1889-03-04 Commonwealth of Massachusetts Essex, ss. To either of the Constables of the town of Beverly in the said County, Greeting: You are hereby required in the name of said Commonwealth to notify and warn in the manner prescribed by the regulations of the town, the qualified voters of said town to meet at the Town Hall in said Beverly on Monday the fourth day of March next at thirty minutes past eight o'clock before noon for the following purposes, viz.; 1st. To choose a Moderator and Town Clerk. 2d. To act on the reports of the several boards of town officers. 3d. To choose town officers for the ensuing year, determining their number and fixing the compensation thereof. The votes for those of the above officers usually chosen by ballot will be received on one piece of paper unless the meeting otherwise determine. Also to give in their votes by ballot upon the question of granting licenses for the sale of intoxicating liquors. The polls will be closed at two o'clock in the afternoon, unless otherwise ordered by the meeting. 4th. To see what disposition the town will make of the dog tax. 5th. To see if the town will grant the sum of two hundred and fifty dollars to defray the expenses of Memorial Day, under the direction of Post No. 89, G. A. R.. 6th. To see if the town will grant the sum of one hundred and fifty dollars to defray the expenses of Memorial Day at the Farms, under the direction of Post No. 188, G. A. R.. 7th. To see if the town will accept and allow of certain town ways in said town, laid out by the Selectmen according to the reports thereon now on file in the office of the Town Clerk, viz.; I. A way in continuation of the way called Atlantic Avenue, from Lothrop Street to high watermark. II. Widening the way called Wallis Street on its southwesterly side by the premises of Augustus N. Clark and of the heirs of Edmund G. Josephs. 8th. To see what action the town will take in regard to draining Charnock Street and Dane Street and any other streets in the vicinity of the Hale Street cemetery as may be thought necessary,- as per petition of Isaac Appleton and others.. 9th. To see if the town will build a sidewalk from the junction of Essex Street and Cole Street to the junction of Essex Street and Hull Street,-as per petition of Ephraim Hathaway and others. 10th. To see if the town will establish and maintain street lights from Chapman's Corner through Boyle Street and Standley Street to Essex Street,-as per petition of Samuel Patch and others. 11th. To see if the town will locate a fire alarm box near the Centerville Engine house and provide a striking apparatus for the bell at the Centerville school house,-as per petition of F. S. Lovett and others. 12th. To see if the town will attach a striking apparatus to the bell on the South School house and connect it with the fire alarm system,-as per petition of George Roundy and others. 13th. To see if the town will establish a fire alarm box on Bridge Street near the store of Gardner Haskell,-as per petition of John W. Gregg and others. 14th. To see if the town will authorize the engineers of the fire department to sell any of the property in their charge that is not now in service and apply the proceeds to the purchase of a horse hose wagon to be located at the central fire station,- as per petition of William W. Hinkley and others. 15th. To see what action the town will take in regard to altering and repairing the building occupied by the Beverly Light Infantry,-as per petition of W. E. Perry. 16th. To see if the town will pay Jeremiah Foster the sum of two hundred dollars for damages to his estate by the widening of Hale Street near Brackenbury Street,- as per petition of Josiah Foster second and others. 17th. To see if the town will establish a fire alarm box near the junction of Essex Street and Cedar Street,- as per petition of William Stevens and others. 18th.. To see if the town will widen and deepen the culvert on Hale Street near its junction with Ober Street, and the bed of the stream below, to the ocean,- as per petition of Perry Collier and others. 19th. To adopt such measures, grant such sums of money, and take such action in regard to schools and school houses throughout the town as may be deemed expedient. 20th. To see if the town will authorize the employment of counsel to represent the town. 21st. To adopt such measures, grant such sums of money, and make such regulations in regard to repairs and building and improvement of highways and town ways throughout the town as may be determined upon. 22d. To grant such sums of money to be raised and assessed upon the polls and estates within the town, for the expenses of the current year as may be deemed expedient, and make all necessary regulations and allowances respecting the same. Also to authorize the Town Treasurer to borrow on the credit of the town, such sums of money as may be necessary from time to time, to meet the liabilities of the town, and to provide State Aid for the families of volunteers. 