1886-03-01Commonwealth of Massachusetts Essex, ss. To either of the Constables of the town of Beverly in said Cotmty, Greeting: You are hereby required in the name of said Commonwealth to notify and warn in the manner prescribed by the regulations of the town, the qualified voters in said town to meet at the Town Hall in said Beverly on Monday the first day of March next, at thirty minutes past eight o'clock before noon, for the following purposes, viz..; 1st. To choose a Moderator and Town Clerk. 2d. To act on the reports of the several boards of town officers. 3d. To choose town officers for the ensuing year, determining their number and fixing the compensation thereof. The votes for those of the above officers usually chosen by ballot will be received on one piece of paper, unless the meeting otherwise determine. Also to give in their votes by ballot upon the question of granting licenses for the sale of intoxicating liquors. Every person qualified to vote for senators and representatives in the general court may express his opinion upon said question, and the form of said ballot shall be as follows; "Shall licenses be granted for the sale of intoxicating liquors in this town?" "Yes" or "No." The polls will be closed at 2 o'clock in the afternoon unless otherwise ordered by the meeting. 4th. To see what disposition the town will make of the dog tax. 5th. To see if the town will grant the sum of two hundred dollars to defray the expenses of Memorial Day, under the direction of Post No. 89, G. A. R. 6th. To see if the town will establish and maintain street lights in any part of the town. 7th. To see if the town will accept and allow of certain town ways in said town, laid out by the Selectmen according to the reports thereon now on file in the office of the Town Clerk, viz.; a way from the southerly side of Railroad Avenue between the Methodist meeting house and Norwood block extending southerly and thence turning and running easterly to Cabot Street; a way in extension of Wellman Street from Webber Avenue northerly to the sea; a way from Congress Street to School Street and from Webber Avenue to the sea; away from the westerly terminus of Congress Street extending westerly to the sea. 8th.To see if the town will reconsider its vote relating to the sale of the former Enterprise steam fire engine company's house, and that said house be removed to the site of the Washington hose company's house on Rantoul Street and the house now standing there sold,- as per petition of Orrin B. Burnham and others. 9th. To see if the town will establish and maintain a drinking fountain near the junction of Cabot and Water streets.- As per petition of George Roundy and others. 10th. To see if the town will purchase a horse hook and ladder truck and a pair of horses for the same,- as per petition of Rufus H. Woodbury and others. 11th. TO see if the town will not reconsider the vote by which it provided for an independent water supply and authorized the expenditure of one hundred and fifty thousand dollars therefore,- as per petition of A. H. Trowt and others. 12th. To adopt such measures, grant such sums of money, and take such action in regard to schools and school houses throughout the town is may be deemed expedient. 13th. To see if the town will authorize anyone to represent the town in any suits or claims against the town for damages. 14th. To adopt such measures, grant such sums of money, and make such regulations in regard to repairs, and building and improvement of highways and town ways throughout the town as may be determined upon. 15th. To grant such sums of money to be raised and assessed upon the polls and estates within the town, for the expenses of the current year as may be deemed expedient, and make all necessary regulations and allowances respecting the same. Also to authorize the Town Treasurer to borrow, on the credit of the town, such sums of money as may be necessary from time to time, to meet the liabilities of the town, and to provide State Aid for the families of Volunteers. 16th. To see if the town will accept the Jury List, as revised by the Selectmen. Hereof fail not, but make due return of this warrant with your doings thereon, before the time of holding said meeting. Pursuant to the foregoing warrant I have notified the persons therein named as therein directed, by posting notifications stating the time, place, and objects of said meeting at each of the several places in town required by the Town Regulations. Lovett, town clerk At a legal meeting of the qualified voters of the town of Beverly held, in pursuance of the warrant recorded on the three next preceding pages, at the Town Hall in said town on Monday the first day of March in the year one thousand eight hundred and eighty-six at thirty minutes past eight o'clock before noon the meeting having been called to order at the time appointed by the Clerk who read the warrant therefor, Messrs. John I. Baker, Freeborn W. Cressy, Henry W. Foster, Isaac Ober, Augustus Williams, William Haskell, John B. Cressy, and George P. Brown were appointed tellers by the Town Clerk to aid him in checking the names of voters and in assorting and counting votes, and they were sworn to the faithful discharge of their duties by the Town Clerk. It was Voted, by ballot, unanimously that Freeborn W. Cressy be Moderator. Prayer was then offered by Rev. William E. Strong of the Washington St. church. Messrs. John I. Baker, Henry W. Foster, Isaac Ober, Augustus Williams, William Haskell, John B. Cressy, George P. Brown were appointed tellers by the Moderator to aid him in checking the names of voters and assorting and counting votes and they were sworn to the faithful discharge of their duties by the Town Clerk. Voted by ballot, unanimously, that Wm. H. Lovett be Town Clerk. Then in open Town Meeting immediately after the election of Town Clerk William. H. Lovett, above