1882-03-06Commonwealth of Massachusetts Essex ss. To either of the Constables of the Town of Beverly, in said County: Greeting You are hereby directed to notify and warn, in the manner prescribed by the regulations of the town, the qualified voters of said town, to meet at the Town Hall, in said Beverly, on Monday, the Sixth Day of March next, at fifteen minutes past eight o'clock before noon, for the following purposes, viz. 1 st. To choose a Moderator and Town Clerk. 2d. To act on the reports of the several Boards of Town Officers. 3d. To choose Town Officers for the ensuing year, determining their number and fixing the compensation thereof. The ballots for the above officers will be received on one piece of paper. Also to give in their votes by ballot upon the question of granting licenses for the sale of intoxicating liquors. Every person qualified to vote for Senators and Representatives in the General Court may express his opinion upon said question and the form of said ballot shall be as follows: "Shall Licenses be granted for the sale of Intoxicating Liquors in this town ?" "Yes," or "No." The polls will be closed at two o'clock in the afternoon unless otherwise ordered by the meeting. 4th. To act on the question of an appropriation for the expenses of Memorial Day, under the direction of Post 89, Department of Massachusetts, Grand Army of the Republic. 5th. To see if the town will establish and maintain street lights on Hale and West Streets, from Pride's Crossing to the Railroad station at Beverly Farms, and on such other streets at Beverly Farms as may seem to be required for public safety,-as per petition of Alvin Williams and others. 6th. To see if the town will establish and maintain a street light on Pleasant Street near Phillips' Court- as per petition of Israel Trask and others. 7th. To see if the town will establish and maintain a street light on Broadway between the estates of J. W. Rogers and Freeman Winslow,- as per petition of Freeman Winslow and others. 8th. To see if the town will establish and maintain a street light on the corner of Dane and Rantoul Streets,-as per petition of L. Barker and others. 9th. To see if the town will establish - and maintain a street light at the junction of School and Rantoul Streets,- as per petition of Prince Howes and others. 10th. To see if the town will establish and maintain a street light at the corner of Charnock and Essex Streets,- as per petition of N. W. Haynes and others. 11th. To see if the town will extend the water pipe to the premises of John W. Bell, on Knowlton Street.,-as per his petition. 12th. To see if the town will pay the expense of raising the house of John W. Bell, two and one-half feet above its present level,-as per his petition. 13. To see if the town will extend the water pipe to the premises of Mark B. Avery, on Herrick Street,-as per his petition., 14th. To see what action the town will take in regard to instructing the Selectmen to regulate the use of the horse railroad tracks through our town, by the Horse Railroad Company, having special reference to the nuisance of the use of salt on the track by said company, to the great detriment of our citizens and the traveling public in general,-as per petition of Frank W. Plaisted and others. 15th. To see if the town will provide for the placing of crossing stones across the head of Bow Street, and from Bow Street across Cabot Street to Abbott Street, and from Broadway to Thorndike Street and at such other places as the town may think necessary,-as per petition of A. Whitcomb and others. 16th. To see if the town will authorize the Town Treasurer to sell and convey the lot of land belonging to the town, adjoining the Farms Cemetery, which is unsuitable for burial purposes. 17th. To see if the town will build a sidewalk from the depot, in North Beverly to the Dodge's Row school house, in those places where none now exists, from material on the premises and owned by the town, -as per petition of Charles Porter and others. 18th. To see if the town will take measures to procure the writing and publishing of the history of the town of Beverly,-as per petition of John B. Hill and others. 19th. To see if the town will repair the drain leading from Bartlett Street near the estate of the late Henry Kennison,-as per petition of Susannah Kennison and others. 20th. To see if the town will provide a drinking fountain at the corner of Essex and Hull Streets,-as per petition of H. A. Appleton and others. 21 st. To see if the town will extend the water pipe to the premises of Charles Cressy in the rear of Ober Street,-as per his petition. 22nd. To see if the town will establish and maintain a street light at or near the junction of Stone and South Streets,-as per petition of A. T. Mosman and others. 23rd. To see what disposition the town will make of the dog-tax. 24th. To see if the town will approve and allow of a town way from the junction of Cross Street and East Lothrop Street to Essex Street near the Gloucester Branch Railroad Crossing-according to a report of the Selectmen now on file in the office of the Town Clerk. 25th. To see if the town will approve and allow of a town way from Hale Street to Lothrop Street, according to a report of the Selectmen now on file in the office of the Town Clerk. 