1881-07-06Commonwealth of Massachusetts Essex, ss. To either of the Constables of the Town of Beverly in said County. Greeting. You are hereby directed to notify and warn, in the manner prescribed by the regulations of the town, the qualified voters of said town to meet at the Town Hall in said Beverly on Wednesday the sixth day of July next at thirty minutes past one o'clock in the afternoon, for the following purposes, viz; 1st to choose a Moderator 2d To act upon Chapter 231 of the Acts of the year 1881 entitled "An Act to Authorize the Town of Beverly to Refund its indebtedness" 3d To choose three or six suitable persons, as the town may determine, as commissioners of its sinking fund as provided in said Chapter 231. One third of the number to be elected for the unexpired terms of one, two and three years respectively. The polls will be closed at three o 'clock in the afternoon unless otherwise ordered by the meeting. 4th To see if the town will adopt a system of sewerage to apply to any part or the whole of the territory of the town and to determine the rate of the assessment to be made upon the owners of the estates embraced in such system. 5th To see if the town will accept and allow of a town way, a way from Hale Street near the estate of Maria Neal to Haskell Street, according to the report of the Selectmen on file in the office of the Town Clerk. 6th To see if the town will accept and allow of a town way, a way from the junction of Wellman and School Streets continuing westerly, thence northerly, thence easterly to the junction of Wellman Street and Webber Avenue, according to the report of the Selectmen on file in the office of the Town Clerk. 7th To see if the town will authorize the Selectmen to sell all the interest the town owns in an undivided lot of land situated at the junction of Hale and West Streets - as per petition of Josiah A. Haskell and others. 8th To see if the town will provide a street light at the corner of River and Federal Streets, and also a street light at the corner of Rantoul and Federal Streets - as per petition of George W. Frost and others. Hereof fail not, but make due return of this warrant, with you doings thereon, before the time of holding said meeting. Beverly, June 29, A.D. 1881 Pursuant to the foregoing warrant I have notified the persons therein named, as therein directed, by posting notifications stating the time, place, and objects of said meeting at each of the several places in town required by the Town Regulations. Lovett, Town Clerk At a legal meeting of the qualified voters of the town of Beverly, held, in pursuance of the warrant recorded above, at the Town Hall in said town on Wednesday the sixth day of July in the year one thousand eight hundred and eighty one at thirty minutes past one o'clock in the afternoon, the Meeting having been called to order at the time appointed by the Clerk, who read the warrant therefor, it was Voted by ballot, unanimously, that Freeborn W. Cressy be Moderator. Upon Article 2. Act to refund Indebtedness. Chapter two hundred and thirty one of the Acts of the Legislature of Massachusetts for the year eighteen hundred and eighty one having been read, upon motion of Joseph Wilson it was. Voted, unanimously, that said Act be accepted. Upon Article 3. Commissioners of the Sinking Fund Upon motion of John H. Young it was Voted that the Board of Commissioners of the Sinking Fund consist of three persons. The polls were then opened and were closed at three o 'clock in the afternoon and the ballots received were assorted and counted and the Moderator declared the following persons elected, by ballot, as Commissioners of the Sinking Fund For the Unexpired Term of One Year, Robert R. Endicott For the Unexpired Term of Two Years, Albert Perry For the Unexpired Term of Three Years, Thomas A. Lefavour Upon motion of Robert R. Endicott it was Voted that one thousand dollars be appropriated to pay the expense of issuing the bonds provided for in the act accepted as above. Upon Article 4. Sewerage Upon motion of Robert R. Endicott it was Voted that this article be referred to the Selectmen with instructions to them to report fully at the next annual town meeting. Upon Article 5. Everett Street A report of the Selectmen laying out as a town way a way from Hale Street near the estate of Maria Neal to Haskell Street was read and is as follows, viz; "Upon petition of C. F. Wentworth and others for a town way, the Selectmen of the town of Beverly having notified, met, and heard the parties interested who wished to be heard did proceed to layout a town way in said town as follows, viz; Beginning at a bounds on Hale Street by land of Maria Neal thence running North twenty eight degrees West by land of said Neal and by land of Watson and Wentworth six hundred and Twenty five (625) feet to land of Davis, thence running North thirty six degrees West by land of said Davis and by land of Haven five hundred and