23d. To see if the town will accept the Jury List, as revised by the Selectmen. Hereof fail not, but make due return of this warrant with your doings thereon, before the time of holding said meeting. Pursuant to the foregoing warrant I have notified the persons therein named as therein directed, by posting notifications stating the time, place, and objects of said meeting at each of the several places in town required by the Town Regulations. Lovett, Town Clerk At a legal meeting of the qualified voters of the town of Beverly held, in pursuance of the warrant recorded on the three next preceding pages, at the Town Hall in said town, on Monday the fourth day of March in the year one thousand eight hundred and eighty-nine, at thirty minutes past eight o'clock before noon, the meeting having been called to order at the time appointed, by the Clerk who read the warrant therefor, Messrs. Freeborn W. Cressy, Charles H. Odell, John H. Woodbury, Joseph A. Wallis and Robert R. Endicott were appointed tellers by the Town Clerk to aid him in checking the names of voters and in assorting and counting votes, and they were sworn to the faithful discharge their duties by the Town Clerk. It was Voted by ballot, unanimously, that Freeborn W. Cressy be Moderator. Prayer was then offered by Rev. Sherrod Soule of the Dane Street Church. Messrs. Robert R. Endicott, John H. Woodbury, Charles H. Odell, Joseph A. Wallis, John B. Cressy, and George P. Brown were appointed tellers by the Moderator to aid him in checking the names of voters and in assorting and counting votes and they were sworn to the faithful discharge their duties by the Town Clerk. It was Voted by ballot, unanimously, the William H. Lovett be Town Clerk. Then in open town meeting immediately after the election of Town Clerk William H. Lovett, above named, was sworn to the faithful discharge of his duties as Town Clerk of Beverly. Before me, Freeborn W. Cressy, Moderator. Upon motion of John I. Baker it was Voted to now adjourn to meet at this hall on Monday the first day of April next at thirty per if minutes past eight o'clock before noon. A true record. Attest. William H. At a meeting of the qualified voters of the town of Beverly held at the town hall in said Beverly on Monday the first of April in the year one thousand eight hundred and eighty-nine at thirty minutes past eight o 'clock before noon, the same being an adjournment of the Annual Town Meeting held on the fourth day of March in the same year, Upon motion of John I. Baker it was Voted to now adjourn to meet at this Hall on Monday the fifteenth day of April current at thirty minutes past eight o'clock before noon. A true record. Attest. William H. Upon Article 2. Reports of Town Officers. Upon motion of Andrew E. Story it was Voted that this article be laid on the table. Upon Article 3. Town Officers. Upon motion of Charles L. Dodge it was Voted that the polls be closed at four o 'clock this afternoon. Upon motion of Perry Collier it was Voted that the pay of the Auditor be at the rate of one hundred (100) dollars a year. Upon motion of Robert R. Endicott it was Voted that the pay of the Town Treasurer be at the rate of six hundred (600) dollars a year. Upon motion of Andrew E. Story it was Voted that the pay of all other town officers be at the same rate as that of last year. Upon motion of Francis Norwood it was Voted that the number of town officers be the same is that of last year. The meeting then proceeded to vote for town officers. The polls were closed at four o'clock in the afternoon and the ballots received were assorted and counted and the Moderator declared the following persons elected by ballot to the several offices named. "No" four hundred and seventy-three (473) votes. After the declaration of the result of the ballot it was Voted that this meeting now adjourn to meet at this Hall tomorrow, Tuesday, April 16, A. D. 1889 at nine o'clock before noon. On Tuesday the sixteenth day of April A. D. 1889 at nine o'clock before noon the voters again assembled according to adjournment and were called to order by the Moderator and proceeded with the business of the meeting. Clerk of the Market. Ezekiel F. Obear. Voted that the Selectmen be authorized to appoint four Measurers of Wood and Bark. Upon Article 4. Dog tax. Upon motion of Andrew E. Story it was Voted that all money received from the County Treasurer upon account of dog licenses be appropriated for the use of the Public Library. Upon Article 5. Appropriation for Memorial Day. It was Voted that the prayer of the petitioners be granted. Upon Article 6. Appropriation for Memorial Day, Farms. It was Voted that the prayer of the petitioners be granted. Upon Article 7. Atlantic Avenue and Wallis Street. A report of the Selectmen laying out a town way in extension of Atlantic Avenue from Lothrop Street to high watermark was read and it was Voted that the Selectmen be authorized to ascertain if the owners of the land will give such a release to the Town, of the premises described for the proposed way, as shall keep them open and flee of access to the public forever, and that there shall never be placed thereon any obstruction to the view nor shall access to the ocean ever be prevented, and report thereon at the adjournment of this meeting. A report of Selectmen widening a part of the town way called Wallis Street was read and it was Voted that the report be accepted and the way widened and laid out as a town way forever according to said report, which is as follows, viz.; "Upon the petition of Joseph A. Haskell and others the Selectmen of the town of Beverly, having notified all the persons interested, did alter and lay out a way in said Town, as follows viz., commencing on Wallis Street by land of Augustus N. Clark, thence running by a stone wall northwesterly by land of said Clark one hundred and forty-three (143) feet to a stake four (4) feet southwesterly of the southwesterly line of said Street, thence running by a stone wall by land of said Clark northwesterly forty-two (42) feet to land of heirs of Mahala Josephs to a point two (2) feet