26th. To see if the town will approve and allow of a town way, the way known as Vine Street extending from Oak Street to land of Abraham Trowt, according to a report of the Selectmen now on file in the office of the Town Clerk. 27th. To see if the town will approve and allow of the widening the town way known as Lovett Street on its northwesterly side between Washington and Central Streets, according to a report of the Selectmen now on file in the office of the Town Clerk. 28th. To see if the town will discontinue five feet in width on each side of the present line of that portion of the way known as Lovett Street, as extends from Ocean Street to Dane Street, so that said Lovett Street at said place shall be forty feet in width-as per petition of Robert. H. and Ellen Bancroft. 29th. To see if the town will cause such portions of the Soldiers' Memorial lot in the cemetery, as maybe deemed necessary, to be suitably laid out and prepared for the burial places of those who have deceased or who may hereafter decease of the soldiers or sailors who served either in the army or navy in the war of the rebellion or in any other war, as per petition of William H. Morgan and others. 30th. To adopt such measures, grant such sums of money, and take such action in regard to schools and school houses throughout the town as may be deemed expedient. 31st. To see if the town will authorize any one to represent the town in any suits or claims against the town for damages. 32d. To adopt such measures, grant such sums of money, and make such regulations in regard to repairs and improvement of the highways throughout the town as may be determined upon. 33d. To grant such sums of money to be raised and assessed upon the polls and estates within the town, for the expenses of the current year, as may be deemed expedient, and make all necessary regulations and allowances respecting the same. Also, to authorize the Town Treasurer to borrow on the credit of the town, such sums of money as may be necessary from time to time to meet the liabilities of the town and to provide State Aid for the families of volunteers. 34th. To see if the town will accept the Jury list, as revised by the Selectmen. Hereof fail not, but make due return of this warrant with your doings thereon, before the time of holding said meeting. Cressy be Moderator Prayer was then offered by Rev. Samuel W. Eddy of the Dane St. Church Voted by ballot, unanimously, that William H. Lovett be Town Clerk. Then in open Town Meeting, immediately after the election of Town Clerk, William H. Lovett above named was sworn to the faithful discharge of his duties as Town Clerk of Beverly Before me, Freeborn W. Cressy, Moderator Upon Article 2. Reports of Town Officers Upon motion of Robert R. Endicott it was Voted that the consideration of this article be postponed until after action has been taken upon Article 3. Upon Article 3. Election of Town Officers. Upon motion of John I. Baker it was Voted that the Board of Selectmen consist of five members. A motion that the Board of Assessors consist of five members was lost as was also a motion that the Board of Overseers of the Poor consist of five members. Upon motion of William A. Friend it was Voted that the polls be kept open till four o'clock in the afternoon. John B. Hill, Josiah A. Haskell and John Girdler were appointed by the Moderator to assist in assorting and counting the ballots received and they were duly sworn to the faithful discharge of their duties. The polls were closed at four o'clock P.M. and the ballots received were assorted and counted and the Moderator declared the following persons elected by ballot to the several offices named. "Yes" one hundred and eighty (180) votes "No" four hundred and seventy four (474) votes After the declaration of the result of the ballot it was Voted that when this meeting adjoums that it adjourns to meet at this Hall to-morrow, Tuesday at nine o'clock A.M. Voted to now adjourn and the Moderator declared the meeting adjourned till Tuesday March 7 at nine o'clock A.M. Time (8:35 P.M.) On Tuesday March 7 at nine o'clock A.M. the voters again assembled according to adjournment and were called to order by the Moderator and proceeded with the business of the meeting. Upon motion of John I. Baker it was Voted that the election of the remaining town officers be postponed until this Tuesday afternoon and that the Moderator appoint a committee of one from each highway ward, to call a meeting of the voters of each ward, to meet separately, to nominate a Surveyor for such ward, to be reported to this meeting. The Moderator appointed the following named persons as the Committee, for Ward 1, Samuel Porter, Ward 2, Joseph Foster, Ward 3, James E. Cole, Ward 4 N. P. Allen, Ward 5 Stephen P. Elliott, Ward 6 Andrew Dodge, Ward 7 Moses S. Herrick, Ward 8 Brackett T. Munsey, Ward 9 Jonathan Dodge, Ward 10 Eli C. Glines, Ward 11 Benjamin V. Giles, Ward 12 Benjamin D. Grant, Ward 13 Joseph F. Standley, Ward 14 Josiah A. Haskell. For the list of Surveyors of Highways see page 281. Upon Article 4. Appropriation for Memorial Day Voted that the sum of