ninety six (596) feet to Haskell Street. Said described line being the easterly line of a private way now known as Everett Street. Laying said town way forty feet wide westerly of said described line. And we award damages as follows, viz; To Elizabeth Ober, five dollars, To Eliza Woodberry, five dollars And we award damages to no other person. And we have named this way Everett Street Beverly, June 27, A.D. 1881 Upon motion of Josiah A. Haskell it was Voted that said report be accepted and that the way be laid out and established as a town way forever according to said report. Upon Article 6. (Extension of School St. and Webber Avenue) A report of the Selectmen laying out a town way was read and a motion that "said report be accepted and the way laid out and established as a town way in accordance therewith" was put to the meeting and lost. Later in the meeting, after action had been taken upon Article 8th a motion to reconsider the above vote was made and it was Voted to reconsider the above mentioned vote before the meeting it was Voted that the report of the Selectmen laying out town way be accepted and that the way be laid out and established as a town way forever according to said report, which is as follows, viz.; "Upon petition of William H. Allen and others for a town way, the Selectmen of the town of Beverly having notified, met and heard the parties interested who wished to be heard did proceed to lay out a town way in said town as follows, viz.; Beginning at a bounds at the southwesterly corner of School and Wellman Streets thence running North seventy six degrees forty five minutes West by the southerly side of a private way known as School Street and across a private way known as Porter Street three hundred and eight one (381) feet to land of Benjamin Webber, thence North eleven degrees forty five minutes East by the easterly side of said private way known as Porter Street seventy eight (78) feet thence North five degrees thirty minutes West by said way fifty three (53) feet, thence North sixty eight degrees fifteen minutes East across said private way known as Porter Street and by the northerly side of a private way known as Webber Avenue three hundred and twenty five (325 ) feet to a way known as Wellman Street. Beginning again at a bounds at the northwesterly corner of School and Wellman Streets North six degrees East and forty three (43) feet distant from the bounds first mentioned in the foregoing described line thence running north seventy seven degrees West by the northerly side of a private way known as School Street three hundred and thirty three (333) feet to a private way known as Porter Street thence by the easterly side of said private way North eleven degrees forty fine minutes East sixty four and one half (64 1/2) feet to a private way known as Webber Avenue thence North sixty seven degrees East by the southerly side of the said private way known as Webber Avenue two hundred and seventy (270) feet to a way known as Wellman Street to a bounds forty five feet southerly from the terminal of the first described lines, laying out as a town way all the land lying within the above described lines which is now known as a portion of School and Porter Streets and Webber Avenue. And we award damages to no person. Beverly, June 25, A.D. 1881 Joseph Wilson Selectmen J. H. Young of Freeborn W. Cressy Beverly" Voted that two hundred and twenty five dollars be appropriated to defray the expense of building Everett Street and five hundred dollars be appropriated to defray the expense of building the portions of School and Porter Streets and Webber Avenue which have been accepted at this meeting. Upon Article 7. (Land at junction of Hale and West Streets) Upon motion of Josiah A. Haskell as amended by Daniel Foster it was Voted that the Selectmen be authorized to sell the interest the town owns in an undivided lot of land at the junction of Hale and West Streets, under and adjoining the Perseverance Hose House, whenever it appears to them to be for the interest of the town to do so or to buy the interest of the other owners of said land if in the opinion of the Selectmen it is advisable. Upon Article 8. Street Lights. Upon motion of George S. Millett it was Voted that the prayer of the petitioners be granted and that the Selectmen cause the lights asked for to be established and maintained. It was Voted that seventy five dollars be appropriated to defray the expense of establishing and maintaining the lights as above mentioned. Upon motion of Joseph Wilson it was Voted that the Treasurer be authorized with the approval of the Selectmen, to hire upon the credit of the town in anticipation of the taxes of the year one thousand eight hundred and eighty two the sum of Eighteen Hundred dollars to pay for the several appropriations made for issuing bonds, constructing the streets and establishing and maintaining the lights as voted by the town at this meeting.
