1881-03-07Commonwealth of Massachusetts Essex, ss. To either of the Constables of the Town of Beverly, in said County: Greeting You are hereby directed to notify and warn, in the manner prescribed by the regulations of the town, the qualified voters of said town, to meet at the Town Hall, in said Beverly, on Monday, the seventh day of March next, at fifteen minutes past eight o'clock before noon, for the following purposes, viz: 1st. To choose a Moderator and Town Clerk. 2d. To act on the reports of the several Boards of Town Officers. 3d. To choose Town Officers for the ensuing year, determining their number and fixing the compensation thereof. The ballots for the above officers will be received on one piece of paper. The ballots of women for School Committee will be received in a separate box. The polls will be closed at two o'clock in the afternoon unless otherwise ordered by the meeting. 4th. To act on the question of an appropriation for the expenses of Memorial Day under the direction of Post 89, of Massachusetts Grand Army of the Republic. 5th. To see if the town will purchase a steam fire engine and act and do anything in regard to the same as necessary-as per petition of L. K. Goodhue and others. 6th. To see what action the town will take in regard to the proposition of George H. Forman for supplying the town with water for a term of years. 7th. To see what action the town will take towards increasing the supply of water in that section of the town called Beverly Farms. 8th. To see if the town will extend the water pipe on Neptune Street. 9th. To see if the town will extend the water pipe through River Street and complete the circuit-as per petition of J. F. Appleton and others. 10th. To see if the town will extend the water pipe through the upper portion of Balch Street from Cabot Street to the residence of J. W. Raymond-as per petition of J. W. Raymond and others. 11th. To see if the town will extend the water pipe to the premises of Charles S. Dennis on Prospect Street-as per petition of Charles S. Dennis and others. 12th. To see if the town will provide a drinking fountain near Chapman's Corner, so called-as per petition of D. A. Sinclair and others. 13th. To see if the town will build a sewer on Park Street, with such connections therewith from other streets as will permit drainage to the manufactories and other interests in that part of the town, upon such terms as maybe lawfully determined-as per petition of E. B. Rogers and others. 14th. To see if the town will set edge stones on the sidewalk in front of the building known as the Lefavour Block on Cabot Street, and crossing stones at the junction of Cabot and Vestry Streets-as per petition of Israel Lefavour and others. 15th. To see if the town will provide a street light on Mark A. Woodbury's shoe factory at the corner of Park and Pleasant Streets as per petition of Cornelius Murphy and others. 16th. To see if the town will reduce the size of the Memorial lot and also to see what action the town will take to provide additional accommodations for burial purposes. 17th. To see what action the town will take in regard to money deposited for the care of burial lots. 18th. To see what disposition the town will make of the dog tax. 19th. To see whether the town will, by its vote or otherwise, ask the Legislature to extend to women who are citizens, the right to hold Town offices and to vote in Town affairs on the same terms as male citizens as per petition of John. I. Baker and others. 20th. To see if the town will forbid the letting or use of the Town Hall except upon the condition that the parties thus hiring or using said Hall or those whom they represent shall not be permitted to use the said Hall in carrying on or permitting therein any practices or conduct in violation of the laws of the Commonwealth-as per petition of Robert R. Endicott and others. 21st. To adopt such measures, grant such sums of money, and take such action in regard to schools and school houses throughout the town as may be deemed expedient. 22d. To see if the town will authorize any one to represent the town in any suits or claims against the town for damages. 23d. To adopt such measures, grant such sums of money, and make such regulations in regard to repairs and improvement of the highways throughout the town as may be determined upon. 24th. To grant such sums of money to be raised and assessed upon the polls and estates within the town for the expenses of the current year, as may be deemed expedient, and make all necessary regulations and allowances respecting the same. Also, to authorize the Town Treasurer to borrow on the credit of the town, such sums of money, as may be necessary, from time to time to meet the liabilities of the town and to provide State Aid for the families of volunteers. 