One Hundred and Fifty dollars be appropriated and assessed for the expenses of Memorial Day in decorating the Soldiers' Graves, to be expended under the direction of Post 89 of the Grand Army of the Republic. Article 2 Was then presented to the meeting and the Reports of the Selectmen, in which was included the Report of the Board of Health, of the Overseers of the Poor, the Engineers of the Fire Department, the Trustees of the Public Library were read and together with the printed reports of the Auditor and School Committee were each severally presented to the Meeting and all were accepted. Upon Article 5. Street Light at Beverly Farms Upon motion of George S. Millett it was Voted to refer this Article to the Selectmen for them to report at the adjournment of this meeting in April as to what is advisable to do in the matter. Upon Article 6. Street Light Pleasant Street Upon motion of Joseph Wilson it was Voted to refer this Article to the Selectmen for them to report at the adjournment of this meeting in April as to what is advisable to do in the matter. Upon Article 7. Street Light, Broadway Upon motion of George S. Millett it was Voted to refer this Article to the Selectmen with authority to establish and maintain the street light asked for if they think it necessary. Upon Article 8. Street Light comer of Dane and Rantoul Streets. Upon motion of George S. Millett it was Voted to refer this Article to the Selectmen with authority to establish and maintain the street light asked for it they think it necessary. Upon Article 9. Street Light cor. School and Rantoul Sts. Upon motion of George S. Millett it was Voted to refer this Article to the Selectmen with authority to establish and maintain the street light asked for it they think it necessary. Upon Article 10. Street Light cor. Charnock and Essex Sts. Upon motion of William A. Friend it was Voted to refer this Article to the Selectmen with authority to establish and maintain the street light asked for it they think it necessary. Upon Article 11. Water Pipe to John W. Bell's premises Upon motion of Perry Collier it was Voted that the prayer of the petitioner be granted and that the water pipe be extended as requested. Upon Article 12. Raising John W. Bell's house. Upon motion of Josiah A. Haskell it was Voted to refer this Article to the Selectmen for them to report upon at the adjournment of this meeting in April. Upon Article 13. Water Pipe to Mark B. Avery's premises Upon motion of William A. Friend it was Voted that the prayer of the petitioner be granted and that the water pipe be extended as requested. Upon Article 14. Horse Railroad Co.'s tracks. A motion of Josiah A. Haskell's to refer this Article to the Selectmen with instructions to report regulations at the adjournment of this meeting in April was lost. Upon motion of Francis S. Lovett it was Voted "That the Selectmen be requested to make such regulations in regard to Snow on the Horse Railroad track as will not allow the Company to dig out the track to the detriment of the Public travel or to salt the track at any time." Upon Article 15. Crossing Stones. Upon motion of Daniel Foster it was voted to refer this Article to the Selectmen with instructions to place crossing stones wherever they think it necessary. Upon Article 16. Land adjoining Farms Cemetery Upon motion of John I. Baker it was Voted that action upon this Article be indefinitely postponed. Upon Article 17. Sidewalk, Dodge's Row Upon motion of Edward F. Danforth it was Voted that the prayer of the petitioners be granted. Upon Article 18. History of the Town Upon motion of John B. Hill it was Voted "That Article 18th be referred to a committee of eleven to be appointed by the Moderator, to consider the expediency of causing a history of Beverly to complied and published at the town's expense, and the best methods to adopt in regard thereto, and report at an adjournment of this meeting. The Moderator appointed the following named persons as this Committee, William Endicott, John Pickett, Augustus A. Clark, John I. Baker, Edward L. Giddings, Charles H. Odell, Eben H. Moulton, John Meacom, Joseph D. Tuck, Albert Perry, William C. Boyden. Upon Article 19. Repairing Drain from Bartlett St. Upon motion of Joseph Foster it was Voted that this Article be referred to the Selectmen. Upon Article 20. Drinking Fountain, Hull and Essex Sts. A motion of George S. Millett's to refer this Article to the Selectmen with instructions to report thereon at the adjournment of this meeting in April was lost. Upon motion of John H. Watson it was Voted that the prayer of the petitioners be granted. Upon Article 21. Water Pipe to Chas. Cressy's premises. Upon motion of Josiah A. Haskell it was Voted that the prayer of the petitioner be granted. Upon Article 22. Street Light cor. Stone and South Sts. Upon motion of Daniel Foster it was Voted that the petitioners have leave to withdraw. Upon Article 23. Dog Tax Upon motion of John I. Baker it was Voted that all money received from the County Treasurer on account of dog licenses be appropriated for the use of the Public Schools. Upon Article 24. Town way from Cross and E. Lothrop Sts. To Essex St. A motion of Jonas G. Gallop's to lay