote to sell any or all of the following named parcels of real estate, viz.:- a lot of land conveyed to the town, by the deed of Hazadiah Smith and others, recorded in the Registry of Deeds Book 167, Leaf 266 and known as the “Hospital Lot”; the former South School House with the land under and adjoining, comprising the land conveyed to the former South School District by the deed of Abraham Edwards, recorded in said Registry Book 398, Leaf 84; a lot of land adjoining the above as conveyed to the town, by the deed of Abraham Edwards recorded in said Registry Book 746, Leaf 841; the lot of land adjoining the Pound and lands of the Philip F. Nichols and wife and others. 4th. To see if the town will direct the extension of the water pipes and distribution of water to those portions of the town popularly known hereto for as North Beverly, Ryal Side, and Montserrat, and authorize the use of the credit of the town. 5th. To see if the town will authorize the purchase of land and buildings for hose carriages. 6th. To see if the town will authorize the Treasurer, to borrow of the Commonwealth, on the credit of the town a sum not exceeding fifty thousand dollars to meet any expenses, incurred or to be incurred in supplying the inhabitants of this town with water. Pursuant to the foregoing warrant, I have notified the persons therein named as therein directed, by posting notices according to the amended Town Regulations at or near the First Parish, Second Parish, and Beverly Farms meeting houses, the Town Hall, Post offices, and the several Railroad Stations in town also at the corners of Hale and Ober Street; Hale and Foster Street; Essex and Standley Street; and it each junction of Rantoul and Cabot streets; and at Dodge’s Mill. At a meeting of the qualified voters of town of Beverly; held (in pursuance of the warrant recorded on the two next preceding pages) at the Town Hall in said Town on Tuesday, the Sixth day of September in the year 1870 at Seven o’clock afternoon.-it was- Voted, that a Moderator be chosen by hand vote, and Freeborn W. Cressy was thus chosen Moderator. Upon Article second of the warrant. A motion offered by Daniel Foster, that the whole subject of this article be indefinitely postponed, was put to the meeting and lost. And it was then Upon motion of Stevens Baker Esq.. Voted, that no person shall be allowed to sell ale, porter, strong beer or lager beer in this town. Also upon motion of Stevens Baker Esq.. Voted, that the Selectmen be instructed to prosecute all known violations of the Liquor Law. Upon Article Second, relating to the sale of certain lands. Hon. John I. Baker offered a motion, “that the Town Treasurer be hereby authorized and directed to cause to be sold at public auction, all the right, title, interest and estate, of the inhabitants of the town of Beverly, in and to all that certain lot of land described in the deed of Hezekiah Smith and others, recorded in the Registry of Deeds Book 167, Leaf 266, and known as the Hospital Lot; and that he give a quitclaim deed thereof in the name of said inhabitants, and purchase with the proceeds for the town, so much of the land and gravel bank lying between Lothrop Street and the Sea as he can obtain therefore” which motion after division of the question and a considerable discussion was put to the vote, and was rejected. John Pickett Esq. then offered a motion, which with an amendment offered by William F. Davis was as follows, “That the Town Treasurer be authorized to sell to the United States for Lighthouse purposes, all the right and title of the town in the Hospital Lot,” and that the Light House shall be built in consideration of the said sale.” Pending the discussion of Mr. Pickett’s motion.-it was voted, that the whole subject of the article, relating to the sale of the Hospital Lot be indefinitely postponed. Upon motions of Hon. John I. Baker. Voted, “That the Town Treasurer be hereby authorized and directed to cause to be sold at public auction the former South School House with land under and adjoining, comprising the land conveyed to the former South School District by the deed of Abraham Edwards, recorded in the Registry of Deeds Book 398, Leaf 84, and, also, a lot of land adjoining the above as conveyed by Abraham Edwards by deed recorded in said Registry Book 746, Leaf 81; selling said house with a suitable a lot of land with it; and dividing the residue into appropriate lots for house lots, reserving always a reasonable lot for Engine and Hose house; and that he give quitclaim deeds thereof in the name of said inhabitants; and that the proceeds be appropriated to the sinking fund for the payment of the town debt.” Voted, That the Town Treasurer be hereby authorized and directed to cause to be sold at public auction, a lot of land on which the Pound is situated adjoining lands of Philip F. Nichols and wife, and others, and that he give a quitclaim deed thereof in the name of said inhabitants. Voted, That the Town approve and adopt the Act of the Legislature of 1869, Chapter 366 concerning the impounding of cattle. That the Selectmen be hereby authorized to extend the water pipes and the distribution of water to those portions of the town popularly known as North Beverly, Ryal Side, and Montserrat, and that they be authorized to use the credit of the Town therefore. th Upon Article 5Land & Building for Hose Carriages. Voted, That the Selectmen and Engineers of the Fire Department are hereby authorized and directed to purchase suitable lots of land and to provide convenient buildings for the accommodation of Hose Carriages. Upon Article 6.Hiring Money. Voted, That the Town Treasurer be authorized to borrow of the Commonwealth, upon notes approved by the Selectmen a sum not exceeding fifty thousand dollars, payable in such rates of interest and at such terms of time within thirty years, as may be agreed upon with the Treasurer and Receiver General of the Commonwealth. Voted, That the Town Treasurer be authorized to borrow of any persons or parties on the credit of the Town, upon notes approved by the Selectmen, such sums of money, as may be necessary to carry into effect any or all the votes of the town passed this day.