named, was sworn to the faithful discharge of his duties as Town Clerk of Beverly. Before me, Freeborn W. Cressy, Moderator. Upon motion of John I. Baker it was Voted that when this meeting adjourns that it adjourns to meet at the Hall on Monday the fifth day of April next at nine o'clock A.M. It was Voted that this meeting now adjourns. At a legal meeting of qualified voters of the town of Beverly held at the Town Hall in said Beverly on Monday the fifth day of April in the year one thousand eight hundred and eighty-six at nine o 'clock before noon, and by adjournment on Tuesday the six day of said month at nine o'clock before noon, the same being an adjournment of the Annual Town Meeting held on the first day of March in the same year. It was Voted that when this meeting adjourns that it adjourns to meet at this Hall on Tuesday the six day of April current at nine o'clock before noon. Upon Article 2. Reports of Town Officers. The reports of the Overseers of the Poor, Trustees of the Public Library, Commissioners of the Sinking Fund, Board of Health, were read and together with the printed reports of the Auditor, Selectmen and Chief Engineers of the Fire Department were each separately presented to the meeting and all were accepted. Upon Article 3. Election of Town Officers. Voted that the number of town officers and their compensation be the same as that of last year. Upon motion of John I. Baker it was Voted that the election of Surveyors of Highways be postponed till Tuesday April 6. The meeting then proceeded to vote for town officers. The polls were closed at two o'clock in the afternoon and the ballots received were assorted and counted and the Moderator declared the following persons elected by ballot to the several offices named. "Yes" two hundred and eighty (280) votes "No" five hundred forty-four (544) votes. After the declaration of the result of the ballot it was Voted to now adjourn. On Tuesday April 6 at nine o'clock before noon the voters again assembled, according to adjournment, and were called to order by the Moderator and proceeded with the business of the Meeting. It was Voted that the remainder of the officers be chosen by hand vote. Upon motion of William A. Friend it was Voted that the Moderator appoint a committee of one from each highway ward, to call a meeting of the voters of each ward, to meet separately, to nominate a Surveyor of Highways for such ward, to be reported to this meeting. The Moderator appointed the following named persons as this committee, viz.; Ward 1, Perry Collier, Ward 2, David L. Foster, Ward 3, Stephen Eldredge, Ward 4, Issacher T. Eldredge, Ward 5, Charles H. Upon motion of John I. Baker it was Voted that all money received from the County Treasurer on account of dog licenses be appropriated for the use of the Schools. Upon Article 5. Appropriation for Memorial Day. It was Voted that the prayer of the petitioners be granted. Upon Article 6. Street Lights. Upon motion of William A. Friend it was Voted that the selectmen be authorized to establish and maintain street lights were they think the public necessity requires. Upon Article 7. Certain Town Ways. A report of the Selectmen laying out as a town way a way from a Railroad Avenue extending southerly and thence easterly to Cabot Street was read and is as follows, viz.; "Upon due notice and proceedings had, the Selectmen of the town of Beverly have laid out a way in said town as follows, viz.: beginning on the southerly side of Railroad Avenue at the northeasterly corner of the Avenue Methodist Church lot, and thence running in a straight line southwesterly by the southeasterly line of said church lot, and by the land of Norwood, about 279 53/100 feet to a corner, and run thence from said corner, southeasterly by land of Norwood, about 445 32/100 feet to Cabot Street, laying said town way forty feet in width southeasterly of the first line described, and the same width northeasterly of the last line described. And we award no damages as the owners of the land taken waive of all claim for such damages. Reference being had to plan on file here with. Beverly, February 19, 1886. John I. Baker Freeborn W. Foster of Isaac Ober Beverly Augustus Williams It was Voted that said report be accepted and that the way be laid out and established as a town way forever according to said report. The following report of the Selectmen was read. "Upon due notice and proceedings had the undersigned Selectmen of the town of Beverly have laid out a town way in said town, beginning at the corner of Congress Street and Porter Street by the homestead estate of Benjamin Webber and run thence about 80o west 227 feet to a bounds 34 feet northerly from the northwesterly corner of the building of Mrs. Lefavour known as "Mill," and run thence south 65o West about 70 feet to the River, said way being in extension of that part of Congress Street formerly laid out as a town way; and laying this present way 34 feet wide southerly of the lines described; allowing the buildings now in said way to remain so long as the same shall stand, and awarding no damages as no one is damaged hereby. Foster of Augustus Williams Beverly" It was Voted that said report be accepted and that the way be laid out and established as a town way for ever according to said report. A report of the selectmen laying out certain town ways was read and is as follows, viz.; "Upon due notice and proceedings had, the undersigned Selectmen of the town of Beverly have laid out a town way in said town as follows; beginning at the southeasterly corner of School and Porter Street by the estate of William H. Welch and run thence as the easterly line of the private way known as Porter Street runs southerly 367 feet to Linden Street and continuing the same course by the southerly end of said Linden Street 50 feet and by Webber land 72 feet to an angle; and run thence