and four (4) inches southwesterly of the southwesterly line of said street, thence running by a stone wall northwesterly over land of said Josephs' Heirs and over land of said Clark eighty-eight (88) feet to the easterly corner of said Clark's house on said Street. Laying all land between the above described line and the present southwesterly line of Wallis Street into the said town way. And we have awarded damages to no one, as none are injured thereby. Drainage, Charnock Street. Upon motion of John I. Baker it was Voted that this Article be referred to the board for them to investigate the subject and report at the adjournment of this meeting what is necessary to be done therein and the cost of doing it. Upon Article 9. Sidewalk, Essex Street. It was Voted that this Article be referred to Perry Collier to report at the adjournment of this meeting as to the need of the sidewalk petitioned for and cost thereof. John Wilson having been previously chosen to report on the subject but declined to serve. Upon Article 10. Street Lights, Boyle and Standley Streets. Upon motion of Robert R. Endicott it was Voted that action upon this Article be indefinitely postponed. Upon Article 11. Fire Alarm Box, etc. Upon motion of John I. Baker it was Voted that the eleventh, twelve, thirteenth, and seventeenth Articles of the warrant, and so much of the Engineers report as relates to fire alarm service be referred to the Engineers of the Fire Department for them to investigate concerning necessities and the cost thereof and report at the adjournment of this meeting. Upon Article 14. Horse Hose Wagon. Upon motion of John Wilson it was Voted that the subject of this Article be divided and each part be acted upon separately. Upon motion of John Wilson it was Voted that the Engineers of the fire Department be authorized to sell any property of the town which is in their charge and is not now in service and is not needed. Upon motion of David L. Foster it was Voted that all action on the remainder of the Article be indefinitely postponed. Upon motion of John Wilson it was Voted that the Engineers be instructed to pay to the Town Treasurer all money received from the sales of old property under the provisions of the foregoing vote. A motion by William A. Friend to reconsider the last vote was lost. Upon Article 15. Armory. Upon motion of Francis E. Porter it was Voted that this Article be referred to a committee of five to be appointed by the Moderator to consider the whole subject as to the necessities and the expense thereof and report thereon at the adjournment of this meeting. Upon Article 16. Land Damages, Jeremiah Foster. Upon motion of Perry Collier it was Voted that the prayer of the petitioners be granted. It was Voted that when this Meeting adjourns that it adjourns to meet at this Hall this Tuesday afternoon at thirty minutes past one o'clock. Upon Article 18. Culvert, Sallows Brook. A motion by John I. Baker to refer this Article to the Board of Health to investigate and report thereon at the adjournment of this meeting was lost. A motion by Charles H. Cressy that action on this Article be indefinitely postponed was lost. Upon motion of Perry Collier it was Voted that this Article be referred to a committee of five to be appointed by the Moderator to examine and report thereon at the adjournment of this meeting. At thirty minutes past one o'clock this (Tuesday) afternoon April 16, A. D. 1889 the voters again assembled, agreeably to the adjournment, and proceeded with the business of the meeting. Upon Article 19. Schools. Upon motion of John I. Baker it was Voted that twenty-seven thousand dollars be appropriated and assessed for the support of the Schools present year. Upon Article 20. Counsel. It was Voted that the Selectmen, if any suits occur at intervals between the annual meetings, be hereby authorized to represent the town in all such suits and claims against the town for damages. It was Voted that the Selectmen be authorized to employ such legal counsel as they may think necessary when there is occasion for it. Upon Article 21. Highways. Upon motion of John I. Baker it was Voted that twenty-five thousand dollars be appropriated and assessed for the expenses of the Highway Department the present year. Upon motion of Perry Collier it was Voted that three thousand dollars of the Highway appropriation be expended on the highways between the Gloucester Railroad Crossing and the ice houses on Essex Street. Upon Article 22. Money Grant. Upon motion of John I. Baker it was Voted that that part of the estimated appropriations needed the current year for the Town HalI be referred to the Selectmen for them to examine into the need of additional safe room and the cost of providing the same and also the cost of painting and repairing the Town Hall and report thereon at the adjournment of this meeting. It was Voted. that the Selectmen be requested to report the cost of a speaker' s desk for the Town Hall. Upon motion of Robert R. Endicott it was Voted, unanimously, that the Town Treasurer be hereby authorized to borrow on the credit of the Town, upon notes, bonds, or certificates of debt, approved by the Selectmen, or a majority of them, such sums of money from time to time, as may be necessary or expedient to meet the liabilities of the Town or to replace existing loans, and to provide State Aid for the families of volunteers. Upon motion of John I. Baker it was Voted that action upon the remainder of this Article be postponed to the remainder of this meeting. Upon Article 23. Jury List.
