To one of the constables of the town of Beverly. Greeting.
You are hereby required in the name of the Commonwealth, to notify and warn in the usual manner,
the qualified voters of said town, to meet at the Town Hall on Monday the Eleventh day of
September next at Seven o'clock afternoon, for the following purposes. Viz.
1st To decide the manner of choosing a Moderator, and to choose the same.
2d To see what action the town will take in relation to the award of the Commissioners fixing the
compensation to be paid for water by the Town of Beverly to the City of Salem
3d To see if the town will direct the Selectmen to extend the Water Pipe from its terminus in Cross
Street to the estate of Andrew K. Ober.
4th To see if the town will direct the Selectmen to lay the Water Pipe from Hale Street through the
way known as Everett Street, terminating opposite the Avenue of William B. Sewall.
5th To see if the town will discontinue so much of the old town way known as Balch Street as lies
Northerly and Westerly of the track of the Eastem Railroad and Northerly and Easterly of a line
parallel with the southerly line of said way as newly located and fifty feet distant therefrom in front
of land of John Mitchell.
Hereof fail not, but make due return of this warrant with your doings thereon before the time
appointed for said meeting.

therein names as therein directed by posting notifications thereof stating the time, place and objects
of the meeting at each of the several places in the town required by the Town Regulations.

At a meeting of the qualified voters of the town of Beverly held in pursuance of the foregoing
warrant, at the Town Hall in said town on Monday the Eleventh day of September in the year
Eighteen Hundred and Seventy Six at Seven o'clock afternoon, it was
Voted That a moderator be chosen by hand vote
Voted That Freeborn W. Cressy be Moderator
Upon the 2d article of the Warrant
Voted That the consideration of this article be postponed until the remaining articles have been acted
upon.
Upon the 3d article of the Warrant
Voted That the Selectmen be instructed to lay the Water Pipe from its terminus in Cross Street to
the Estate of Andrew K. Ober, at an expense not exceeding three hundred and twenty five dollars.
Upon the 4th article of the Warrant
Voted That the Selectmen be instructed to lay the Water Pipe from Hale Street through the way
known as Everett Street terminating opposite the Avenue of William B. Sewall, at an expense not
exceeding One Hundred & twenty five dollars.
Upon Article 5th of the Warrant
Voted That so much of Balch Street as is specified in this Article in front of the land of John
Mitchell be discontinued.
The 2d Article of the Warrant was then taken up, and the following reports of the Selectmen
thereon was read, and accepted
"The Selectmen have given the matter considerable attention and concluded that we have no
authority to go on and collect the Water Rates without instruction from the town. That while the
Commissioners appointed by the Supreme Court, have fixed the compensation to be paid by the
Inhabitants of Beverly to the City of Salem, for the use of the Water in a gross sum for 5 years to be
paid annually commencing Jan. 1, 1874 and to terminate Dec. 31, 1880. Also fixed the rates for the
water taken (except for mechanical purposes, but there appears to be no provision giving authority
to any one to make the necessary regulations & collections from the Water takers. And we
recommend that a Water Board be chosen at this meeting to take charge of the inspection,
regulations & collections of the Water rates."
On the motion of John I. Baker
Voted That the Selectmen have full power to fix the water rates provided that the rates shall not be
higher than the rates of previous years, and that they have full power in the matter of inspecting and
collecting said water rates, and also full power to regulate the same.
Voted. That this meeting be dissolved.
