Acceptance of Minutes of Previous Meeting Special City Council Meeting, August 21, 2023 A motion to approve was made and seconded. A vote was taken, and the motion carried (9-0). Communications from His Honor the Mayor Order#223-Grant-$24,047.61 from FEMA-FY22 Fire Prevention and safety grant to be used by the fire department to purchase new props to use when delivering public safety messages Referred to Committee on Finance and Property. Motions and Orders Order#182-Councilor Feldman-A proposed ordinance amendment to Section 215-18 "Deliveries" (First vote) Feldman stated she worked with the planning department and solicitor's office on the proposed ordinance. Feldman stated there are some proposed edits to the ordinance. Deliveries made to a store or place of business that holds a common victualler license would be exempt from this. Houseman stated he supports the intent of this and asked about the large grocery stores' typical delivery hours and how this came about. Feldman stated there are other communities that have this in place. There are other hours they can receive deliveries. Feldman stated she would like to protect constituents. Houseman proposed changing the language to add a specific distance of the store from residences, so that it would not apply to businesses that do not abut residential areas and so it would be more tailored. Feldman stated she could take that into further consideration. Flowers paused the discussion for the public hearing. Public Hearings Order 9187-7:15-National Grid-Petition#30706279-Federal Street to install electric conduits The public hearing was opened. Michael Kazadi from National Grid was available for questions. Rotondo asked if there would be digging up of the road to lay lines or if this work would be done through existing utility holes. Kazadi stated there would be additional digging. Rotondo asked if it would be done before the city does paving. Kazadi stated he could find that out. Rand asked if this is for service to the bank. Kazadi confirmed it is. Bowen followed up on what Councilor Rotondo had said and asked what the process would be for making approval conditional. Flowers stated that after closing the public hearing this would go to Committee on Public Services and that would be an opportunity to discuss options. No members of the public wished to speak on the item. The public hearing was closed and the item was referred back to Committee on Public Services. Motions and Orders (Continued) Order#182(Continued)-Councilor Feldman-A proposed ordinance amendment to Section 215- 18 "Deliveries" (First vote) Sweeney stated his main concern is businesses like cafes or restaurants that are geared toward the early morning hours. Bowen stated she would not want to put an ordinance on the books if the intention is to not have it enforced as written. It could create unnecessary confusion. Bowen stated she would like to see either a restriction on distance from a residential unit or not applying to businesses whose open hours preclude deliveries at that time. Feldman stated the way this is written it really only applies to the grocery stores. Feldman stated she does not see any reason to get in the weeds with more details. Public Hearings (Continued) Order#188-7:25pm-National Grid-Petition#29920267-Lovett Street to install electric conduits . The public hearing was opened. Rotondo asked why this petition says Lovett St. when it is for Briscoe Village. Kazadi stated this is for Sohier Road not Lovett. Houseman suggested a specific vote so that it is clear this does not have to do with Lovett Street. No members of the public wished to speak on the item. The public hearing was closed and the item was referred back to Committee on Public Services. Order#179-7:30pm-National Grid-Plan#30782870- Ober Street to install electric conduits The public hearing was opened. Houseman asked if this would require cutting into the pavement. Kazadi stated it will be a trench up the side of the street and sidewalk to the customer's house. Houseman asked what National Grid's obligation is to patch or repave the section. Kazadi stated the trench is usually two to three feet wide.National Grid usually tries to have it repaved the same day or there will be metal coverings on it. Motions and Orders (Continued) Order#182(Continued)-Councilor Feldman-A proposed ordinance amendment to Section 215- 18 "Deliveries" (First vote) St. Hilaire asked about the process tonight. Flowers stated the last meeting was the first reading but there was no vote, so tonight would be the first vote. A motion to approve the first vote was made and seconded. Sweeney asked about receiving and incorporating the revised language Councilor Feldman had mentioned earlier. A motion for a brief recess was made and seconded. A vote was taken, and the motion carried (9- 0). The meeting recessed at 7:38pm. The meeting was called back to order at 7:42pm. City Solicitor Williams stated it could be discussed and acted on or if it would need to be published again. Bowen asked for clarification on the amended language as it related to food service establishments. Williams stated that her understanding is that the intention of this was to prevent a business from receiving deliveries at 3:30 or 4:00am. This change made sense to keep the intention and to achieve that goal. A vote was taken on approving the first vote