Dr. Jordan called the meeting to order at 6:30 p.m.
The minutes of the February 15, 2023 and March 29, 2023 meeting were approved.
Mr. &Mrs. Decker of 32 Middlebury Lane and Mr. Leone Barletta of 5 Foster Street were present for
the review of their keeping of animals applications. The Decker's applied for 4 chickens and Mr.
Barletta applied for 5 chickens. Both requested were reviewed by the Board. Dr. Silva motioned to
approve, Ms. Morse seconded—both applications were approved.
Hannah Village Apartments were present and requested a life guard waiver for 2023.The Board
questioned their pool safety protocols. They stated that in order to access the pool you enter through the
clubhouse and down a hallway that has a door with a lock about 5' high to gain access to the pool area.
Pool gates are always locked and no children without adult supervision are permitted. The Board
requested for a photo to be sent of the double locked door. Dr. Silva motioned to approve,Ms. Morse
seconded—life guard waiver was approved.
Mission Boathouse had requested for a variance to open the windows and garage doors on the third floor
with no screens in place. The concern is with insects and pests entering the full bar area. They have
established daily procedures for maintaining safe sanitation practices which prevent insects and rodents
from entering the bar and the fully enclosed food prep area. Dr. Silva motioned to approve,Ms. Morse
seconded—variance request was approved.
The request for 12 Charles Street hearing, which landlord, Mr. Martin, and tenant, Ms. Johnson, were
present. The correction order stated that Mr. Martin hire a professional pest control operator. Mr. Martin
is requesting for the correction order to be modified so he can to continue to do his own rodent control
due to costs. The Board listened to both parties and concluded that it is a two part effort and it is the
responsibility of a landlord to hire a professional pest control company and for the tenant to keep food
and trash properly stored. The Board also reiterated that the tenant must give access to the landlord, an
original requirement of the correction order that must be upheld.
Fabiane Tavares requested a variance for her body art establishment permit with the following three
adjustments:
1. The rug flooring needs to be covered with an easily cleanable mat
2. To use a portable sink, not mechanically plumbed
3. To use a janitorial sink in unoccupied build out
Dr. Silva motioned to approve the variance - all which expire 6/30/23, Ms. Morse seconded— approved.
Erina Keefe the Sustainability Director attended the meeting to discuss dumpster regulations and
composting ideas. She explained that dumpsters are now having materials thrown in them that are
banned (not recyclable) and end up in transfer stations. She is advocating for a mandatory policy for
these haulers to have a way to recycle these banned items. She also discussed composting for restaurants
that have big food wastes, as well as, donating end of the day food surplus. These ideas are some ways
that could aid with food wastes being minimized into dumpsters, as well as, decreasing rodents. Ms.
DelleChiaie also discussed dumpster regulations and possibly permitting all dumpster owners so we
know their locations and who is responsible for each dumpster. We will continue to work with Ms.
Keefe in the upcoming months.
Ms. Redford from the Northshore/Cape Ann Tobacco Policy Program came to discuss the City of
Beverly's current tobacco regulations. She reviewed possible revisions that she will draft up for a public
hearing to be held on May 23, 2023. At the hearing the Board will be discussing 2 new regulations and 1
amended regulation.
1. Updating the existing tobacco regulations—retiring cap on tobacco permit, updating the language
to reflect changes in state law and revising penalties for violations
2. A new regulation concerning synthetic cannabinoids—adopt a new regulation to regulate
synthetically produced THC. This regulation will prohibit the ability to manufacture, distribute or
sell any product containing a synthetic derived cannabis including,but not limited to delta-8 and
delta-10
3. Adopt a new regulation restricting marijuana products where sales are not in compliance with the
regulations of the Cannabis Control Commission
A meeting regarding the Purdue Funds was held between Ms. DelleChiaie, the Mayor and Finance
Department. The School and Police departments were not present. The Mayor would like the three
departments to work together on a unified goal for ways to use the funds. It was suggested that some
funds could be used in collaboration with Be Healthy Beverly for substance use, more discussions to
come.
Dr. Jordan continued the discussion on community based health programs and the possibility of a Drug
Free Grant. Ms. DelleChiaie will advocate for this. Also discussed was a desire for transportation access
with opioid settlement funds.
Ms. DelleChiaie reported that the Health Department will be holding its Hazardous Household Waste
Day on Saturday, April 22, 2023 at Beverly High School. She is working on hiring a third Sanitarian to
add to the Health Department staff. She is planning on discussing the 1st Amendment Audits and how to
handle them with her staff at their next staff meeting. Staff and Board members will be a participating in
a live, virtual training concerning racial equity.
Teresa Kirsch, Public Health Nurse,Updates for the Board:
The 7-day average/100K(4/9/23-4/15/23) Covid case reports were at 3.13%, and the 14-day
average/100K(4/2/23-4/15/23) cases reported were at 2.43%. The Covid numbers to date (4/17/23) in
Beverly are 11,470 total cases confirmed, 256 deaths, 11,202 (last month the number was misreported at
11,209 should have been 11,161) confirmed cases who have recovered and 963 probable cases. These
numbers do not include home tests that were positive.
The Diaper Drive is underway with collection boxes located at Beverly City Hall, The Health
Department/COA and the two libraries.
Beverly and the surrounding North Shore Public Health Nurses (PHN) are planning an appreciation
luncheon for the Mass. Medical Reserve Corp (MRC)volunteers who participated in the Board of
Health clinics during COVID-19. It will be held on May 23, 2023 at Essex Tech in Danvers.
With the COVID public emergency set to expire and reports of cases steadily declining,the PHN's from
Beverly and surrounding towns are discussing ways to use the grant funded outreach individuals who
were hired to contact trace. One idea is to have them work with local Senior Centers to provide outreach
to seniors to help combat isolation, loneliness and depression.
Ms. Kirsch continues to provide Directly Observed Therapy(DOT) 5 days a week, expected to continue
for 2 additional months. She continues to investigate infectious disease reports through MAVEN and by
providers.
Dr. Silva motioned to adjoin the meeting. Ms. Morse seconded.
The meeting was adjourned at 9:05 P.M.
