1880-03-01Commonwealth of Massachusetts Essex, ss. Pursuant to a Warrant from the Selectmen of the Town of Beverly to me directed, I hereby, in the name of said Commonwealth, notify and warn the qualified voters of said town, to meet at the Town Hall in said town, on Monday, the First day of March next, at Nine o'clock in the forenoon, for the following purposes, viz. 1st. To choose a Moderator and Town Clerk. 2d. To act on the reports of the several Boards of Town Officers. 3d. To choose Town Officers for the ensuing year, determing their number and fixing the compensation thereof. The ballots for the above officers will be received, on one piece of paper. The ballots of women for School Committee will be received in a separate box. The polls will be closed at four o'clock p.m., unless otherwise ordered by the meeting. 4th. To act on the question of an appropriation for the expenses of Memorial Day under the direction of Post 89 of Mass. Grand Army of the Republic. 5th. To see if the town will indemnify Daniel Foster 2d for damages to his shoe factory estate; at the corner of 64 Rantoul Street and Railroad Avenue, caused by raising the grade of Rantoul Street--as per his petition. 6th. To see if the town will provide a street light on Hale Street, near Ocean Street; and also a street light on Hale Street, near the corner of Dane Street--as per petition of O. F. Swasey and others. 7th. To see if the town will provide a street light on Abbott Street, at the corner of Lovett Street -as per petition of C. W. Stickney and others. 8th. To see if the town will provide a street light on Pleasant Street, at Phillips Court, so called; and a street light near the horse railroad turnout, by Mr. Sullivan's store, near Beverly Bridge-- as per petition of Perry Collier and others. 9th. To see if the town will approve and allow of a town way, in extension of Stone Street, from Bartlett Street to Lothrop Street, according to a report of the Selectmen on file with the Town Clerk: 10th. To see if the town will approve and allow of a town way of the way now known as Webber Avenue, extending from River Street into the way heretofore known as Wellman Street, and by said Wellman Street to School Street, according to a report of the Selectmen on file with the Town Clerk. 1 lth. To see if the town will approve and allow of a town way the way known as Congress Street, extending from Wellman Street to Porter Street, according to a report of the Selectmen on file with the Town Clerk. 12th. To see if the town will authorize the Selectmen to expend a sum of money on Park Street, between Federal Street and Creek Street, sufficient to make said portion of Park Street in a condition suitable for ordinary travel--as per petition of john F. Carter. 13th. To see if the town will vote to cause the abutters on Cabot Street, between Elliott Street and the Beverly Bridge and such other streets as the town may select, to remove the snow and ice, as per the Sidewalk Act of 1863, Chap. 114, and Chap. 45, Sections 7 and 8 of the General Statutes--per petition of B. C. Butler and others. 14th. To see if the town will provide better school accommodations for Dodge's Row and vicinity, by building a new school house or otherwise--as per petition of Thomas H. Dunham, Jr., and others. 15th. To see if the town will appropriate a sufficient sum of money to extend the stage at the Town Hall and finish ante-rooms adjoining it--as per petition of George Swan and others. 16th. To see if the town will reduce the size of the Memorial lot. 17th. To see if the town will purchase a new hearse and appropriate money therefor. 18th. To see what disposition the town will make of the dog tax. 19th. To adopt such measures, grant such sums of money, and take such action in regard to schools and school-houses throughout the town as may be deemed expedient. 20th. To adopt such measures, grant such sums of money, and make such regulations in regard to repairs and improvement of the highways throughout the town as may be determined upon. 21st. To grant such sums of money to be raised and assessed upon the polls and estates within the town, for the expenses of the current year, as may be deemed expedient, and make all necessary regulations and allowances respecting the same. Also, to authorize the Town Treasurer to borrow, on the credit of the town, such sums of money as may be necessary, from time to time to meet the liabilities of the town and to provide State Aid for the families of Volunteers. 