with the amended language of the ordinance, and the motion carried (7-2, Bowen and Houseman opposed). Order#196-Councilor Rotondo and Councilor Crowley-A request to amend the Downtown Beverly Parking District Ordinance, Section 270-66(B) (1) and Section 270-66 (B) (2) (b)to waive all parking fees for on street parking lot kiosks for our city veterans (First reading) Kent read the order. A motion to approve the first vote was made and seconded. A vote was taken, and the motion carried (9-0). Order#197-Councilor Rotondo-A proposed amendment to the City Ordinance Chapter 270-41 "Prohibited Parking at All Times" on both Greene Street to Livingstone Ave. (First Reading) Kent read the order. Public Hearings (Continued) Order#184-8:00pm-(joint public hearing with Planning Board)-A Proposed Amendments to The Beverly Zoning Ordinance: Accessory Dwelling Unit Ordinance; Definitions Regarding Transient Lodging, Bed and Breakfasts; and Other Minor Clarifications The joint public hearing was called to order. Planning Board members present: Ellen Hutchinson, Sarah Bartley, Derek Beckwith, George Gomes,Nathaniel Lewis, Wayne Miller, Rodney Sinclair Planning Director Darlene Wynne presented the proposed changes. Bowen stated she is excited this has reached this stage and in this form. It is very strong. Bowen stated one of the things that was in a previous draft that is not here is a specific requirement for affordability. These are likely to be naturally affordable to start. Bowen stated she is comfortable with that at this stage but would like to keep the conversation alive. Bowen stated it is positive that the square footage has been reduced and that there are a few other design features that were tightened up. Bowen stated one of the things she would still like to think about before this is passed is the prohibition around a tandem parking spot. Bowen stated she feels that goes a bit too far and would like to see that removed. Bowen stated she is also interested in the bigger picture Beverly City Council Meeting Minutes—September 5,2023 page 4 of 10 question around allowing variances. Bowen said she would like to see that option but it can be revisited at another time if it is a sticking point. Bowen stated she supports how the language around short-term rentals is worded here and asked for a little clarity on that for the public. Wynne stated transient lodging, casually referred to as short-term rental, is currently not allowed in the City of Beverly and language was added to clarify that. Williams confirmed that, by definition in the zoning ordinance, a dwelling cannot be used for transient lodging. Order#189-8:30pm-National Grid-Plan#30708798-Cherry Hill Drive to install electric conduits A motion to recess this public hearing to 9:00pm was made and seconded. A vote was taken, and the motion carried (9-0). Order#184-8:00pm-(joint public hearing with Planning Board)-A Proposed Amendments to The Beverly Zoning Ordinance: Accessory Dwelling Unit Ordinance; Definitions Regarding Transient Lodging, Bed and Breakfasts; and Other Minor Clarifications Bartley asked for more detail on why affordability was not required. Wynne stated the primary rationale was the complexity of managing that for a homeowner. It would require a deed restriction and annual monitoring. The units do tend to be more affordable than other units on the market based on research. Mayor Michael Cahill stated we all understand at this point that this is not about renting a room, this is about building an apartment. There is a real capital cost to the homeowner in order to do this. One of the goals here is to provide an avenue for homeowners to stay in their home longer to help afford the cost of the home. If they're going to need to take out a home equity loan or refinance,which is likely, we don't feel like we can tell them that they can't charge a fair market rate for the unit. Rand spoke of her support for this as a good opportunity to spread out new housing stock around the city. Rand asked for an example of a variance that couldn't be used to create an accessory dwelling unit and commented that she would support the allowance of tandem parking. Rand stated that in some places in California, for example, housing trusts are being used to allow for creation of accessory dwelling units. This proposal has a lot of potential for creating housing in a way that could be low impact. Wynne stated that current parking regulations only allow tandem parking for parking spaces assigned to the same unit. Wynne stated it is to minimize situations where people have a tandem spot,but because it's a nuisance,they park on the street. That accessory dwelling unit needs to have a dedicated off street parking spot dedicated for that unit. Wynne stated a lot of the variances we end up looking at are dimensional things like side yard setback, rear yard setback, front yard setback, and height. A frequent complaint from neighbors is that it is too close or that neighbors can see over into the yard, and those are the kinds of situations we were trying to avoid if there is a property with the house built already to the lot line, and then they want to build an addition, or close to the lot line. Beckwith asked where citizens would appeal decisions of the zoning officer or what that process would be. Beckwith asked about the section of the ordinance where it says