this Article on the table till the year nineteen hundred and five was lost. A report of the Selectmen laying out as a town way a way from the junction of Cross Street and East Lothrop Street to Essex Street near the Gloucester Branch Railroad crossing was read and is as follows, viz.; The Selectmen of the town of Beverly upon the petition of Henry W. Foster and others for a town way from the junction of Cross Street and East Lothrop Street substantially in the direction of the old "Outlet Way" by and over Snake Hill to Essex Street near the Gloucester Branch Railroad crossing have duly notified all person interested and met and heard all who desired to be heard did proceed to lay out said town way as follows - Beginning at the southerly corner of Andrew K. Ober' s land by the corner of Cross Street and the open way known as Perkins Avenue and running thence North 45° 29' West by said Ober's land four hundred feet in a straight line as said avenue is now walled out, thence running North 58° 50' West by land of Gallop heirs, land of A. K. Ober and land of Est. of Israel Cole twenty two hundred feet to an angle in the Cole Land made by the crossing of the Gloucester Branch Railroad over Essex Street said described line being the northerly side of said way. Then commencing on East Lothrop Street fifty feet southerly from the northerly line of said Perkin's Avenue and thence running North 45° 29' West by land of heirs of Bardwell three hundred and forty five feet, thence running by land of said Bardwell, land of Gallop heirs, land of H. B. Taylor and land of Estate of Israel Cole on a course north 58° 50' West parallel to and fifty feet southerly of the northerly line of said way twenty one hundred feet to a bounds one hundred feet South 58° 50' East from the southwesterly line of Essex Street, thence running westerly and southerly on a regular curve with a one hundred feet radius one hundred and fifty seven feet to Essex Street one hundred and fifty feet southerly of the termination of the first described line, laying all the land within the above described lines from Cross Street and East Lothrop Street to Essex Street into a town way. And we award damages as follows, viz.; To the heirs of Edmund K. Gallop To the heirs of Samuel Gallop To Mrs. Abby Bisson To Jonas G. Gallop $20.00 20.00 20.00 20.00 And we allow until the first day of July next for the owners of the land to remove trees and fences from the limits of the road. Beverly, Feb. 27, 1882 Joseph Wilson Selectmen J. H. Young of Freeborn W. Cressy Beverly It was Voted that said report be accepted and the way be laid out and established as a town way forever according to said report. Upon Article 25. Town way from Hale St. to E. Lothrop St. A report of the Selectmen laying out as a town way a way from Hale Street southerly of the house of James Clayton to Lothrop Street was read and is as follows, viz.; The Selectmen of the Town of Beverly upon the petition of Joseph W. Lefavour and others for a town way from Hale Street to East Lothrop Street having duly notified all persons interested and met and heard all who desired to be heard did proceed to lay out said town way as follows, viz.; Beginning at the southerly corner of James Clayton's land on Hale Street thence turning North twenty two degrees West by land of said Clayton and by land of Joseph W. Lefavour two hundred and fifty eight feet, thence north fifty nine degrees thirty minutes West four hundred eighty two feet over land of Beverly National Bank to East Lothrop street laying said town way forty feet wide southwesterly of the lines described. And we award damages to no person. Beverly, Feb. 27, 1882. Joseph Wilson Selectmen J. H. Young of Freeborn W. Cressy Beverly Voted that said report be accepted and that the way be laid out and established as a town way forever according to said report. Upon Article 26. Town way, Vine Street. A report of the Selectmen laying out as a town way a way from Oak Street to land of Abraham Trowt was read and is as follows, viz.; The Selectmen of the town of Beverly upon the petition of N. P. Allen and others for a town way over Vine Street from Oak Street to land of Abraham Trowt having duly notified all persons interested and met and heard all who desired to be heard did proceed to lay out said town way as follows, viz.; Beginning at the southeasterly corner of Emily Ober's land on Oak Street thence running North twenty degrees thirty minutes West by land of said Ober, N. P. Allen and Joseph F. Haskell three hundred and twenty feet to land of Abraham Trowt. Laying said town way forty feet wide easterly of the line described. And we award damages to no person. Beverly, February 27, 1882. Joseph Wilson Selectmen J. H. Young of Freeborn W. Cressy Beverly It was Voted that said report be accepted and that the way be laid out and established as a town way forever according to said report. Upon Article 27. Widening town way, Lovett Street. A report of the Selectmen widening the town way known as Lovett Street between Washington Street and Central Street was read and is as follows, viz.; Upon petition of Elbridge Fiske and others for a town way to be allowed and widened, the Selectmen of the