Dr. Jordan called the meeting to order at 6:31 p.m.
The minutes of the October 19, 2022 meeting were approved and accepted.
Teresa Kirsch, Public Health Nurse updates for the Board:
The 7-day average/100K(10/30/22-11/05/22) Covid case reports were at 12.17%, and the 14-day
average/100K(10/23/22-11/15/22) cases reported were at 13.74%. The Covid numbers to date
(11/08/22)in Beverly are 10,725 total cases confirmed, 233 deaths, 10,439 confirmed cases who
have recovered and 739 probable cases.
The North Shore Public Health Nurses (NS PHN's) and volunteer staff have continued to have
flu clinics throughout the region, the attendance has been low.
The NS PHN's have scheduled three COVID booster clinics—Beverly Senior Center 11/15/22,
2:30-5:30pm, Salem Community Life Center 11/16/22, 9:00-11:00am and Danvers Senior Center
11/17/22, 2:00-5:OOpm. Beverly has received 200 doses of the Moderna Bivalent vaccine for the
3 clinics. Dr. Jordan asked about the enrollment and Ms. Kirsch mentioned that the clinics are
open to everyone age 18 and up and not just for Beverly residents. Enrollment is still pretty low—
Beverly to date has 60 registrants and Salem and Danvers have low numbers. If we have extra
doses we can give to surrounding towns for their vaccination clinics.
Mr. Kruczynski of 267 Rantoul Street requested a hearing in regards to a correction order for
excessive trash observed in a passage way as a means of egress for 2 buildings. The Board of
Health Inspector Mr. Coulon observed this violation on 10/25/22. Mr. Kruczynski said that he
hired a junk company to come by and clean up the area, which he showed a receipt of. Mr.
Coulon went by the address and took pictures on 11/8/22 and observed that there were still paint
cans piled up. Mr. Kruczynski wanted to show good faith and will continue to clean up the paint
cans. Mr. Burke advised him to add kitty litter to the latex paint cans and put them out in the
trash. Mr. Coulon was not present at the time of the hearing but arrived a little later. The Board
updated Mr. Coulon on their conversation with Mr. Kruczynski and wants to pursue non-criminal
follow up and have Mr. Coulon recheck the progress of this address in 30 days.
Ms. Oldmixon, the City Solicitor addressed the Board on the Cabot Smoke Shop violations. She
handed out a draft letter for everyone to review the multiple violations against the establishment.
The draft outlines the prior violations and what the Board of Health's responsibilities are. Ms.
Oldmixon initial suggestion was for this third violation to get a notice of intent to suspend their
license for 30 days and a $5,000. fine. If there was an additional violation then proceed with the
revocation of the license. Dr. Jordan and Ms. Higgins had some questions and concerns about the
violations. Dr. Jordan said that the violations are egregious and are causing harm to the city. Ms.
Higgins agreed with Dr. Jordan and said we should look into the possibility of revoking their
license. Ms. Higgins said we should rise to the challenge. Ms. Oldmixon said it is not wrong to
go to revocation. Mr. Burke wants to make sure we are on solid legal ground before we move
forward with the possibility of taking their livelihood away. Ms. Higgins asked if the intent
notice needed to be specific of the punishment or can it be decided after the hearing. Ms.
Oldmixon said she will update the notice of intent order letter with the hearing date and what the
punishment can be and that it will be decided after the Board Hearing. Ms. Higgins and Dr.
Jordan both agreed that they may need time to discuss the hearing and if necessary we will
schedule a closed session the following Wednesday, December 28, 2022 for disciplinary actions.
Ms. Oldmixon will send the revised letter to Mr. Burke for review and then will be mailed out to
Cabot Smoke Shop.
Mr. Burke had some staffing updates—Kristin Esposito McRae has started as an Inspector and
has been working out well, she comes with 20+years of experience. Mr. Burke expressed
concerns that part-time inspectors are paid a higher hourly rate than full time employees. Mr.
Burke has been in touch with Human Resources about updating his job description. The Board
talked about perspective new Board Members. Dr. Jordan suggested that he should send an email
to the Mayor inquiring next steps for the Board due to Mr. Burke and Ms. Higgins no longer
being here next year.
Ms. Higgins inquired about 2023 Hazard Household Waste Days, Mr. Burke commented that he
has been unable to get a response from the vendor, Clean Harbors, about a date. He stated that
the Board of Health experienced a similar circumstance last year with no commitment until late
winter, early spring. This matter in all likelihood needs to be followed up by others after Mr.
Burke's retirement date of 1/6/23. Dr. Jordan asked about Beverly's outdoor barrels at the parks,
Ms. Higgins said there is no easy solution, people throw household items in them.
Dr. Jordan also inquired if we think we need police at the next Board meeting for the Hearing?
Ms. Higgins suggested maybe just having an officer here due to the violations that are the cause
of the Hearing. Mr. Burke will inquire.
Dr. Jordan motioned to adjoin the meeting. Ms. Higgins seconded.
The meeting was adjourned at 7:50 P.M.
The next meeting will be scheduled for December 21, 2022.