22d. To see if the town will accept the Jury List, as revised by the Selectmen. Hereof fail not, but make due return of this warrant, with your doings thereon, before the time of holding said meeting. Lovett, Town Clerk At a legal meeting of the qualified voters of the Town of Beverly held, in pursuance of the warrant recorded on the three next preceding pages, at the Town Hall in said Town on Monday the First day of March in the year One Thousand Eight Hundred and Eighty at nine o'clock A.M., and by adjournment on Tuesday the Second day of said Month, the Meeting having been called to order, at the time appointed, by the Clerk, who read the warrant therefor it was Voted by ballot, unanimously, that Freeborn W. Cressy be Moderator Prayer was then offered by Rev. William H. Davis of the Washington St. Church. Voted by ballot, unanimously, that William H. Lovett be Town Clerk. Then in open Town Meeting, immediately after the election of Town Clerk William H. Lovett abovenamed was sworn to the faithful discharge of his duties as Town Clerk of Beverly. Before me Freeborn W. Cressy Moderator Upon Article 2 Reports of Town Officers Upon motion of Robert R. Endicott it was Voted to lay Article 2 on the table. Upon Article 3 Election of Town Officers. Upon motion of Robert R. Endicott it was Voted that the Boards of Selectmen, Assessors, and Overseers of the Poor consist of three members each. Upon motion of John I. Baker it was voted that the ballots of women for School Committee be received in a separate box. Upon motion of John I. Baker it was Voted that the Selectmen, Assessors, Overseers of the Poor, Collector of Taxes, Town Treasurer, Chief of Police, School Committee, Trustees of the Public Library and Constables be voted for on one ballot and on one piece of paper. Albert Perry and Josiah A. Haskell were appointed by the Moderator to assist in assorting and counting the ballots received and were duly sworn to the faithful discharge of their duties as above by Wm. H. Lovett, Justice of the Peace. The polls were closed at four o'clock P.M. and the ballots received were assorted and counted and the Moderator declared the following persons elected by ballot to the several offices named. On Tuesday March 2 at nine o'clock A.M. the voters again assembled, according to adjournment and were called to order by the Moderator and proceeded with the business of the meeting. Upon motion of John I. Baker it was Voted to choose the remaining Town Officers by hand vote. Voted to indefinitely postpone the choice of a Board of Health. Ober it was Voted that the Moderator appoint a committee of one from such highway ward to call the voters together for the purpose of nominating Surveyors to be voted for by the Meeting. Appropriation for Memorial Day Voted that the sum of One hundred and Fifty dollars be appropriated and assessed for the expenses of Memorial Day in decorating the Soldiers' Graves, to be expended under the direction of Post 89 of the Grand Army of the Republic. Upon Article 5. Damages to David Foster 2d Upon motion of John I. Baker it was Voted that the Selectmen be authorized to settle with Mr. Foster in a sum not exceeding Three Hundred Dollars. Upon Article 6. Street Lights on Hale Street Upon motion of George S. Millett it was Voted that the prayer of the petitioners be granted and that the Selectmen cause the lights asked for to be established and maintained. Upon Article 7. Street Light on Abbott Street Upon motion of John I. Baker it was Voted that the prayer of the petitioners be granted and that the Selectmen cause the lights asked for to be established and maintained. Upon Article 8. Street Lights on Pleasant and Cabot Streets. Upon motion of William W. Hinkley it was Voted that each of the lights asked for by the petitioners be voted for separately and it was Voted the action on the street light petitioned for to be established on Pleasant Street be indefinitely postponed. Upon motion of Edward F. Danforth it was Voted that the prayer of the petitioners as far as it relates to the establishing a street light on Cabot Street near the Horse Railroad turnout near Beverly Bridge, be granted and that the Selectmen cause a light to be established and maintained at that place. Upon Article 9. Extension of Stone Street. The report of the Selectmen was read and a motion was made that the report be accepted and the way established as a town way according to said report, which motion was put to the meeting and lost. After the consideration of Article 12 of the Warrant a motion to reconsider the above vote was made and it was. Voted to accept this motion to reconsider. It was then Voted that the report of the Selectmen laying out the extension of Stone Street from Bartlett Street to Lothrop Street be accepted and said way established as a town way forever according to said report, which is as follows; "Upon the petition of Charles Haddock and others, the Selectmen of the town of Beverly having notified, met, and heard the parties interested, did proceed to lay out a town way in said town as follows: Beginning at a bounds on Lothrop Street, thence running North eighteen degrees thirty minutes, West by land of David Crowell, twenty feet to a bounds; thence turning and running North forty nine degrees forty five minutes West by land of said Crowell, Gardner Haskell, Israel Foster, Edward C. Butler, and John Pickett six hundred and seventeen feet to a bounds on Bartlett Street making said line the southwesterly line of a way known as East Stone Street. Beginning again at a bounds on Lothrop Street sixty feet easterly from the bounds first mentioned, thence running North forty nine degrees forty five minutes west by land of David Crowell, Alden C. Stevens, John Pickett, and Heirs of Abram T. Doyle six hundred and sixty nine feet to a bounds, on Bartlett Street forty and one half feet Northeasterly from the bounds on the Southeasterly side of said way. Laying out the premises lying between the above