1893-07-20 Commonwealth of Massachusetts Essex, ss. To either of the Constables of the town of Beverly in said County, Greeting: You are hereby required in the name of said Commonwealth, to notify and warn in the manner prescribed by the orders of the town, the qualified voters of said town to meet at the Town Hall in said Beverly, on Thursday the twentieth day of July current at thirty minutes past seven o'clock afternoon, for the following purposes, viz.; 1st. To choose a Moderator. 2d. To see if the town will accept chapter three hundred and sixty-four of the Acts of the Legislature for the year eighteen hundred and ninety-three entitled, "An Act to provide additional water supply for the city of Salem." 3d. To see if the town will accept and allow widening of certain town ways in said town, laid out by the selectmen, according to their reports thereon now on file in the office of the Town Clerk, viz.; I. Widening the way called Fayette Street on the southerly side thereof near the junction of said street and Cabot Street. II. Widening the way called Chestnut Street on the southerly side thereof near the junction of said street and Cabot Street. 4th. To see if the town will lay and maintain a sewer in Rantoul Street from the premises of William J. Brown to the sewer now laid in said Rantoul Street, - as per petition of Edward Brown and others. 5th. To see if the town will make an appropriation of money for fitting and furnishing an office for the Town Treasurer. Hereof fail not, but make due return of this warrant with your doings therein before the time of holding said meeting. Lovett, Town Clerk At a legal meeting of the qualified voters of the town of Beverly held, in pursuance of the warrant recorded above, at the Town Hall in said town, on Thursday the twentieth day of July in the year one thousand eight hundred and ninety-three, at thirty minutes past seven o'clock afternoon, the Meeting having been called to order at the time appointed, by the Town Clerk who read the warrant therefore it was Voted, that the Moderator be chosen by open nomination and hand vote. It was Voted, that Freeborn W. Cressy be Moderator. Upon Article 2. Concerning an additional water supply. The following communication from the Water Board was read, viz.; "Beverly, July 20th 1893. Mr. Chairman. The Water Board call your attention to the Board's reports of 1889 and 1893 as to the condition of Wenham Lake. Your board has considered it a matter of vital importance that the Lake be reinforced by an additional supply of water from some source, and has been investigating the matter jointly with the Salem Water Board and agreed with them upon the act recently passed by the Legislature and which is now before you for acceptance believing it to be for the interests of the Town to accept the same and therefore recommend its acceptance by the meeting. The act was unanimously accepted by the City of Salem. Peter. E. Clark Water Board George Swan of Hugh Hill Beverly" Upon motion of Perry Collier it was Voted. that this article be referred to a committee of seven to be appointed by the Moderator, for them to investigate and report thereon at an adjourned meeting. Upon Article 3. Widening Fayette Street. A report of the Selectmen widening a part of the town way called Fayette Street was read, and a motion that the report be accepted and the way be widened and laid out as a town way forever, according to said report, was lost, there being but eighty-nine (89) voting in favor of the motion. Later in the meeting, upon motion of John I. Baker it was Voted, to reconsider the vote upon the report of the Selectmen widening a part of Fayette Street. The report of Selectmen being again brought before the meeting, upon motion of John I. Baker it was Voted, that the report be accepted and that the way be widened and laid out as a town way forever, according to said report, which is as follows, viz.; "On this eighth day of July in the year one thousand eight hundred and ninety-three, the Selectmen of the town of Beverly, having notified all persons interested, did alter and lay out a town way in said town as follows, viz.; beginning at a point on the southerly side of Fayette Street at the intersection of the southerly line of said street with the produced line of the easterly side of the house belonging to heirs of Charles H. Rogers and thence running southeasterly over land of the heirs of said Rogers and over land of Ulysses G. Haskell on the arc of a circle of 320.58 ft. radius, one hundred and ten and twenty one hundredths (110.20) feet to Fayette Street at a point forty eight and forty six one hundredths (48.46) feet westerly on said street from Cabot Street. Laying all land between the above described line and the present southerly line of Fayette Street into the said town way. And we award damages as follows,- To the heirs of Charles H. Rogers, fifty dollars To Ulysses G. Haskell, five dollars. Dated at Beverly in the Commonwealth of Massachusetts the day and year first above written. Freeborn W. Hardy A report of the Selectmen widening a part of the town way called Chesnut Street was read, and it was Voted. that the report be accepted and the way be widened and laid out as a town way forever, according to said report, which is as follows, viz.