BOH minutes 10-18-23 City of Beverly, Massachusetts Public Meeting Minutes Board: Board of Health Date: October 18,2023 Place: Beverly Council on Aging Building Suites A& B Board members present:Dr.Justin Jordan,Rachel Morse,Esq.,Dr. Sheryl Silva Others present: Laura DelleChiaie,Director, Teresa Kirsch,Public Health Nurse,Joyce Redford, Director at North Shore/Cape Ann Tobacco Policy Program Recorder: Lynne DePiero,Administrative Assistant Dr. Jordan called the meeting to order at 6:30p.m. The minutes from the September 27, 2023 were approved with two amendments. Corner Variety— 84 Hale Street—requested a transfer of the tobacco permit.New owner intends to keep the operations the same—also owns a business in Danvers and is familiar with the regulations. Ms. Morse motioned to approve the permit transfer. Dr. Silva seconded— all in favor. Review application and variance for Nicole Mondello, body art practitioner. Ms. Mondello is required to complete an apprenticeship to obtain her hours necessary for a body art practitioner permit. She has already completed her schooling. Ms. Fabiane Tavares of Fabiane Tavares Beauty and Academy, has agreed to supervise Ms. Mondello on her apprenticeship. Ms. Morse motioned to approve the variance for a permit with the following conditions: 200 hour apprenticeship with the agreement if the Board enacts revisions to the regulations during the apprenticeship that Ms. Mondello abides to them. All body art related activities must be done in Fabiane Taveres'presence, and Fabiane Tavares must sign off on all hours completed under this apprenticeship. Dr. Silva seconded— all in favor. Request for an animal permit at 3 Monument Square— is on hold until the November Board meeting based on the coop location being less than 25 feet from a part of the applicant's house. Ms. DelleChiaie will discuss with Assistant City Solicitor, Beth Oldmixon. Dr. Jordan motioned to table request until the November Board meeting -Ms. Morse seconded. Lighthouse Wine & Spirits —requested a hearing regarding their violation of selling multiple products containing Delta-8 (synthetic cannabinoid) —the hearing will be moved to the next Board meeting in November as the establishment needs to be informed in writing of the meeting date. Going forward, any tobacco establishments that request a hearing due to a violation will receive a letter informing them of their hearing date. The Board asked if any other non-tobacco establishments need to be alerted about these infused synthetic cannabinoid drinks or food that are illegal to sell. Ms. DelleChiaie stated that she is working with the Mayor's office on sending out correspondence to all establishments. Establishments are responsible for keeping up to date on illegal products being sold in the marketplace. Laura DelleChiaie, Director, updates for the Board: The Medical Director, Dr. Demetrius Rizos, has been in the voluntary position since 9/10/2009. The Medical Director responsibilities have been primarily signing off on standing orders for vaccines. The Board discussed creating a term limit for the Medical Director that would be re- appointed on opposite years of the Board member terms. Dr. Silva stated that she would like to see a job description for this position. Ms. DelleChiaie is going to check in to see if Dr. Demetrius Rizos would be available to attend or zoom in for the November Board meeting to meet everyone and discuss the position. As an alternative, Dr. Jordan suggested if he cannot come to the meeting that he and Ms. DelleChiaie can do a zoom meeting with him. Dr. Silva updated us on meeting with the school dietician and food services director to discuss school lunches and healthy choices. They are enthusiastic about a meeting with the Board. The Board discussed going to the BHS school cafeteria for a tour. Ms. DelleChiaie will try to set up a time with them. Ms. Kirsch and Ms. DelleChiaie attended the HUB meeting to discuss the unhoused population in Beverly. The Police Department informed them that there are currently about 12-15 regularly unhoused individuals, with 4 or 5 who truly have nowhere to go. The tobacco renewal letter has been reviewed by Ms. Redford and Dr. Jordan. The department is working on a violation spreadsheet to track the last 3 years of establishment's violations. Currently Lush Ink is operating without a valid 2023 permit. A Cease and Desist Order has been delivered to Vanessa Brea at Lush Ink. The hearing will be scheduled for the November Board meeting. The North Shore Public Health Collaborative nurses are discussing the need for regional COVID-19 vaccination clinics. They are looking to schedule some before the holidays. She has handed out 12 outreach bags to the community impact unit at the Beverly Police Department for the unhoused population. She has provided rabies post-exposure prophylaxis counseling to individuals exposed to a bat in their home. Dr. Silva motioned to adjoin the meeting—Ms. Morse seconded—All in favor.