described lines as a town way. And we award damages to the Heirs of Abram T. Doyle in the sum of ninety five dollars $95.00 and we award damages to no other person." Beverly, Feb. 21, 1880 Joseph Wilson Selectmen J. H. Young of Freeborn W. Cressy Beverly Upon Article 10 Webber Avenue and Wellman Street The report of the Selectmen laying out said way was read and a motion that said "report be accepted and the way laid out and established as a town way in accordance therewith" was put to the meeting and lost. Later in the meeting, after the extension of Stone Street had been accepted and established as a town way, as recorded above, a motion to reconsider the above vote was made and it was Voted to accept this motion to reconsider Upon the question then brought before the Meeting it was Voted "that the report of the Selectmen laying out a town way be accepted and said way established as a town way forever according to said report." which is as follows;- "Upon the petition of Jeremiah Harrigan and others, the Selectmen of the Town of Beverly having notified, met and heard the parties interested, did proceed to lay out a town way in said town as follows; Beginning at a bounds at the comer of School and Williams Streets thence running North Fourteen degrees thirtyminutes West over land of Patrick Buckley and Edward Brown three hundred and twenty three to a bounds at the north side of Webber Avenue laying said town way forty five feet wide westerly of said described line. Beginning again at said bounds at the North Side of Webber Avenue and running North sixty seven degrees East by land of Benjamin Webber, Daniel Linehan, Jeremiah Harrigan, and Rosabella Lamson four hundred and sixty feet to River Street. Laying said town way fifty feet wide southeasterly of said described line. And we award damages to no person." Beverly, Febmary 21, 1880 Joseph Wilson Selectmen J. H. Young of Freeborn Cressy Beverly Upon Article 11 Congress Street The report of the Selectmen laying out the way known as Congress Street was read and accepted and it was Voted that said way be laid out and established as a town way forever according to said report which is as follows "Upon the petition of William H. Allen and others, the Selectmen of the town of Beverly having notified, met and heard the parties interested, did proceed to lay out a town way in said town as follows; Beginning at a bounds at the corner of Wellman Street on the Northerly side of a way known as Congress Street, thence running South eighty six degrees West, by Land of Benjamin Webber one hundred and fifty four feet, thence turning and running South eighty five degrees West over land of Benjamin Webber, Nancy Bailey and said Webber one hundred and forty five feet to a bounds at the corner of Porter Street making said line the northerly line of said way. Beginning again at a bounds thirty five feet southerly of the bounds first mentioned at the corner of Wellman Street, thence running North seventy nine degrees West by land of Annie David and Nettie Davis, seventeen feet, thence tuming and running South eighty five degrees West by land of said Davises and land of William Towhig and Allen one hundred and ninety five feet, thence turning and running south eighty three degrees west eighty three feet, to a bounds on a line in continuation of a line on the easterly side of Porter Street and thirty five feet southerly from the northerly side of said way. Laying out the premises lying between the above described lines as a town way. And to William Towhig we award damages in the sum of twenty five dollars. $25.00 and we award damages to no other person." Beverly, February 21, 1880 Joseph Wilson Selectmen J. H. Cressy Beverly Upon Article 12 Park Street Upon motion of Perry Collier it was Voted that the prayer of the petitioner be granted and that the Selectmen be authorized to expend an amount sufficient in their discretion to put said portion of Park Street between Federal Street and Creek Street, in a condition suitable for ordinary travel. Upon Article 13. Sidewalk Act Upon motion of F. W. Choate it was Voted that action on all matters pertaining to this article be indefinitely postponed. Upon Article 14. Dodge' s Row School House. Upon motion of Joseph E. Ober it was Voted that the subject of this Article be referred to the School Committee, for them to report upon at the adjournment of this meeting in April. Upon Article 15 Town Hall Stage Upon motion of William A. Teague it was Voted that action on all matters pertaining to this article be indefinitely postponed. A motion of Perry Collier to reconsider the above vote was put to the meeting and lost Upon Article 16 Memorial Lot Upon motion of John I. Baker it was Voted that action on the subject of the Article be indefinitely postponed. Upon Article 17. Hearse A motion made by Joseph E. Ober, that "action on the subject of this Article be indefinitely postponed," was put to the Meeting and lost. Upon motion of Perry Collier it was Voted that the Selectmen be instructed to procure a Hearse at a cost not exceeding six hundred dollars. Upon Article 18. Dog Tax Upon motion of John I. Baker it was Voted that all money received from the County Treasurer on account of Dog Licenses