25th. To see what action the town will take in regard to building one or more Receiving-tombs. 26th. To see if the Town will accept the Jury list, as revised by the Selectmen. Hereof fail not, but make due return of this warrant with your doings thereon, before the time of holding said meeting. At a legal meeting of the qualified voters of the Town of Beverly, held, in pursuance of the warrant recorded on the three next preceding pages, at the Town Hall in said Town on Monday the seventh day of March in the year One Thousand Eight Hundred and Eighty one at fifteen minutes past eight o'clock A.M., and by adjournment on Tuesday the eighth day of said month at nine o'clock A.M. and by adjournment on Wednesday the ninth day of said month at seven o 'clock P .M., the Meeting having been called to order, at the time appointed, by the Clerk, who read the warrant therefor it was Voted by ballot, unanimously, that Freeborn W. Cressy be Moderator Prayer was then offered by Rev. Ellery C. Butler of the First Parish Church. Voted by ballot, unanimously, that William H. Lovett be Town Clerk. Then in open Town Meeting, immediately after the election of Town Clerk William H. Lovett above named was sworn to the faithful discharge of his duties as Town Clerk of Beverly. Before me Freeborn W. Cressy Moderator Upon Article 2 Reports of Town Officers Upon motion of Joseph E. Ober it was Voted that further consideration of this article be postponed until after action upon Article 3. Upon Article 3 Election of Town Officers Upon motion of Robert R. Endicott it was Voted that the Selectmen, Assessors, Overseers of the Poor, Collector of Taxes, Town Treasurer, Chief of Police, School Committee for Three Years, Trustees of the Public Library for Five Years and Constables be voted for on one ballot and on one piece of paper. A motion of Andrew E. Story that the Boards of Selectmen and Assessors consist of five members each and a motion of Francis J. Crowell that the Board of Selectmen consist of five members were each put to the meeting and lost. It was Voted that when this meeting adjourns that it adjourn to meet at this Hall, tomorrow, Tuesday at nine o'clock A.M. Albert Perry and Josiah A. Haskell were appointed by the Moderator to assist in assorting and counting the ballots received. The polls were closed at two o 'clock P .M. and the ballots received were assorted and counted and the Moderator declared the following persons elected, by ballot, to the several offices named. Herrick After the declaration of the result of the ballot it was Voted to adjourn and the Moderator declared the meeting adjourned till Tuesday, March 8, at nine o'clock A.M. (Time 8:10 P.M) On Tuesday March 8 at nine o'clock A.M. the voters again assembled according to adjournment and were called to order by the Moderator and proceeded with the business of the meeting. Upon motion of John I. Baker it was Voted to indefinitely postpone the choice of a Board of Health. Upon motion of Joseph E. Ober it was Voted that the Moderator appoint a committee of one from each highway ward, to call a meeting of the voters of each ward to meet separately, to nominate a Surveyor for such ward, to be reported to this meeting, and that we adjourn at 11 ½ o'clock that forenoon to one o'clock this afternoon to give opportunity for such nominations. The Moderator appointed this Committee as follows: for Ward 1, Wm. W. Hinkley, Ward 2, Philip Hammond, Ward 3, Issacher T. Eldredge, Ward 4 Joseph E. Ober, Ward 5 Isaac Standley, Ward 6 Andrew Dodge, Ward 7, A. B. Lord, Ward 8, Hugh Hill, Ward 9 Jonathan Dodge, Ward 10 Eli C. Glines, Ward 11 Benj. V. Giles, Ward 12 Benj. D. Grant, Ward 13 Henry W. Lee Voted that the pay of all Town Officers be the same as that of last year. Article 2 was then presented to the meeting and the Reports of the Selectmen, in which was included the Report of the Board of Health, was read and accepted. It was Voted that where abutters will pave their sidewalk with brick or concrete the Selectmen be authorized to furnish edge stones and that a sum not exceeding five hundred dollars be appropriated for the purpose. The Report of the Overseers of the Poor was read and accepted and it was Voted that the Overseers of the Poor be instructed to take such action in the case of Anna W. Stickney as will secure to the town whatever may be due her from the estate of Joseph L. Woodbury 2d. The Report of the Engineers of the Fire Department was read and accepted and it was Voted that the sum of three hundred