BOH minutes 9-21-2022 City of Beverly, Massachusetts Public Meeting Minutes Board: Board of Health Date: September 21,2022 Place: Beverly Council on Aging Building Suites A& B Board members present: Dr.Justin Jordan MD,Ms.Susan Higgins Others present: Teresa Kirsch,Public Health Nurse,Joyce Redford,North Shore Tobacco Control Recorder: Lynne DePiero Dr. Jordan called the meeting to order at 6:35 p.m. The Board approved and accepted the minutes of the June 22, 2022 meeting. Darshan Patel, Borah's Convenience— 175 Rantoul Street—requested a hearing, Violation of 105 CMR 665.000 Minimum Standards for Retail Sale of Tobacco and Electric Nicotine Delivery Systems —first violation. Darshan appealed asking to waive the fee and suspension. Stating that by the time he received the letter his film was not available anymore from August 4. He has since purchased the software to scan licenses so that this will never happen again. He asked seeing that this was his first offense if it could be waived. Joyce Redford of North Shore Tobacco Control had the packaging of what was purchased and stated that an ID was never asked for. She told him that the new regulations are $1,000. fine and 3-day suspension for your first violation. Ms. Higgins thanked him for his efforts to keep tobacco out of youth's hands, but regulations do not allow waivers to reverse. Dr. Jordan also thanked him for coming and stated that the violation did happen and you have to pay the consequences. Mr. Patel then asked if he could have the 3-day suspension lifted, but he would pay the fine. His employee that sold the product admits to the mistake and also asked if the notice had to be posted about the suspension. Dr. Jordan stated that it stands as what the regulations say. Ms. Higgins motioned to follow regulations of paying the fine and 3-day suspension, Joyce also reiterated that all tobacco products need to be removed from the establishment. Dr. Jordan seconded the motion. Teresa Kirsch, Public Health Nurse had updates for the Board: The 7-14 day Covid cases reported to date were at 12.87%, she has not been receiving many reports from schools. All confirmed and probable Covid cases are assigned to a case investigator for follow-up. The Health Department still has 2 part-time registered nurse case investigators. A regional grant funds 3-5 more case investigators. Ms. Kirsch reported there have been less than 5 reported cases of Monkeypox in the city of Beverly. Salem had a Monkeypox vaccine clinic and had 16 participants. Updates on the Flu Clinic in Beverly—we have received the vaccines,we are just trying to finalize the date and venue. There is a Is'Responders clinic next Tuesday 9/27, the numbers seem to be down. Dr. Jordan asked if there was some sort of outreach we could do, Ms. Kirsch commented that she has and most likely responders will just show up rather than registering ahead of time. There was a multi-state salmonella outbreak that affected Beverly and the Northshore. Cases reported at the end of July and into early August. It appears that July 18 - July 26 is the timeframe of the outbreak. Ms. Kirsch worked with other Northshore communities to identify additional cases. The organism was identified as Salmonella Mississippi. The CDC/FDA will keep the case open in the event of another outbreak. Ms. Higgins asked if there should be any concerns for polio vaccinations. Dr. Jordan said to his knowledge there are no updated policies on polio vaccines and no general concerns. Ms. Higgins commended Bill Burke on his Annual Report—she said it was well done—great work for such a small group! Ms. Higgins asked Dr. Jordan about his meeting with the Mayor, Jocelyn and Mr. Burke about the possibilities of collaborating with surrounding town Chairs of the Board of Health for ways to work together—Dr. Jordan was excited about the meeting and the possibilities. Dr. Jordan brought up one item that was not on the agenda—mask advisory—the Board decided to wait until next meeting to add it to the agenda and discuss what orders were still in place, expired or need to be rescinded. Dr. Jordan also discussed how he attended a Brain Summit held by The American Neurology Association. He asked what was the history of health fairs held in Beverly. Ms. Kirsch said they really have not had them since she has been here. Suggestions were made to maybe collaborate with the YMCA, the BCOA and look for other areas to educate and reach out, such as, BevCam, the High School and even having High School interns so that all ages were educated on Brain Health. Dr. Jordan motioned to adjoin the meeting. Ms. Higgins seconded. The meeting was adjourned at 7:20 P.M. The next meeting will be scheduled for October 19, 2022. Respectfully submitted, Lynne DePiero