a little more easterly as said easterly line of said Porter Street runs 398 feet to Congress Street; laying said town way for its entire extent forty five feet wide westerly of the lines described. Allowing that part of the Webber building which comes within said way to remain so long as the same shall stand; and awarding damages to no one, as no one is damaged hereby. And upon like notice and proceedings we have laid out town ways in said town, viz.: extending Porter Street from Webber Avenue to Bass River at right angles with said Avenue about 210 feet to said river, and forty five feet in width: and we award no damages as no one is damaged. Also extending Wellman Street from Webber Avenue in a direct line with that part of Wellman Street already laid out as a town way, to Bass River about 220 feet to said river and 45 feet wide, and we award no damages as no one is damaged. Foster of Augustus Williams Beverly" It was Voted that said report be accepted and that the way be laid out and established as a town way for ever according to said report. Upon Article 8. Enterprise Hose House. Upon motion of Andrew E. Story it was Voted to reconsider the vote (see page 433) by which it was voted to sell the house and lot formerly occupied by the enterprise steam fire engine company. The original motion was then put the meeting and lost. It was Voted to remove the building formerly occupied by the Enterprise steam fire engine company to the site of the Washington Hose Company' s building. Two hundred and sixteen voting in favor of the motion and one hundred and seventy-one opposed to it. It was Voted to remove the building now occupied by the Washington Hose company to Chapman' s Corner. It was Voted that when this meeting adjourns that it adjourns to meet at this Hall this Tuesday afternoon at half past one o'clock. Upon Article 9. Drinking Fountain Cabot and Water Streets. Upon motion of Wm. F. Davis it was Voted that prayer of the petitioners be granted. Upon Article 10. Hose Hook and Ladder Truck and Horses. Upon motion of Edwin Foster it was Voted to buy a horse hook and ladder truck. Upon a motion to buy a pair of horses for said truck it was Voted that action thereon be indefinitely postponed. Upon Article 11. Independent Water Supply. Upon motion of Chas H. Odell it was Voted that action upon this article be indefinitely postponed. Upon Article 12. Schools. Upon motion of John I. Baker it was Voted that twenty-two thousand dollars be appropriated and assessed for the support of the Schools the present year. Upon Article 13. Suits for Damages. Upon motion of Andrew E. Story it was Voted, that the Selectmen, if any suits occur at intervals between the annual meetings, be hereby authorized to represent the Town in all such suits and claims against the Town for damages. Upon Articlel4. Highways. Upon motion of John I. Baker it was Voted that twenty-five thousand dollars be appropriated and assessed for expenses of the Highway Department the present year. Upon motion of Andrew E. Story it was Voted that two hundred dollars of the above appropriation be expended on Mulberry Street. Upon Article 15. Money Grant. Upon motion of John I. Baker it was Voted that the Town Treasurer be hereby authorized to borrow on the credit of the town, upon notes, bonds, or certificates of debt, approved by the Selectmen, such sums of money from time to time, as may be necessary or expedient to meet the liabilities of the town or to replace existing loans, and to provide State Aid for the family of Volunteers. It was Voted that further consideration of this Article be postponed till adjournment of this Meeting. Voted to now adjourn. It was At half past one o'clock this Tuesday aftemoon April 6, A.D. 1886 the voters again assembled, agreeably to the adjournment, and proceed with the business of the meeting. The report of the selectmen having been taken up, upon motion of John I. Baker it was Voted that the Assessors be authorized to have such surveys and plans of the town made as will enable them to make correct assessments, and to have the valuation of the town the present year published at as early a date as practicable; and also that they may be authorized to procure at a reasonable expense such other information as may be necessary for them to obtain an accurate knowledge of the taxable property in the town. Upon motion of Edwin Foster it was Voted that the Engineers be a committee to purchase the hook and ladder truck and that a sum not exceeding one thousand five hundred dollars be appropriated therefor. Upon a motion by John Meacom that the school committee be instructed to have all school houses insured at one half their value and also all public buildings that require it, was lost. Upon motion of John I. Baker it was Voted that when this meeting adjourns it adjourns to meet at the Hall on Tuesday April 20, current, at two o'clock afternoon. The several committees appointed by the Moderator to call together the voters of each ward to nominate a person to serve as Surveyor of Highways for such ward (see page 442) reported and it was voted, by hand vote, the following persons be Surveyors of Highways for the respective wards the present year; Ward 1 West D. Crowell that the Selectmen be directed to discontinue building the wall at the terminus of Bay View Avenue was lost, as was also a motion by the same person that an opening seven feet wide be left in said wall and a flight of stone steps be placed there extending to the beach. A motion by Samuel Thissell that "Any persons having help outside of the alms house that their names shall be put in the town report" was lost. Upon Article 16. Jury List. The list of Jurors as revised by the Selectmen was read and was amended by striking out the names of Samuel A. Holden, Jeremiah Murphy and Austin Whitcomb and inserting the names of Richard Symmes, Patrick Guinivan and John W.