dollars be raised and appropriated to paint the engine houses throughout the town. The Reports of the Trustees of the Public Library and of the Trustees of the Sinking Fund were read and together with the printed reports of the Auditor and School Committee were each severally presented to the Meeting and all were accepted. Upon Article 4. Appropriation for Memorial Day Voted that the sum of One Hundred and Fifty dollars be appropriated and assessed for the expenses of Memorial Day in decorating the Soldiers' Graves, to be expended under the direction of Post 89 of the Grand Army of the Republic. Upon Article 5 Steam Fire Engine Upon motion of Josiah A. Haskell it was voted that the Board of Engineers be authorized to purchase a new steam fire engine and that Four Thousand dollars be appropriated and assessed for this purpose. (304 to 235) Upon Article 6. George H. Norman's proposition This article having been stated to the meeting it was ascertained that the time had arrived at which it had been previously voted to adjourn and it was. Voted to adjourn At one o'clock this Tuesday afternoon March 8, A.D. 1881 the voters again assembled agreeably to the adjournment and proceeded with the business of the meeting. Upon Article 6 A motion was made by John I. Baker which is recorded below. A motion offered by Robert R. Endicott to refer the whole of Mr. Baker's motion to a committee consisting of the Selectmen and Messrs. John Pickett, Augustus N. Clark, Albert Perry and Austin D. Kilham was lost. A motion offered by Francis J. Crowell to amend Mr. Baker's motion by striking out the words "according to the proposition of Mr. George H. Norman" was lost. (221 to 307) It Was Voted that Mr. Baker' s motion be divided and each part be acted upon separately. Upon the first part of the motion it was. Voted that the Selectmen be authorized to petition the Legislature for such authority as will authorize the taking of water from Wenham Lake for our direct water supply, and for taking lands for reservoirs and the other necessary works therefor, according to the proposition of Mr. George H. Norman. Upon the second part of the motion it was Voted that the Selectmen be instructed to further investigate the proposition of Mr. George H. Norman and all other matters relating to an independent supply of water and report at the adjournment of this meeting. The Committee appointed by the Moderator for the purpose of procuring a list of nominees for Surveyors of Highways (see page 220) reported and it was Voted by hand vote that the following persons be Surveyors of Highways of the respective wards the present year. Upon Article 8. Water Pipe, Neptune Street Upon motion of John I. Baker it was Voted that the Selectmen be authorized to make the necessary extensions of water pipe on Neptune Street. Upon Article 9 Water Pipe, River Street Upon motion of Joseph F. Appleton it was Voted that the Selectmen be directed to lay the water pipe on River Street as requested by the petitioners. Upon Article 10. Water Pipe, Balch Street Upon motion of William A. Friend it was Voted that the prayer of the petitioners be granted and that the water pipe be extended as requested. Upon Article 12. Drinking Fountain near Chapman's Corner Upon motion of William A. Teague it was Voted that the prayer of the petitioners be granted and that the drinking fountain be established. Upon Article 13. Sewer, Park Street A motion that this article be indefinitely postponed was lost. Upon motion of John I. Baker it was Voted that the subject of this article be referred to the Selectmen and that they report at the adjournment of this meeting in April. Upon Article 14. Edge and Crossing Stones Upon motion of John I. Baker it was Voted that when Mr. Lefavour paves with brick the sidewalk in front of the building known as the Lefavour block, the Selectmen be authorized to place crossing stones at the head of Vestry Street. That portion of this article which relates to the setting of edge stones having been provided for by a vote of this meeting no action was taken therein. Upon Article 15. Street Light. Upon motion of Cornelius Murphy it was Voted that the prayer of the petitioners be granted and that the Selectmen cause the light asked for to be established and maintained. Upon Article 16. Memorial Lot. Upon motion of Charles C. Foster it was Voted that action on the subject of the Memorial Lot be indefinitely postponed. Upon motion of John I. Baker it was Voted to refer the subject of the remainder of this Article to the Selectmen and that they report at the adjournment of this meeting in April as to what is necessary and advisable in the matter. Upon