1859-07 County Commissioners OrCommonwealth of Massachusetts Essex, ss. Court of County Commissioners July term 1859 On the petition of Israel Trask 5th and others No. 57 praying the County Commissioners for the County of Essex to approve and allow all of a town way in the town of Beverly and county aforesaid, as laid out by the Selectmen thereof,- It having been made to appear that all persons and corporations interested had been duly notified of the time and place of meeting, we the County Commissioners for our said County of Essex, did on the fourteenth day of June in the year eighteen hundred fifty-nine, proceed to view the premises and hear the parties. And now upon the completion of said view and hearing, no sufficient cause having been shown against said petition or application, and it appearing that said town had within one year last past, unreasonably refused to allow and approve of said town way, we, the said County Commissioners do adjudge that the prayer of the said petition should be granted, and we do approve and allow of the said town way as laid out by the Selectmen of said town, and we direct the said laying out be recorded by the said Clerk of said town of Beverly. The following being a true copy of said original laying out by said Selectmen. "Upon petition of Israel Trask 5th and others for a new town way from Rantoul to Cabot Streets in the town of Beverly the Selectmen of said town having notified, met, and heard the parties interested did proceed and layout said way as a town way in the manner following.- Beginning at a stake on the Easterly side of Rantoul Street fifty feet Southerly of the southwesterly corner of land of C. F. Dodge and run thence at right angles with said Rantoul Street about two hundred thirty-six feet to a stake, laying the way for this extent fifty feet wide northerly of the line described. Beginning next at the stake last above named and run thence about South 36 1/2° east in a line parallel with the northerly line of the estate of Samuel P. Lovett and wife, and twelve feet Southerly of said line shout eight hundred feet to a point on Cabot Street, twelve feet Southerly of the northerly line of said Lovett's estate, laying the way for this last described course of eight hundred forty feet wide northerly of said line, and said way shall be of before mentioned width upon the surface or traveled part thereof, both in the cuttings and on the embankments, with all slopes resting upon the adjoining owners outside of the lines described, and each course describe shall be extended, so that they shall meet and extend into each other. And we have awarded damages consequent upon laying out of said way, as follows:- To Samuel P. Lovett and wife, three hundred dollars. Mary W. Vickery two hundred dollars.