- "On this eighth day of July in the year one thousand eight hundred and ninety-three, the Selectmen of the town of Beverly, having notified all the persons interested, did alter and lay out a town way in said town as follows, viz.- Beginning at a point on the southerly side of Chestnut Street by land of the heirs of Isaac W. Baker forty (40) feet southerly from the northerly line of said street, the said forty feet being measured on a line at right angles with the said northerly line, and thence running easterly over land of the heirs of the said Baker on a line parallel with the northerly line of said Chestnut Street and forty (40) feet distant southerly therefrom, about one hundred and five (105) feet to Cabot Street. Laying all land between the above described line and the present southerly line of Chesnut Street into the said town way. And we award damages as follows,- To the heirs of Isaac W. Edgett Beverly" John H. Woodberry Upon Article 4. Sewer, Rantoul Street. Upon motion of Robert Robertson, as mended by Edward L. Giddings it was Voted, that the prayer of the petitioners be granted and that the Selectmen be instructed to lay and maintain the sewer as petitioned for, provided that the parties interested shall pay to the town two-thirds of the expense of constructing the sewer. Upon Article 5. Furnishing office for Town Treasurer. Voted, that the sum of three hundred and twenty-five dollars be appropriated for the fitting and furnishing an office for the Town Treasurer. Upon motion of Dennis W. Quill it was Voted, to now adjourn to meet at this hall on Thursday the third day of August next at thirty minutes past seven o'clock afternoon. A true record. Attest. At a legal meeting of the qualified voters of the town of Beverly held at the Town Hall in said Beverly on Thursday the third day of August in the year one thousand eight hundred and ninety-three at thirty minutes past seven o'clock, the same being an adjournment of the town meeting held on Thursday the twentieth day of July in the same year Upon Article 2. Concerning an additional water supply. The committee, to whom the subject was referred, presented the following report; "Beverly, August 1st, 1893. The committee to which was referred the recent Act of the Legislature authorizing an increased water supply to report thereon at this meeting, have considered the matter, have visited the various sources proposed for such supply, and recognizing the immediate necessity for an increased supply, and that an abundance of good water can be furnished from the authorized sources, can but recommend the town to accept the act as for its best interest. It was Voted, that when this meeting adjourns that it adjourn to meet at this hall on Saturday evening next, August 5, A.D. 1893, at thirty minutes past seven o'clock and that the bell be rung. At a legal meeting of the qualified voters of the town of Beverly held at the Town Hall in said Beverly on Saturday the third day of August in the year one thousand eight hundred and ninety-three at thirty minutes past seven o'clock afternoon the same being an adjournment of the town meeting held on the twentieth day of July and on the third day of August in the same year. Upon Article 2. Concerning an additional water supply. A motion that chapter three hundred and sixty-four of the Acts of the Legislature for the year one thousand eight hundred and ninety-three, entitled"An Act to provide an additional water supply for the city of Salem" be accepted, was lost, there being but sixty-six (66) voting in favor of the motion. Upon motion of Charles H. Odell it was Voted that a recess of half an hour be now taken. After the close of the recess, the meeting having been called to order by the Moderator, Upon motion of John I. Baker it was Voted, to reconsider the action of this meeting upon the second article of the warrant. One hundred and forty-six (146) voting in favor of such reconsideration. Upon motion of John I. Baker it was Voted, that chapter three hundred sixty-four of the Acts of Legislature for the year eighteen hundred and ninety-three, entitled, "An Act to provide an additional water supply for the city of Salem" be accepted.