Article 17. Money deposited for care of Burial lots. Upon motion of William W. Hinkley it was voted to refer the subject of this article to the Selectmen with instructions for them to prepare the By laws necessary and report the same at the adjournment of this meeting in April. Upon Article 18. Dog Tax. Upon motion of Henry E. Woodberry it was Voted that all money received from the County Treasurer on account of Dog Licenses be appropriated for the use of the Schools. Upon Article 19. Women to vote in Town Affairs, etc. Upon motion of William A. Friend it was Voted that all action on the subject of this Article be indefinitely postponed. Upon Article 20. Use of Town Hall. Upon motion of Charles C. Foster it was Voted that all action on the subject of this Article be indefinitely postponed. (254 to 193) It Was Voted that when this meeting adjourns that it adjourn to meet at this Hall tomorrow, Wednesday evening at seven o'clock. Voted to now adjourn (Time 6:00 P.M.) At seven o'clock this Wednesday evening March 9, A.D. 1881 the voters again assembled agreeably to the adjournment and proceeded with the business of the meeting. Upon Article 21. Schools Upon motion of John I. Baker it was Voted that Eighteen Thousand dollars be appropriated and assessed for the support of schools the present year. Upon Article 22. Suits for Damages. Upon motion of John I. Baker it was Voted that the Selectmen, if any suits occur at intervals between the annual meetings, be hereby authorized to represent the Town in all such suits and claims against the Town for damages. Upon Article 23. Highways. A motion offered by Jeremiah Horigan that Ten Thousand dollars be appropriated for highway expenses the present year - was lost. Upon motion of Joseph Wilson it was Voted that Seven Thousand Seven Hundred Ninety and forty seen one hundredths ($7790.47) dollars be appropriated and assessed for the expenses of the Highway Department the current year. Upon motion of Perry Collier it was Voted that the Selectmen be authorized to place crossing stones on Cabot Street at the head of Broadway. Upon motion of John I. Baker it was Voted that the Selectmen be authorized to place crossing stones across Rantoul Street in continuation of the northerly sidewalk on Broadway. Upon Article 24. Money Grant. Upon motion of Robert R. Endicott it was Voted that a Committee of two be appointed by the Moderator to confer with the Town Treasurer concerning refunding the Town Debt as far as practicable at a lower rate of interest, and that the Treasurer is hereby authorized to refund the same if in this judgment it can be done for the best interests of the town. Robert R. Endicott and Thomas A. Lefavour were appointed as this committee. Upon motion of John I. Baker it was Voted to postpone further consideration of the subject of this Article until the adjournment of this meeting in April. Upon article 25. Receiving Tombs. Upon motion of Josiah A. Haskell it was Voted that the subject of this Article be referred to the Board of Health with instructions to report at the adjournment of this meeting in April in regard to the condition of affairs in the matter of receiving tombs in each Cemetery. Upon Article 26. Jury List. It was Voted to strike out the name of Charles L. Moulton and to insert the name of Frank W. Ober. A motion offered by William A. Teague to strike out the name of Charles T. Lovett was lost. A motion offered by Charles L. Moulton to insert the name of William A. Teague was lost. It was Voted to accept the Jury List as amended. This List is recorded on page 229. Upon motion of John I. Ober it was Voted that when this meeting adjourns that it adjourn to meet at this Hall on the first Monday in April at seven o'clock in the afternoon. A motion was offered by Samuel F. Ober that Bass River Lodge of Odd Fellows be allowed to hold a Fair in the Town Hall commencing March 23 and continuing one week. As objections were made to the consideration of this motion it was decided by the Moderator to be out of order as there was no article in the warrant for the same and it could not be entertained except by general consent. A motion to adjourn was lost. A motion offered by Andrew E. Story that the vote upon Article 20 be reconsidered was lost. An appeal was made by Josiah A. Haskell from the decision of the Moderator on the motion of Samuel F. Ober (as above) and the Moderator was not sustained by the meeting in his decision. Upon motion of Charles C. Foster it was Voted that the Selectmen be instructed to let the Town Hall to the Odd Fellows or any other organization for fairs or other similar purposes. Voted that this meeting now adjourn.