town of Beverly having notified, met, and heard the parties interested who wished to be heard did proceed to widen a town way in said town as follows, Beginning on Washington Street forty one feet northwesterly from the junction of the southwesterly line of Washington Street and the southeasterly line of Lovett Street thence running South sixty eight degrees West over land of Joseph W. Lefavour, Benjamin A. Cleaves and George W. and George C. Stickney three hundred and fifteen and one half feet to Central Street to a bounds forty two feet northwesterly from the junction of the northeasterly line of Central Street and the southeasterly line of Lovett Street, laying out all the land of said Lefavour, Cleaves and Stickney between the above described line and the present northerly line of Lovett Street into the said town way. And we award damages as follows, To Joseph W. Lefavour, two hundred and fifty dollars. To Benjamin A. Cleaves, three hundred and twenty five dollars To Geo. W. and Geo. C. Stickney, three hundred and twenty five dollars And we allow the owners of the land until the first day of July next to remove their buildings and fence. Beverly, February 27, 1882. Joseph Wilson Selectmen J. H. Young of Freeborn W. Cressy Beverly It Was Voted that said report be accepted and that the way be widened and established as a town way forever according to said report. Upon Article 28. Discontinuing part of Lovett St. Upon motion of John H. Watson it was Voted to lay this Article upon the table. (It was acted upon at a later stage of the meeting) Upon Article 29. Memorial Lot. Upon motion of Henry P. Woodbury it was Voted that this Article be referred to the Selectmen with instructions to them to provide some suitable burial place for the soldiers and sailors who served either in the army or navy in the war of the rebellion or in other war who have deceased or who may hereafter decease, and that they report their doings therein at the adjournment of this Meeting in April. Upon Article 30. Schools Upon motion of John I. Baker it was Voted that Nineteen Thousand dollars be appropriated and assessed for the support of schools the present year. Upon Article 31. Suits for Damages. Upon motion of Josiah A. Haskell it was Voted that the Selectmen, if any suits occur at intervals between the annual meetings, be hereby authorized to represent the town in all such suits and claims against the Town for damages. Upon Article 32. Highways It was Voted that Ten Thousand dollars be appropriated and assessed for the expenses of the Highway Department the current year. Upon Article 33. Money Grant. Upon motion of John I. Baker it was Voted that so much of this Article as relates to the granting of money to be raised and assessed upon the polls and estates within the town, for the expenses of the current year and the making of all necessary allowances and regulations respecting the same be postponed till the adjournment of this meeting in April. It was Voted that the Town Treasurer be hereby authorized to borrow on the credit of the Town, upon notes, bonds or certificates of debt, approved by the Selectmen, such sums of money from time to time as may be necessary or expedient to meet the liabilities of the town or to replace existing loans, and to provide State Aid for the families of Volunteers It was Voted that when this meeting adjourns that it adjourn to meet at the Hall this (Tuesday) afternoon at thirty minutes past one o'clock. Upon motion of John I. Baker it was Voted to reconsider that portion of this Article which was postponed till the adjournment of this meeting in April. A motion of John H. Watson' s to lay the Article upon the table was put to the meeting and lost. Upon motion of Joseph Foster it was Voted that Post 89, Grand Army of the Republic have the use of Town Hall for a fair free of charge. Upon motion of John I. Baker it was Voted that so much of this article as relates to the granting of money to be raised and assessed upon the polls and estates within the town for the expenses of the current year and the making of all necessary regulations and allowances respecting the same be postponed till the adjournment of this meeting in April. It was Voted to now adjourn. At thirty minutes past one o'clock this Tuesday afternoon March 7 A.D. 1882 the voters again assembled agreeably to the adjournment and proceeded with the business of the meeting. It was Voted to choose the remaining Town Officers by hand vote. The committee appointed by the Moderator for the purpose of procuring a list of nominees for Surveyors of Highways (see page 271) reported and it was Voted by hand vote that the following persons be Surveyors of Highways of the respective wards the present year. (The list is recorded on page 284) Upon motion of Edwin Foster it was Voted that the Selectmen be requested to cause the street light voted by the town at its annual meeting in March A.D. 1880, to be established and maintained near the corner of Dane and Hale Streets, to be erected the present season. Upon motion of Francis S. Lovett it was Voted that when this meeting adjourns that it adjourn to meet at the Hall on the first Monday in April at one o'clock in the afternoon.