be appropriated for the use of the Schools. Upon Article 19. Schools Upon motion of F. W. Choate it was Voted that Seventeen Thousand dollars be appropriated and assessed for the support of schools the present year. Upon Article 20 Highways Upon motion of Joseph Wilson it was Voted that Seven Thousand dollars be appropriated and assessed for the expenses of the highway Department the current year. Upon motion of William W. Hinkley it was Voted that when the meeting adjourns, it adjourn to meet at this place at half past one o'clock this aftemoon. Upon motion of Jeremiah Murphy it was Voted "That the Surveyors of Highways for the fifteen wards give every tax payer in the Town in their different or respective wards the privilege of working out his Highway tax or their respective proportion of the amount raised for highways." It was Voted that Article 2 be taken from the table and the reports of the Selectmen, Overseers of the Poor, Engineers of the Fire Department, Trustees of the Public Library and Trustees of the Sinking Fund were then read and together with the printed reports of the Auditor and School Committee were each severally presented to Meeting and all were accepted. Upon motion of John I. Baker it was Voted "that the Selectmen, if any suits occur at intervals between the annual meetings, be hereby authorized to represent the Town in all such suits and claims against the Town for damages. Upon motion of Josiah A. Haskell it was Voted that the town authorize the Board of Engineers to purchase one thousand feet of rubber lined cotton hose and one thousand feet of linen hose as recommended by the Board of Engineers and that the sum of eight hundred dollars be appropriated and assessed for the expenses of the Fire Department the present year in addition to the forty five hundred dollars estimate by the Selectmen for that purpose. Upon motion of Josiah A. Haskell it was Voted that the Board of Engineers be authorized to purchase a Bangor ladder and that the sum of one hundred and fifty dollars be appropriated and assessed for that purpose. Upon motion of Josiah A. Haskell it was Voted that the town locate Hydrants as recommended by the Board of Engineers and that the sum of three hundred dollars be appropriated and assessed for that purpose. The location of Hydrants recommended by the Board of Engineers is as follows: one at the comer of River and Federal Streets, one at the foot of Brackenbury Lane near Mrs. Sears' Avenue entrance, one near the junction of Prince and Hale Streets, one near the corner of Thissell and Hale Streets and one near the residence of Dr. Hooper on Hale Street at Beverly Farms. Voted to adjourn. At half past one o'clock this Tuesday afternoon March 2, A.D. 1880 the voters again assembled agreeably to the adjournment and proceeded with the business of the meeting. The Committee appointed by the Moderator for the purpose of procuring a list of nominees for Surveyors of Highway (see page 18) reported and it was Voted by hand vote that the following persons be Surveyors of Highways of the respective wards the present year. A motion of David L. Foster' s that "a list of items of the property taxed be put upon each bill of taxes" was put to the meeting and lost. Upon motion of Joseph Wilson it was Voted that the Collector of Taxes deliver or cause to be delivered at the last and usual place of abode of each inhabitant of the town who may be taxed, or to such inhabitant in person, as soon as practible after the taxes have been assessed, a list of the taxes assessed upon such person, accompanying which list shall be a notice of the time and place where the Collector will be present to receive the taxes, and also a notice of the meetings of the Assessors to determine upon abatements; and interest at the rate of seven per cent per annum shall be charged upon all the taxes not paid on or before the first day of November next which interest shall be added to and considered a part of said taxes, and that so far as practicable the Collector shall on the first day of January next, put in suit all taxes then due and unpaid, commencing with the highest and so on to the lowest tax. Upon motion of Joseph E. Ober it was Voted that the pay of the Collector of Taxes be five eighteenths of one per cent of the amount collected and paid to the Town Treasurer. Upon motion of Joseph Wilson it was Voted that the pay of the Town Treasurer be Three Hundred and Fifty dollars. A motion of Hiram Doane's that "the salary of the Superintendent of Water Works be seven hundred dollars for the ensuing year" was put to the meeting and lost. Upon motion of Robert R. Endicott it was Voted that the salary of the Superintendent of Water Works be the same as that of last year, i.e. One Thousand dollars. Upon motion of Henry E. Dodge it was Voted that the pay for labor on highways the present year be at the rate of twenty cents per hour for each man and twenty cents per hour for each horse and cart. Upon Article 22 Jury List It was Voted that the Jury List as revised by the Selectmen be accepted. It was Voted that when this meeting adjourns, it adjourns to meet at this place on the first Monday in April at one o'clock in the afternoon. Voted that his meeting now adjourn.