one of the dwelling Beverly City Council Meeting Minutes—September S,2023 page 5 of 10 units must be occupied by an owner or individual with a beneficial interest. Williams stated if the building commissioner didn't believe a proposed project was eligible under the ADU ordinance and made that determination,then the applicant would appeal to the zoning board of appeals who would review that determination. If a building commissioner denies a permit for whatever reason, the administrative appeal process next step is the zoning board of appeals. If the zoning board of appeals rules in a fashion the applicant doesn't like then,they have the right to go to court. Williams stated an individual with an interest was added because sometimes properties are held in real estate trusts or LLCs, and a trust or LLC will not occupy the property. It is intended to allow a trustee or beneficiary of the trust to occupy the house or sometimes an LLC owns a home too. St. Hilaire asked what the goals are in terms of new units in ten years. Wynne stated the City is looking at an intake of five to ten a year. Ten is probably high, but it also depends on the market. A 2018 report estimated five permits per municipality per year, so possibly 50 in ten years. Miller stated it is his understanding that ADUs provide dwelling options with relatively low environmental impact ramifications and that he would be interested in reviewing any research supporting that contention if it could be made available. Miller stated he is interested in the environmental impact. Wynne stated a lot of is because they are infill properties that generally require less impact to the actual parcel. They're occurring, in a lot of cases, in existing buildings,which itself is an environmentally sustainable strategy to redevelopment. Things like historic preservation and repurposing existing buildings are environmental strategies. Sweeney expressed support for the proposal and how this will allow for smaller scale development of buildings that already exist into apartments. Sweeney stated he agrees with the mayor on not having the affordability requirement in that we don't want to add additional burdens when these units are more naturally affordable. Sweeney stated he would like the City to look into partial property tax exemptions for those that do build ADUs and meet qualifying affordability requirements. We should look at ways to incentivize affordability. Gomes echoed concerns on the variance point and asked why limit that when it comes to something like an accessory dwelling unit. Gomes asked about requiring a special permit in the RHD or RSD districts and why not let them if they can meet the requirements. Wynne stated the special permit in RHD or RSD came out of the process because they are not naturally single family units. Houseman thanked those who worked on this and commented that the beneficial interest for trusts may be for estate planning purposes. Houseman asked for clarification that all Airbnb and Vrbo type rentals are prohibited under the ordinance. Williams confirmed. Houseman asked about the current definition of a single family. Lewis asked what the purpose is of limiting doors or stairs along the ADU, outside of design standards. Wynne stated that the notion was continuing the theme that these are secondary uses to the primary use of the house. Stairs are an aesthetic piece; the idea is that kind of activation and movement through the house should be on the inside of the house rather than the outside. Feldman expressed her support for the ADU ordinance. Hutchinson spoke in support of this. There needs to be a bit of a balancing act here. Hutchinson expressed concerns about taking away the abutters' right to privacy if the ADU sits on the property line and about the size and maximum height of the ADU. Hutchinson asked about in the ordinance where it says that the dwelling units should be no greater than 1,000 sq. ft. in total habitable space and how habitable space and gross floor area are defined. Wynne stated gross floor area is defined in the zoning ordinance and habitable space is part of the building and energy code typically. They are fairly common terms for contractors, but maybe there is an education component when that information is put on the website. Flowers opened the hearing to the public. Nat Carpenter, Prospect Hill, spoke in support of the proposed ADU ordinance. Libby Adams, 8 Bartlett St., spoke in support of the ADU ordinance. Quigley noted that the requirement for one main door may affect accessibility and encouraged thinking about aging in place safely. Don Preston, 3 Pickett St., spoke in support. Diantha Phothisan, 99 Corning St., read a statement from Stacy Rogers, 13 Beckford St., in support of ADUs. Jean Michael Fana with Harborlight Homes at 283 Elliott St. spoke in support. Danielle Spang, 16 Mulberry St., spoke in support. A member of Essex County Community Organization(ECCO) spoke in support of the changes. Bowen read comments from Carole Rein from Pratt Ave. in support of the ADU ordinance. Wynne summarized public comments received since May. There were 38 comments received via an online form or email with 36 in favor, 1 not in favor, and 1 not sure in regards to passing a general ADU ordinance. Since filing the ordinance, 8 more letters have been received which will also be added into the record.
