1869-04-05Commonwealth of Massachusetts Essex, ss:To one of the Constables of the town of Beverly- Greeting. You are hereby required in the name of said Commonwealth to notify and warn in the usual manner the qualified voters of said town, to meet at the Town Hall on Monday the fifth day of April next at ten o’clock before noon for the following purposes viz;- 1st. To choose a Moderator. 2d. To see if the town will accept and allow of a town way extending westerly from Chapman Street, over lands of the Whitney Estate, the Kittredge Estate, and others, to the way which leads in from Federal Street, between the Raymond Estate and the Dennis Estate and thence Southerly as said last named way runs to Federal Street according to Report of Selectmen on file with Town Clerk. 3d. To see if the town will accept and allow of the town way extending Westerly from Cabot Street by the Estate in occupation of J. S. Eveleth and as the way known as Roundy Street runs, and thence over land of Samuel Chase to Rantoul Street, and crossing Rantoul Street and Extending over lands of the B O. Peirce to high water mark, according to Report of Selectmen on file with Town Clerk 4th. To see what further action the town will take in regard to supplying our inhabitants with water from the Salem Water Works, and to take any and all measures necessary fully to secure that purpose, either by further legislation, by authorizing negotiations, loans, or any other acts to accomplish that end. 5th. To see if the Town will cause Cabot Street to be Macadamized or otherwise put in good traveling order, and to see if they will purchase a Stone crushing machine for that and similar purposes according to petitioners thereof. 6th. To see what action the town will take upon the petition of Jonathan Batchelder for a Jury to re- assess his damages etc. upon the town way laid out in extension of Dane Street. Hereof fail not but make due return of this warrant with your doings thereon before said time. Pursuant to the foregoing warrant I have notified the persons therein named by posting notices as required by the amended Town Regulations at the various places designated therein. William D. Moses, Constable At a legal meeting of the qualified voters of the town of Beverly, held (in pursuance of the warrant recorded on the two next preceding pages) at the Town Hall on Monday the fifth day of April, in the year Eighteen hundred and sixty nine at ten o’clock before - it was Voted, that the Moderator be chosen by hand vote, and Freeborn W. Cressy was thus chosen Moderator. Upon Article 2d. The way from Chapman Street to Federal Street. Voted, that the Report of the Selectmen laying out said way be accepted, and said way be laid out and established as a town way forever according to said Report, which is that is follows. “Upon petition of Richard C. Dennis and others for a town way, the Selectmen of the town of Beverly, having notified the parties and met and heard all who appeared did proceed to lay out said town way in manner and form following this:- Commencing at the Northwesterly corner in the way known as Chapman Street by land of the Whitney Estate and run thence westerly over lands of said Whitney Estate, and the lands of the Kittredge Estate and others about four hundred ninety-five feet to the cross fence of John I. Baker, laying out said way thus far forty feet wide Southerly of the line described; continuing from the last named terminus then southwesterly in a line with said fence and with the Easterly side of the Dennis House about two hundred forty feet to Federal Street, laying said way for this extent forty feet wide southeasterly of the line described. And we provide for the working of the way for its full with, and that the slopes of cut and embankment shall rest on the abutters. And we award, to the owners of the Whitney Estate land, one hundred and fifty dollars. To the owners of the Kittredge Estate land, thirty dollars. And we award no the damages.” Beverly March 27,1869. Voted, that the Report of the Selectmen laying out said way be accepted as said way laid out, and established as a town way forever, according to said report which is as follows. “Upon the petition of Orin B. Roberts and others for a town way the Selectmen of the town of Beverly, having notified, and met and heard all who appeared, proceeded to lay out said town way as follows, viz. beginning at the southeasterly corner of the Estate in occupation of J. S. Beverly, on the westerly side of Cabot Street; and run thence as the Northerly line of said way known Dennis Roundy Street runs about 495 feet to land of Samuel Chase, laying the way for this extent thirty feet wide, Southerly of the line described; beginning next at the westerly terminus of the Northerly line of said Roundy Street, and run thence angle therewith laying said way forty feet wide southwesterly of the line described; continuing thence in the same direction across Rantoul Street, 66 feet and over land of B. O. Peirce about 260 feet to high water mark, laying this extent of the way also forty feet wide southwesterly of the described line. And we award no damages.” Beverly March 27,1869 John I. Baker Seth NorwoodSelectmen Geo. Roundy of B. N. Dodge Beverly Saml. Porter Upon Article 4.In relation to Salem Water Works. Upon motion of H. P. Moulton, Esq. Voted, that whereas by the Act of the Legislature passed May 13,1864 Entitled an act to supply the City of Salem with the pure water, it is provided that “the inhabitants of any town upon the line of the works authorized by this act, upon application of its Board of Selectmen shall be entitled to a reasonable use of the water upon paying an equitable compensation therefore” which provision was inserted in said act upon the claim of the Town of Beverly with the full understanding at that time that the City of Salem would lay pipes and supply water to the Inhabitants of this town whenever requested, and whereas the citizens of the Town will be benefited by having an opportunity to use said water, and it is important that they have the use of it at the earliest possible moment, therefore. Voted, that the Selectmen of this town be hereby requested and authorized to take such measures either through the existing application to the Legislature, or by agreement, with the authorities of the City of Salem, as they shall deem expedient to secure said privileges, and they are hereby fully authorized in their discretion to request of the Legislature the passage of an act, authorizing the Town of Beverly to construct and lay all such pipes as maybe necessary to supply our citizens with water from Wenham Pond, and to connect the same at convenient points with the main pipe of the Salem Water Works, with the authority to use the water of said Pond, through said pipes for the above purpose. On motion of J. C. Kimball Voted, that it is the desire of the town that pipes be laid and that the water be introduced into the town. Voted, that the Town will cause upon the passage of the Act voted for, pipes to be laid for the supply of our citizens with water, so far as in the judgment of the Selectmen the interest of the Town will warrant it. On motion of C. H. Odell Voted, that the Town Treasurer be authorized to borrow, on the credit of the town, upon notes approved by the Selectmen such sums of money as maybe necessary to carry into effect any and all the foregoing votes in relation to supplying the inhabitants of this town with water. Upon Article 5. Macadamizing Cabot St. & Stone Crusher. Voted, that the whole subject of this article being indefinitely postponed. Upon Article 6.Petition of Jonathan Batchelder for a Jury. Voted that the whole subject of this article be referred to the Selectmen with full authority to represent, and act for the interest of the town in the matter. Voted, that this meeting be dissolved.
